Dear Mr. Solomon:
In response to your request dated September 14, 2004 for the
administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following :
. Placement of thirty (30) seats at tables on the sidewalk
directly in front of the storefront location (as depicted on the
attached drawing) .
Please be informed that the proposed changes on the revised
date stamped 09/14/04 are "minor" as defined within the
Development Regulations, Chapter 4 Si te Plan Review.

1. The outdoor table locations shall be exactly as shown on the
attached drawing, and a minimum 48-inch clear aisle shall be
maintained from the parking lot westward to the front door of the
restaurant, to facilitate pedestrian traffic.
2. The outdoor tables and chairs shall be stored inside the store at
the close of business each day.
3. The outdoor tables and chairs must be maintained in good repair.
4. The sidewalk area utilized for the outdoor seating must be policed
several times during the hours of operation to ensure cleanliness
and thoroughly cleaned daily.
5. Approval from the shopping center owner/agent is required prior to
issuance of a permit.
6. Capital Facilities fees shall be paid for the outdoor seating and
the Business License shall reflect the outdoor seating in the total
number of seats.
