DESCRIBED HEREIN; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXEClITE A DISCLAIMER
FOR SAID ABANDONMENT; PROVIDING THAT
THE ATTACHED DISCLAIMER BE RECORDED IN
THE PUBUC RECORDS OF PALM BEACH COUNl'Y;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the abandonment of Casa Lorna Boulevard is an intricate part
of the Marina redevelopment and a condition of a mediated settlement of
litigation concerning the development project; and
WHEREAS, comments have been solicited from the appropriate City
Departments, and public hearings have been held before the City Commission on
the proposed abandonment; and
WHEREAS, the approved site plan approved for the development of the
marina provides for redesign and construction of Casa Lorna Boulevard in a
manner which will preserve and enhance public access along Casa Loma
Boulevard,
WHEREAS, based on the foregoing information, the Casa Lorna
Boulevard no longer serves any purpose which would require that it be
maintained as a public right of way,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. Each Whereas clause set forth above is true and correct
and incorporated herein by this reference,
