Under the provisions of this law, the Department of Community Affairs (DCA) prepares an Objections, Recommendations, and Comments (ORC) Report on a proposed amendment only if requested to do so by the local government, the regional planning council, or an affected person or if an ORC Report is otherwise deemed necessary by the DCA. If the local government requests the DCA to prepare an ORC Report, then Council must provide the DCA with its own objections, recommendations for modification, and comments on the proposed anlendment within 30 days of its receipt. Background The City of Boynton Beach is proposing one Future Land Use Map (FLUM) amendment. The FLUM amendment is shown on the attached map. The City has requested that the DCA prepare an ORC Report. Evaluation Future Land Use Map Amendment LUAR 02-007-This amendment involves approximately 49.7 acres located at the southeast comer of Congress Avenue and Gateway Boulevard. The proposal is to redesignate a portion of the 85.6-acre Motorola Development of Regional Impact (DR!) development from Industrial to Local Retail Commercial to allow development of 500 multi-family residential units and 63,500 square feet of commercial development. The site is presently vacant. The surrounding existing land uses include the developed portion of the Motorola DRI to the north, the C-16 Canal and vacant property to the south, Lake , Worth Drainage District E-4 Canal and the Boynton Beach High School to the east, and commercial development (Catalina Center) to the west. The surrounding FLUM designations include Industrial to the north, Moderate Density Residential to the south, Government/Institutional to the east, and Local Retail Commercial to the west. As stated above, the 49.7 acres is part of the approved Motorola DRI. The amount of development approved for the entire Motorola DRI and the mitigation of impacts created by the project are governed by the DRI development order. The applicant has applied to amend the DRI development order in conjunction with this land use amendment. The proposed amendments to the DRI development order were detennined not to create a substantial deviation requiring additional DRI review. Extrajurisdictional Impacts Analysis of the amendment indicates that it would not have any significant adverse impacts on neighboring jurisdictions. Effects on Significant Regional Resources or Facilities Analysis of the proposed amendments indicate that it would not have adverse effects on significant regional resources or facilities. Objections, Recommendations for Modification, and Comments A. Objections None B. Comments 1. The Strategic Regional Policy Plan for the Treasure Coast Region encourages the formation of sustainable neighborhoods and communities. Sustainable communities should include a compatible mix of land uses, well designed and maintained public spaces, buildings and infrastructure, and a network of interconnected streets designed for various transportation modes. Council strongly encourages continued efforts to provide for mixed-use development in the City. However, if the City and its residents expect to achieve all the benefits associated with mixed-use development, it must be executed properly. Such benefits are achieved when the mix of uses and associated parking are arranged and designed along a street not just for cars but to create a comfortable and enjoyable environment for human interaction and use. There should be not only a fully integrated mix of uses but also a dense network of walk able streets and sidewalks that ties uses together and accommodates present or future public transit. There should be both a vertical and horizontal integration of land uses, and the uses should be of a type and nature that are appropriate and complementary to this network of pedestrian-friendly streets. The plan of development proposed for the Motorola site does not incorporate all the best components of mixed-use development. Council is available to assist the City in working with the developer of the property to ensure that the proposed development contains all the important components of authentic mixed-use development. Recommendation Council should adopt the above comments and approve their transmittal to the Department of Community Affairs. Local Government Comprehensive Plan Review Draft Amendments to the CIty of Boynton Beach Comprehensive Plan DCA Reference No, 03-01 Introduction The Local Government Comprehensive Planning and Land Development Regulation Act, Chapter 163, FLorida Siatutes, requires that Council review local government comprehensive plan amendments prior to their adoption, Under the provisions of this law, the Department of Community Affairs (DCA) prepares ObjectlOns, Recommendations, and Comments (ORC) Report on a proposed amendment only if requested to do so by the local government, the regional planning council, or an affected person or if an ORC Report is otherwise deemed necessary by the DCA. If the local government requests