RECOMMENDATION: Please place this request on the April 15, 2003 City Commission Agenda under
Legal, Ordinance - Second Reading. The City Commission with a 4 to 0 vote, recommended approval under First Reading
on April I, 2003. The Agenda Request for First Reading on April I, 2003 under description should have read, "to request to
rezone 49.695 acres of the Motorola DRI from PID Planned Industrial District to C-3 Community Commercial district". Due

PROJECT ANALYSIS
Tne parcels, which are the subject: of this land use amendment. total =49.69 acres. Because of
the size of the property under consideration, the Florida Department of Community Affairs
classifies this amendment as a "large-scale" amendment. Following local board review and Cit;
Commission public hearing, a "large-scale" amendment is transmitted to the Florida Departmen,
of Community Affairs for review for compliance with b'1e state. regional and local comprehensiv'O'
plans prior to adoption. Following the review perioc of approximately 60 days, DCA provides
the City wib'1 a report of their findings in an "Objections, Recommendations and Comments
(ORC) Report". Tne City then has 60 days to eib'1er (1) adopt the amendment as transmitt'O'd,
(2) adopt b'1e amendment wib'1 changes in response to b'1e ORC report. or (3) determine noe to
adopt the amendment and inform DCA of that decision. According to Fiorica Statutes Chapt'O',
163, large-scale amencments may only be adopt'O'd during tNO amendmen, cycles each
calendar year. An exception to that rule is in the case of a Development of Regional Impact:
(DRl) where b'1e law permits amendments to be adopted without being subject to the twice-
yearly restrictions.
Tne criteria used to review Comprehensive Plan amendments and rezonings are listed in the
Land Development Regulations, Chapter 2, Section 9. Administration and Enforcement, Item C.
Comprehensive Plan Amendments: Rezonings. These crit'O'ria are required to be part of a staff
2nafysis when t~e proposed c:,ange induces an amendmenc co the Comprehensf'le Plan Future
Land Use ~lap.
a. Whether the proposed land use amendment/rezoning would be consistent with
applicable comprehensive plan policies including but not lirT7/ted to, a prohibition

pattern, or would create an isolated district unrelated to adjacent and neariJy
diS-Jicts, or would constjtute a grant of special priVilege to an individual properry
owner as conrrasted with the protecion of the public welfcre.
Tile proposed land use amendment/rezoning would not create an isolated dis-wict, but would
relate to t'1e adjacent lands to the west across Congress Avenue that are developed with
commercial uses (Catalina Center) and are designated Local Retail Commercial and zoned C-3,
Community Commercial.

Tner.e are several condioons that have chanoed since the DP.l, consisting of ::85.55 acres, was
aoproved in 1979. Tne project was originally. expected to develoo at buildout with a total of
325,000 square Feet of industrial, research and development, and office uses. Even as planned,
:his was an extremely inefficient use of land, with a floor area ratio (FAR) of 0.22, compared to
che maximum permitted by the development regulations (60% lot coverage x 4 stories= 2.4
=AR). As the environment of t'1e telecommunications industry changed, the demand for the
:eveloped space lessened, and the Final phase, which consisted of 200,000 square Feet of office
ipace, was never developed. Instead, Motorola has drastically reduced their operations wit'1in
"'1e city, leaving 70% of the existing Facilities vacant. T;1e current industrial market condioons
-emain poor. Moreover, the specialized nature of the existing buildings decreases their potenoal
ldaptability for other industrial uses.

Tne traffic analysis submitted on behalf of the apolicant states tilat the ~lotorola DRI was
approved for 625,000 square feet of manufacturing space and 200,000 square feet of office use.
Tnis would vest tile project for 13,020 daily trips and 1,634 peak hour trips. According to that
same study, the proposed development plan will be limited to only generate a comparable
number of daily trips as are vested for t'le Sit2. Tner2 are no projected increases In the daily
and peak hour trips above the vested number. (Attachment "B")
Utilizing Departrnent of Healt'l standards, t'le applicant Stat2S that when 1'10torola was operating
at full capacity, sewage Row was estimated at 62,500 gallons per day (gpd) and the estimated
water demand was 75,000 gpd. Tne Gty recogniz2s prior vesting (for planning purposes) in the
site of 127,000 gpd each for potable wat2r and sanitarl sewer. The developer is responSible For
reser/ing or purchasing ail additional water anc sewer c2pacity noe pre'/icusly purc.~ased by the
prior owners of t'le property.
With respect to solid waste, in a letter dated December 18, 2001 the Palm Beach County Solid
Waste Aut'lority has stated that adequate capacity exis"<.5 to accommodate the county's
municipalities throughout the lO-year planning period. Tne School Dis"crict of Palm Beach County
has reviewed t'le project and approved it for school concurrency. Lastly, drainage will also be
re'/iewed in detail as part of the review of the cOildltional use application, and must satisfy all
requirements or u~e city and local drainage permitting authorities.

use of adjacent and nearby properties,. or would affect the property values of
adjacent or nearby properties.

