Dear Mike:
In response to your previous request, attached are 10 prints of a conceptual site plan for 199 units
on the 9.99 acre property. There are two building types. Building type I consists of 11 units and 15
garage spaces in each building. Building type II consists of 6 units and 12 garage spaces in each.
Building type I contains 2 and 3 story units. Building type II are 2 story units.
In regard to other issues that you raised, my client has obtained an addendum to their contract
with the property owner that the billboard is required to be removed no later than November 2,
2004 hopefully sooner. For the strip of land along the south property line, the quit claim deed has
been executed for it to be conveyed to the Public Storage project to the south.
This information addresses the comments that you have given us thus far and should allow the
project to get back on schedule. Please advise us as to the project schedule os we move forward.

Dear Sir:
You have requested information concerning the above-referenced parcels. The parcels
currently lying within the City of Boynton Beach have a mixture of commercial zoning.
Those fronting on Federal Highway are zoned C-3 commercial. C-3 commercial can also
be developed at a density of 10.8 dwelling units per acre (dufac) instead of Community
Commercial, utilizing R-3 Multi-family Residential regulations. Properties within the city
that front on Old Dixie Highway have C-4 commercial zoning and cannot be utilized for
residential development. Properties with frontage on both South Federal and Old Dixie
have a combination of C-3 and C-4 zoning. Properties outside the City of Boynton
Beach would need to be annexed into the City and given a City land use designation
and zoning, to be developed under a single site plan.
The land use designation and zoning for these parcels that would be most
advantageous to you for townhouse or multi-family residential development would be
Special High Density Residential land use designation with a PUD Planned Unit
Development zoning district. The density under these designations would be up to 20
du/ac. You would utilize the City's PUD regulations. If the total land area of the land
use amendment is less than 10 acres, the combination annexation, land use map
amendment, rezoning and site plan approval requires 90 days, and is based on specific
submittal deadlines each month, depending on the review board that will be approving
the proposed project. If it is 10 acres or more, the process will require approximately
nine (9) months from the submittal deadline of April 1.
The City generally looks favorably on annexations--provided there are no billboards on
the property--if the accompanying site plans gain a recommendation of approval from
the reviewing board and if there is adequate water and sewer capacity to serve the

property; however, there is no guarantee that a request will be approved.