the DCA to prepare an ORC Report, then Council must provide the DCA with its own objections. recommendations for modification, and comments on the proposed amendment within 30 days of its receipt. Background The City of Boynton Beach IS proposing one Future Land Use Map (FLUM) amendment. The FLUM amendment is shown on the attached map. The City has requested that the DCA prepare an ORC Report. EvaluatlOn Future Land Use J\.lap Amendment LUAR 02-007-This amendment involves approximately 49,7 acres located at the southeast comer of Congress A venue and Gateway Boulevard, The proposal is to redesignate a portlOn of the 85,6-acre Motorola Development of Regional Impact (DRI) development from Indllstrial to Local Retail CommercIal to allow development of 500 multI-family resldential units and 63,500 square feet of commercial development, The site IS presently vacant. The surrounding existmg land uses include the developed portion of the Motorola DRI to the north. the C-16 Canal and vacant propel1y to the south, Lake DRAFT Subject to Modifications WOl1h Dramage District E-4 Canal and the Boynton Beach High School to the east, and commercial development (Catalma Center) to the west. The sUlTounding FLUM designations include Industrial to the north, Moderate Density Residential to the south, GovenmlcnL'lnstitutional to the east, and Local Retail Commercial to the west. As stated above, the 49.7 acres is part of the approved Motorola DRI. The amount of development approved for the entire Motorola DR! and the mitigation of impacts created by the project are govemed by the DRI development order. The applicant has applied to amend the DRl development order in conjunction with this land use amendment. The SU'Ulegic RegIOnal Policy Plall for the Treasure Coast Region encourages the fonnatlOn of sustainable neighborhoods and communities, Sustainable communities should include a compatible mIx of land uses, well designed and maintained public spaces. bLlildings and mfi'astructure. and a network of intercoilllected streets designed for various transportation modes, Council strongly encourages continued efforts to provide for mIXed-use development in the City, However, if the City and its residents expect to achieve all the benefits associated with mixed-use development, it must be executed properly, Such benefits are achieved when the mix of uses and associated pm']ong are alTunged and designed along a street not just for cars but to create a comfortable and enjoyable environment for human interaction and use. There should be not only a fully mtegrated mix of uses but also a dense network of walkable streets and sidewalks that ties uses together and accommodates present or future public tranSlt. There should be both a vertical and honzontal integratIon of land uses. and the uses should be of a type and nature that are appropriate and complementary to this network of pedestnan-friendly streets. This was the simulation test we agreed to in the electronic message of December 8, 2002. A copy of the test results, in the January 24, 2003 memo from Pete Mazzella to me, is attached, I am very pleased that we were able to conduct this simulation test by using our own existing Utilities Department staff, rather than using an outside consultant at a potential cost of $25,000.00. In fact, it looks as though the total cost associated with the necessary system modifications will be limited to $10,178.00. With the proposed improvements, it appears that our sanitary sewer system will be able to accommodate the anticipated flows as outlined in Attachment "An of the report. Because of the size of the property under consideration, the Florida Department of Community Affairs classifies this amendment as a "large-scale" amendment. Following local board review and City Commission public hearing, a "large-scale" amendment is transmitted to the Florida Department of Community Affairs for review for compliance with the state, regional and local comprehensive plans prior to adoption. Following the review period of approximately 60 days, DCA provides the City with a report of their findings in an "Objections, Recommendations and Comments (ORC) Report". The City then has 60 days to either (1) adopt the amendment as transmitted, (2) adopt the amendment with changes in response to the ORC report, or (3) determine not to adopt the amendment and inform DCA of that decision. According to Florida Statutes Chapter 163, large-scale amendments may only be adopted during two amendment cycles each calendar year. An exception to that rule is in the case of a Development of Regional Impact (DRI) where the law permits amendments to be adopted without being subject to the twice- yearly restrictions. The criteria used to review Comprehensive Plan amendments and rezonings are listed in the Land Development Regulations, Chapter 2, Section 9, Administration and Enforcement, Item C. Comprehensive Plan Amendments: Rezonings. These criteria are required to be part of a staff