The total number of acres for Amendment is 04-008 is 0.72. The total number of acres for
Amendment 04-011 is 0.29. With the adoption of these amendments, the cumulative total of
acreage to date for the 2004 calendar year is 13.65 acres.
Enclosed are Ordinances 04-083 and 04-086, reflecting approvals by the City Commission on
October 19, 2004, the publication notices, an updated land use map with the boundaries and

16 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
17 adopted a Comprehensive Future Land Use Plan and as part of said Plan a Future Land
18 Use Element pursuant to Ordinance No. 89-38 and in accordance with the Local
19 Government Comprehensive Planning Act; and
20 WHEREAS, the procedure for amendment of a Future Land Use Element of a
21 Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed;

23 WHEREAS, after public hearing and study, the City Commission deems it in
24 the best interest of the inhabitants of said City to amend the aforesaid Element of the
25 Comprehensive Plan as provided.
26 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
27 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

virtue of the adoption of this Ordinance until all statutory required review is complete and
all legal challenges, including appeals, are exhausted. In the event that the effective date is
established by state law or special act, the provisions of state act shall control.

CONFLICTS, SEVERABILITY, AND AN
EFFECTIVE DATE.

20 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
21 adopted Ordinance No. 02-013, in which a Revised Zoning Map was adopted for
22 said City; and
23 WHEREAS, Boynton Mango, LLC., owner of the property located at the
24 Northwest comer of Boynton Beach Boulevard and Northwest 7th Court in Boynton
25 Beach, Florida, as more particularly described hereinafter, has heretofore filed a
2 6 Petition, through its agent, Maggie Barszewski, pursuant to Section 9 of Appendix
27 A-Zoning, of the Code of Ordinances, City of Boynton Beach, Florida, for the
28 purpose of rezoning a parcel of land, said land being more particularly described
29 hereinafter, from Single Family Residential (R-I-A) to Neighborhood Commercial
30 (C-2); and

2 WHEREAS, the City Commission conducted a public hearing and heard
3 testimony and received evidence which the Commission finds supports a rezoning
4 for the property hereinafter described; and
5 WHEREAS, the City Commission finds that the proposed rezoning is
6 consistent with an amendment to the Land Use which was contemporaneously
7 considered and approved at the public hearing heretofore referenced; and
8 WHEREAS, the City Commission deems it in the best interests of the
9 inhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter
1 0 set forth.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
12 COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

Section 1.
The foregoing Whereas clauses are true and correct and
14 incorporated herein by this reference.

Section 2.
The following described land, located at the Northwest
16 corner of Boynton Beach Boulevard and Northwest 7tl1 Court in the City of Boynton
17 Beach, Florida, as set forth as follows:

20 according to the plat recorded in Plat Book 23, Page 236,

conditions:
The above-referenced rezoning is subject to the following
I. The buffer wall required between the commercial and residential zoning districts
shall be enhanced). with appropriate landscaping on both sides. setback an
additional three (3) feet from the property line (for an overall setback of five (5)
feet from the property line. and shall extend south along the east propertY line a
minimum distance to buffer the adiacent residence without interfering with
planned driveways and clear site triangles: and.
2. Any structure placed on the above-described property shall be located as close to
Bovnton Beach Boulevard as permitted bv the Citv Land Development
Regulations in order to minimize the impacts on the existing single-fanrilv
neighborhood
Section 4. That the aforesaid Revised Zoning Map of the City shall be amended

accordingly.

Section 5. All ordinances or parts of ordinances in conflict herewith are

hereby repealed.

Section 6. Should any section or provision of this Ordinance or any portion
25
thereof be declared by a court of competent jurisdiction to be invalid, such decision shall
26
not affect the remainder of this Ordinance.

Section 7. This ordinance shall become effective immediately upon passage.
