Kilday Kilday & Associates, Inc. 1551 Forum Place, Suite 100A West Palm Beach, FL 33401 Re: South Congress Residential LUAR Dear Sir: At the time the Boynton Beach City Commission approved the above referenced future land use map amendment for transmittal to the Florida Department of Community Affairs, you were apprised of the fact that the companion rezoning of the property to a Planned Unit Development will not be adopted without the required Master Plan. At the time the application was submitted, staff was told that the applicant did not want to spend money on a site plan when there was a possibility that the land use amendment would not be approved: however, in light of the approval for transmittal, it was assumed that the master plan would be forthcoming. In a conversation with Jamie Gentile, with your office, I informed him that in order to adopt the land use amendment and rezoning with the second reading of the ordinances at the December 3, 2002 City Commission meeting, the deadline for master plan submittal was August 21,2002. This was assuming that the ORC report would be received during the first week of September, as DCA has advised and that the City would have sixty (60) days to adopt. I was in error on this matter. It is imperative. however. that your client submits his proposed master plan for review no later than September 18, 2002, if the land use amendment is to be adopted in the 2002 amendment cycle. Section V.D.3 (Exemptions) of the Interlocal Agreement, which established Public Schoo Concurrency, states the following: "Arty new Residential Development that has filed a complete application for a site specific development order or any amendment to any previously approved site specific development order pending prior to the comrnencement date of the School Concurrency Program shall be exempt from the School Concurrency Requirements." Since South Congress Residential submitted a complete application to the City of Boyntor Beach prior to the commencement date of the School Concurrency Program (June 27,2002) the proposecl development is not subject to review for School Concurrency. Access Scenario No. 1 aligns the project driveway with the existing traffic signal at the Hunters Run full median opening on Congress Avenue. Access Scenario NO.2 proposes to have the access for the apartment complex offset from the signal to the north (the conclusions for Access Scenario No_ 2 would apply with the driveway offset to the north or to the south). Palm Beach County Traffic Division will require, as a condition of the permit, that the apartment complex access align with the existing traffic s;gna! at the fun rnediail opening. This office, as a standard, requires thai proposed driveway connections align with existing traffic signals where possible from both a traffic operations and safety standpoint.