analysis when the proposed change includes an amendment to the Comprehensive Plan Future Land Use Map. a. Whether the proposed land use amendment/rezoning would be consistent with applicable comprehensive plan policies including but not limited to, a prohibition against any increase in dwelling unit density exceeding 50 in the hurricane evacuation zone without written approval of the Palm Beach County Emergency Planning Division and the City's risk manager. The planning department shall also recommend limitations or requirements, which would have to be imposed on subsequent development of the property, in order to comply with policies contained in the comprehensive plan. The property is not located in the hurricane evacuation zone; therefore, the prohibition against increasing residential densities does not apply. Other applicable policies from the comprehensive plan are cited below. The proposed development for the site is consistent with both of the cited policies in that it will provide both commercial and residential development. This development, as well as the redevelopment of that portion of the site remaining with an "Industrial" land use designation and PID zoning, is expected to generate employment opportunities and provide goods and services, as well as add to the range of housing opportunities in the City. b. Whether the proposed rezoning would be contrary to the established land use pattem, or would create an isolated district unrelated to adjacent and nearby districts, or would constitute a grant of special privilege to an individual property owner as contrasted with the protection of the public welfare. The proposed land use amendment/rezoning would not create an isolated district, but would relate to the adjacent lands to the west across Congress Avenue that are developed with commercial uses (Catalina Center) and are designated Local Retail Commercial and zoned C-3, Community Commercial. c. Whether changed or changing conditions make the proposed rezoning desirable. Ther.e are several conditions that have changed since the DRI, consisting of :t85.55 acres, was approved in 1979. The project was originally expected to develop at buildout with a total of 825,000 square feet of industrial, research and development, and office uses. Even as planned, this was an extremely inefficient use of land, with a floor area ratio (FAR) of 0.22, compared to the maximum permitted by the development regulations (60% lot coverage x 4 stories= 2.4 FAR). As the environment of the telecommunications industry changed, the demand for the developed space lessened, and the final phase, which consisted of 200,000 square feet of office space, was never developed. Instead, Motorola has drastically reduced their operations within the city, leaving 70% of the existing facilities vacant. The current industrial market conditions remain poor. Moreover, the specialized nature of the existing buildings decreases their potential adaptability for other industrial uses. Page 4 File Number: LUAR 02-007 Motorola DRI The reduction of the local Motorola labor force over recent years has negatively impacted the local economy. The proposed reuse of the site as a multi-use development with a commercial component will serve as an employment generator, establishing a partial compensation for industrial employment losses. d. Whether the proposed use would, be compatible with utility systems, roadways, and other public facilities. The traffic analysis submitted on behalf of the applicant states that the Motorola DRl was approved for 625,000 square feet of manufacturing space and 200,000 square feet of office use. This would vest the project for 13,020 daily trips and 1,634 peak hour trips. According to that same study, the proposed development plan will be limited to only generate a comparable number of daily trips as are vested for the site. There are no projected increases in the daily and peak hour trips above the vested number. (Attachment "B") Utilizing Department of Health standards, the applicant states that when Motorola was operating at full capacity, sewage flow was estimated at 62,500 gallons per day (gpd) and the estimated water demand was 75,000 gpd. The City recognizes prior vesting (for planning purposes) in the site of 127,000 gpd each for potable water and sanitary sewer. The developer is responsible for reserving or purchasing all additional water and sewer capacity not previously purchased by the prior owners of the property. With respect to solid waste, in a letter dated December 18, 2001 the Palm Beach County Solid Waste Authority has stated that adequate capacity exists to accommodate the county's municipalities throughout the la-year planning period. The School District of Palm Beach County has reviewed the project and approved it for school concurrency. Lastly, drainage will also be reviewed in detail as part of the review of the conditional use application, and must satisfy all requirements of the city and local drainage permitting