Boynton Beach Blvd. Boynton Beach, Florida 33435 Re: Former Clear Copy / New Citadel Chiropractic Center Parking MMSP 04-020 Dear Mr. Alexandre: In response to your request date-stamped February 11, 2004 for the administrative review and approval of the modifications proposed to the above-referenced approved site plan, depicting the following: · Installation of two (2) new parking spaces (as depicted on the attached plan) ; Please be informed that the proposed changes on the revised plan date stamped 2/11/04 are not "minor" as defined within the Land Development Regulations, Chapter 4 Si te Plan Review. This project may not continue to be processed by the Building Division as a permit application, due to the following condition: 1. The Building Division has determined that the handicap parking space needs to be relocated against the building to satisfy ADA requirements. The result of that relocation to parking space #12 may potentially encroach into the landscape buffer and also create elevation problems on the site, thus requiring a redesign of the parking layout and/or the approval of a variance. If your architect can develop an alternative parking layout that satisfies the Building Division comment while providing the additional two (2) parking spaces required by City Commission action, please submit the revised plans for consideration. Should you wish to pursue a variance for the landscape buffer requirement, the process is approximately ninety (90) days in length and requires the applicant provide justification and demonstrate hardship. Additionally, you may wish to consider presenting a plan that mitigates the reduction in the landscape buffer, should that . Page 2 February 20, 2004 be the result of any re-design. Additionally, as we discussed on the phone, the issue of utilizing roll-out trash containers would need to be coordinated with Mr. Larry Quinn, Solid Waste Supervisor, for appropriateness and suitable location for storage and pickup.
