review of a draft utility easement. I have reviewed the Draft Utility Easement and find the same to be acceptable as to legal
form, subject to the following comments:
1. The easement indicates that, "apparenttille to" the alley is "vested in" the City. I am not sure this is
correct and would defer to staff. Generally, alleys and streets are dedicated to the public, which is different than the
"vesting of title."
This easement will be incorporated into the ordinance to specifically reserve the perpetual utility easement. Should you
have any questions or wish to discuss this matter further, please do not hesitate to contact me.

'things'; and subsequently did received Mike Pawelczyk's e-mail of 09/01/04 addressing phraseology. However, I have not
seen any revised legal description to review. Apparently Mr. Pawelczyk is handling this 'in toto'. The ball is back in your

This memorandum is in response to your memorandum request dated August 26, 2004 on the above noted
subject The legal description delineated with the proposed application needs to be corrected as follows:
1) In the sth paragraph, 2nd line, the distance of "130.19" needs to be corrected to read
131.19'.
2) In the 6th paragraph, 2nd line, capitalize the "P" in the word Point, and capitalize the "B" in
the work Beginning. This is proper terminology in legal descriptions.
I refer you to our Memorandum #04-083 dated may 24,2004 (copy attached); we identify that the alley
contains utility services. This requires that the abandonment be converted to a utility easement to support
the existing uses. Therefore, the legal description needs to be:
"SUBJECT to a utility easement over the legal description described above."

Abandonment of a 20-foot wide alley lying east of Lots 20, 21 and 22 in Block 3, Lake
Addition to Boynton (ABAN 04-002).
NATURE OF REQUEST
The applicant and agent for Boynton Seafood, Carter Logan, is requesting to abandon a portion of the 20-foot
wide alley located between N.E. 9th Avenue and N.E. 10th Avenue. This request to abandon a public alley was
submitted on April 23rd, 2004. This abandonment is for the following unimproved platted alley segment:
A portion of a twenty foot wide alley being east of lots 20, 21,22 and west of Lot 19 as shown on plat of Lake
Addition to Boynton Beach filed in the official records of Palm Beach County in Plat Book 11, Page 171 and
being more particularly bounded and described as follows:
Beginning at the northeast corner of Lot 20, Plat of Lake Addition to Boynton Beach, at the south right of way
of Northeast 10th Avenue. Thence southerly, along the easterly bounds of Lots 20, 21 and 22 of the
aforementioned Plat of Lake Addition to Boynton Beach, a distance of 131.19 feetto a point. Thence easterly
on the prolongation of the southerly boundary of Lot 22 a distance of 20.18 feet to a point. Thence northerly,
maintaining a distance of20 feet from and parallel to the easterly bounds of Lots 20,21, and 22 a distance of
130.19 feet more or less to a point on the southerly right of way of the aforementioned Northeast 10th Avenue.
Thence westerly along the right of way of Northeast 10th Avenue a distance of 20.18 feet more or less to the
point of beginning. Subject to easements, right of way and reservations of records.
The location map attached as Exhibit "A" shows the general vicinity of the alley right-of-way to be abandoned.
The attached Exhibit "B"- "Proposed Abandonment" shows the location of the subject property and includes a
detailed location of the alley to be abandoned and its legal description.
The following is a description of the zoning districts and land uses of the properties that surround the subject
req uest.
North -
N.E. 10th Avenue right-of-way, and farther north a vacant commercial building zoned C-4;
South -
Boynton Beach F.O,E. #3944 lodge building, zoned C-4 and farther south, N,E, 9th
Avenue right-of-way;
East
A vacant parcel within a single-family neighborhood, zoned R-1-A; and
West -
Boynton Seafood property, zoned C-4, and farther west, North Federal Highway right-of-
way, zoned C-4.

BACKGROUND
In March of 1925, the Plat of Lake Addition to Boynton was approved. It included several 20-foot wide alleys
dedicated to the perpetual use by the public, reserving unto the developers or successors the right of reversion
if not used as such. As such this clause is in favor of the original interest party if any right of way is abandoned.
Pursuant to Florida Statutes Sections 117.085, reversions contained in plats recorded prior to July 1, 1972
would be extinguished if specific action were not taken to establish such rights on or before July 1, 1973.
The applicant has the intention of vacating the adjacent portion of the 20-foot wide alley to consolidate it with
Lots 20, 21 and 22 in order to renovate the Boynton Seafood property. The renovation of the Boynton Seafood
is proposed to include but not limited to parking lot expansion 1 reconfiguration. When abandoned the alley will
revert to the adjacent property owners; one-half to the property owner to the east and one-half to the property
owner to the west.
ANALYSIS
Pursuant to Chapter 22, Article III, Section 4, public notice was given to the property owners that abut the right-
of-way to be abandoned, all utility companies have been notified and the request has been advertised in the
newspaper. A summary of the responses from the utility companies and city staff is as follows:

RECOMMENDATION
Staff has determined that the subject alley no longer serves a public purpose, and therefore recommends that
this request to abandon a segment of the 20-foot wide alley as described above, be approved, subject to the
comments included in Exhibit "C" - Conditions of Approval. Any conditions recommended by the Community
Redevelopment Agency Board or required by the Commission will be placed in Exhibit "C" - Conditions of
Approval.

BellSouth has reviewed the requested abandonment of the alleyway at the rear
of the above-mentioned property and will require a utility easement to maintain
the existing aerial facilities.
Please forward an executed utility easement to my office. Upon receipt of the
easement BeIlSouth will have no objection to the alleyway abandonment as
recorded in the Lake Addition to Boynton Beach, Block 3, Lots 20-25 as recorded
in the public records of Palm Beach County, Florida.
The alternative to an easement would be a relocation of facilities at the property
owner's expense.