authorities. e. Whether the proposed rezoning would be compatible with the current and future use of adjacent and nearby properties, or would affect the property values of adjacent or nearby properties. Refer to responses provided under items ''bHand ''c'; above. f. Whether the property is physically and economically developable under the existing zoning. A portion of the property is developed with 625,000 square feet of industrial space, including ancillary office and storage, and an additional 200,000 square feet of office use is approved but unbuilt. As explained in (c), the specialized nature of the existing buildings limits their potential adaptability for other industrial uses, including other desirable light industrial uses. The demand in recent years has been focused on warehousing and distribution; however, after a relatively long period of high construction activity, the local industrial markets have been negatively affected by the economic downturn. Given the overall market conditions, it may be Page S File Number: LUAR 02-007 Motorola DRI cost prohibitive to wait out the period of time required to locate industrial uses that would be an ideal match for this unique type and size of space. g. Whether the proposed rezoning is of a scale which is reasonably related to the needs of the neighborhood and the city as a whole. Over the past decade, the concept of an inc;!ustrial park has evolved from its traditional character of a basic, single use industrial area to a flexible district form featuring a mix of components tailored to the needs of local business and industrial groups. The mix may contain industrial, finance, technology and research as well as other uses, including residential and retail. The size of the Motorola DR! site makes it an ideal candidate for such redevelopment. It is expected that the master plan for the project will be developed with this concept in mind. As such, it will contribute to economic development of the City. Additionally, mixed-use developments that include housing, shopping and employment opportunities offer the possibility of internal capture of traffic that single-use developments do not. h. Whether there are adequate sites elsewhere in the city for the proposed use, in districts where such use is already allowed. The site is one of the two Developments of Regional Impact in the City. The other, Quantum Park, has already almost completely developed with a mixture of industrial, commercial and residential uses. The subject site is the only other place in the City where such a mixture of uses can occur in close proximity to the retail core anchored by the Boynton Beach Mall. CONCLUSIONS/RECOMMENDATIONS As indicated herein, this request is consistent with the intent of the Comprehensive Plan; will not create additional impacts on infrastructure that have not been anticipated in the Comprehensive Plan; will be compatible with adjacent land uses and will contribute to the overall economic development of the City. Therefore, staff recommends that the subject request be approved. If the Planning and Development Board or the City Commission recommends conditions, they will be included within Exhibit "C". Recommendation #1 relates to the provision of a market analysis. Recommendation 2: Provide data and analysis for the availability of all public facilities upon the maximum allowable development intensities for local Retail Commercial. Response: An analysis of the maximum allowable dellelopment Intensities for the proposed local Retail Commercial land use designation should include a comparison with both the oment land use designation and the proposed development plan, Attachments 1 and 2 provide the trip generation for the Existing Land Use Designation, Proposed land Use Designation and Proposed Development Plan for Dally and PM peak hour respectively. The Existingand Proposed land Use Designation development Intensities are based on maximum allowable intensities in the Oty of Boynton Beach Codes. On a Daily basis, the number of external trips is higher under the Proposed Land Use Designation than for the Existing Land Use Designation. The Proposed Development Plan is estimated to generate 12,837 New External trips as compared to 62,331 New External Trips for the Existing land Use Designation and 73,132 New External Trips for the Proposed land Use Designation. During the PM peak hour, the Proposed Land Use Designation will generate less new external trips than the Existing Land Use Designation. The Proposed Development Plan estimated New External Trips (1,402) is substantially less than either the Existing land Use Designation (8,764 New External Trips) or the Proposed Land Use Designation (7,904 New External Trips). During the critical PM peak hour and in the more critical outbound direction, both the Proposed Land Use Designation and the Proposed Development Plan are estimated to generate less New External Trips than would be allowed under the Existing Land Use Designation.