A portion of the property is developed wit'l 625,000 squere Fee, of industrial space, including
ancillarl office and storage, and an additional 200,000 square f2et of office use is approved but
unbuilt. As explained in (c), the specialized nature of the existing buildings limits t'leir potendal
adapcability for other industrial uses, including orner desirable light industrial uses. Tne
demand in recent years has been focused on warehousing and dist,ibution; howe'ler, after a
reiatively Icr.g period of high cons"..ruction ac.:jvit/, che local industrial markets have been
negatively affected by the economic downturn. Given the overall market conditions, it may be

Over the past decade, the conc:pt of an ir,<;Justrial park has evolved from its traditional
character of a basic, single use industrial area to a fiexible district form featuring a mix of
components tailored to the ne,,:ds of local business ard industrial groups. Tne mix may contain
industrial, finance, technology and research as we!1 as other uses, including residential and
retail. Tne siz,,: of the Motorola DRI sit: makes it an ideal candidat: for such redeve!opmenc.
It is expected that the mast:r plan for the project will be de'/eloped with this conceat in mind.
As such, it will contribut: to economic development of the City. Additionally, mixed-use
developments that include housing, shopping and employment opportunities offer the possibiliC'(
of internal capture of traffic that single-use developments do not.
h. Whether there are adequate sites elsewhere in the cit>/ for the proposed user in
distnd:s where such use is already allowed.
The sit: is one of the two De'lelopments of Regional Impact in the City. Tne other, Quantum
Park, has already almost compiecely deve'oped with a mixture of industrial, commercial anc
residential uses. The subject site is the only other place in the City where such a mixture of
uses can occur in close proximity to the retail core anchored by the Boynton Beach Mall.
CONCLUSIONS I RECOMM ENDA TIONS
fts indicated herein, this request is consistent with the intent of t'1e Comprehensive Plan; will
not create additional impacts on infrastructure that have not been anticipated in the
Comprehensive Plan; will be compatible wit'1 adjac:nt land uses and will contribute to t'1e
overall economic development of t'1e City Tnerefore, staff recommends that the subject
request be aoproved. If t'1e Planning and De'/e!opmem Board or the City Commission
recommends conditions, they will be included wit'1in Exhibit "C".

Attached please find a Comprehensive Plan Amendment trip generation analysis for the above
referenced project.
The existing land use designation on the 85.54 acre site is Industrial. It is proposed to change the
land use on a portion or the site. Proposed land uSe designations are Local Retail Commercial on
4S.4S acres and Industrial on the remaining 40.09 acres. Ci~1 code allows 40% lot coverage and 4
stories for Local Retail Commercial and 60% lot coverage and 4 stories for Industrial.
The owner/developer cannot build to this intensity because of an existing ORion the property.
Therefore, the owner/developer will voluntarily restrict the uses and intensities of the site. The
maximum development will be limited based on the total external trips approved ror the existing
DRI.
Attachment 1 presents a comparative trip generation analysis for the existing land use designation,
proposed land use designation and the proposed development plan. The maximum 13,020 new
external daily trips is the threshold currently approved under the Motorola DR!.

NOTICE OF REZONING
NOTICE IS HEREBY GIVEN that the City Commission of THE CITY OF BOYNTON BEACH, FLORIDA,
will conduct a PUBLIC HEARING, on Tuesday, April 15, 2003 at 7:00 p.m. or as soon thereafter as the
agenda permits in the CITY HALL COMMISSION CHAMBERS, 100 East Boynton Beach Boulevard, to

All interested parties are notified to appear at said hearings in person or by attorney and be heard. Any
person who decides to appeal any decision of the Planning and Development Board or City
Commission with respect to any matter considered at these meetings will need a record of the
proceedings and for such purpose may need to ensure that a verbatim record of the proceedings is
