Dear Mr. Daszkal:
In response to your request dated September 15, 2003 for the
administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following :
. Relocation of the menu board sign and entrance directional sign
(as depicted on the attached drawing) .
Please be informed that the proposed changes on the revised plan
date stamped 09/15/03 are "minor" as defined within the Land
Development Regulations, Chapter 4- Site plan Review. This project
may continue to be processed by the Building Division as a permit
application, subject to the following conditions:
1. The landscaping associated with the signs at their previously
approved locations shall be relocated to the new sign locations and
any necessary modifications to the planting scheme due to site
restraints will be addressed in the field, subject to the review
and approval of the City Forester.
Be advised that the proposed changes may require a modification to
the building permit. Please contact me at (561) 742-6260 if you have

Please be informed that the above-reference project has been permitted consistent with the approved
site plan, conditions of approval, and the Grove Plaza Design Guidelines. As for parking
requirements, the attached staff report and code excerpt indicate the minimal requirement was
applied to the project, which was exceeded.
Due to project uniqueness or code weakness, staff frequently senses the need to recommend more
stringent, applicable regulations. However, due to the minimal enclosed/air conditioned square
footage of this project, there is no appropriate parking space ratio currently codified that staff could
have applied to the project, which would have more accurately assessed project needs.
You will note that paragraph H.12 allows individual parking requirements for unlisted uses to be set
by the Commission; however, there should be defensible criteria in the code to support such a review
and determination by staff. Although the need for an applicable parking space ratio is apparent, a
requirement may be based on minimum spaces per use, square footage, employees, or a
combination of these characteristics. This issue will be evaluated and resolved as part of the LDR
rewrite. Please contact me should you have further questions.

The above referenced project is nearing completion. Prior to the Building Division issuing the
Certificate of Occupancy, I would like to ensure that you do not have any outstanding or pending
conditions concerning this site that must be rectified (excluding issues that are covered entirely
with a City approved surety).
If any outstanding conditions are related to permits issued by the Building Division, please
provide this division a memorandum containing a description of the unresolved conditions. If
the unresolved conditions are not permit related, please notify the owner or the owner's agent to
ensure that the matters are rectified.
Please respond to me, within ten (10) days, in order that we may proceed in a timely manner to
issue the Certificate of Occupancy. No response is necessary if your department is satisfied with
the current state of the above referenced site. Thank you for your cooperation.
