Dear Mr. Peterson:
In response to your statements at Public Audience during last evening's City
Commission meeting, I would like to clarify the status of both the Site Plan Approval
and Building Permits for the New Haitian Alliance Church of Boynton Beach.
Planning & Zoning records indicate that the site plan was originally filed on 8/20/01 but
was voided due to non-activity. The application was re-filed by the applicant on 8/27/02
and approved by City Commission on 6/3/03. A request for site plan time extension was
filed on 5/4/04 and approved by City Commission on 7/6/04, extending the site plan
from 6/3/04 to 6/3/05.
Building Permit 04-2509, to construct a Church, was applied for on 6/1/04 and issued
on 4/14/05. The Building permit is good for a period of 180 days (6 months) from the
date issued and is considered to be in active progress when the permit has received an
approved inspection within the 180 day period. If no inspections are requested or
approved, the permit becomes null and void unless the applicant requests a time
extension prior to the expiration date. Up to three time extensions of not more than 90
days each may be granted by the Building Official. After the third extension, appeal may
be made to the Building Board of Adjustments and Appeals for additional time
extension.
Building division records also indicate that you placed a Public Information Request on
Friday, July 1, 2005, which staff completed on the next working day, Tuesday, July 5,

2005. The record document indicates that a voice message was left at the number
indicated on the request form this morning, July 6, 2005, indicating that the requested
information relating to the permits for this site is ready for pick up. The requested
information is enclosed with this letter.

Gentlemen,
Several issues tracking here that I would appreciate follow-up on please:
1. Site Plan Extension -- The one-year period ends on June 3rd, Rev. Jacques has submitted his application for the site
plan extension. Development needs to make sure the application materials are in order so that this item goes forward with
proper legal notice for the P&D Meeting on June 22nd and City Commission for July 6th.
2. Building Plans and Site Work Plans -- Mr. Daise submitted the plans today and was advised by Building that we do not
have the soil boring data, soils report, prior comments and survey data, They have to be somewhere. Please research
and advise.
t. Site Plan Modification -- An early determination needs to be made by Planning as to whether the changes submitted
are a major or minor site plan modification, If major, can this be processed with the P&D application in #1 above for June
22nd? Again, Legal notice is jurisdictional and steps need to be taken by staff to meld the two issues together, if possible.
~<(/ 4. Off-site improvements. I need a final determination from Engineering as to the scope of the improvements and what
1Cl7J cost sharing, if any is expected of the City. If there is any proposed, does the City Commission need to approve.

SUBJECT: New Alliance Haitian Church
The first review comments from the TRC regarding this project included, under
Utilities comment no. 4, the requirement to pay a capacity reservation fee for this
project within 30 days of City Commission approval. Although this comment
does not appear in the final conditions of the development order, payment of the
reservation fee upon issuance of a development order is a code requirement, and
must therefore be adhered to.
To date, the developer of this project has not paid the required reservation fee, and
does not have a firm reservation of capacity. In that the reservation fee is past due.
the developer should pay the past due amount and an equivalent amount for the
upcoming year prior to City Commission's approval of this extension. As an
alternative to paying the reservation fee. the developer may pre-pay the full capital
facilities charge. as allowed by the Code.
Water treatment capacity is severely limited at this time. Without a firm
reservation, this Department cannot commit to serving this project with potable
water.

UTILITIES
Comments:
1. All utility easements shall be shown on the rectified site plan and
landscaping drawings so that we may determine which trees may interfere
with utilities. In general, palm trees will be the only tree species allowed
within utility easements. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those utilities within the
easement in the foreseeable future. LDR Sec, 7.5-18,1 give public utilities
the authority to remove any trees that interfere with utility services, either in
utility easements or public rights-of-way.
2. Palm Beach County Health Department permits will be required for the
water and sewer systems serving this project (CODE Sec. 26-12),
3, Fire flow calculations will be required demonstrating the City Code
requirement of 1,500 g.p.m. as stated in LDR Chap, 6, Art, IV, Sec, 16, or
the requirement imposed by insurance underwriters, whichever is greater
(see CODE Sec, 26-16(a)). The submitted plans do not indicate whether the
building is to have a sprinkler system or not. As stated in our letter of July
9, 2001, the water main extension will require a fire hydrant at the south
terminus for flushing (if not for fire protection),
(t37 CODE Sec, 26-34(E) requires that a capacity reservation fee be paid for this
project either upon the request for the Department's signature on the Health
Department application forms or within 30 days of site plan approval,
whichever occurs first. This fee will be determined based upon fmal meter
size, or expected demand.
5. Comprehensive Plan Policy 3.C.3.4. requires the conservation of potable

water, City water may not, therefore, be used for irrigation where other
sources are readilv available,
6. Provide an engineer's written certification that drainage will conform to all
rules of the City and the South Florida Water Management District
(SFWMD) (per LDR Chap. 4, Sec. 7F).
7. Water and sewer lines to be owned and operated by the City shall be
included within the road right-of-way or utility easements. Please show any
and all proposed utility easements on the engineering drawings, using a
minimum width of 12 feet. The easements shall be dedicated via separate
instrument to the City as stated in CODE Sec. 26-33(a).
8. This office will not require surety for installation of the water and sewer
utilities, on conditions that the systems be fully completed, and given to the
City Utilities Department before the permanent meter is set. Note that
setting of a permanent water meter is a prerequisite to obtaining the
Certificate of Occupancy.
9. LDR Chap. 6, Art. IV, Sec. 16 requires that all points on each building will
be within 200 feet of an existing or proposed fire hydrant. Please
demonstrate that the plan meets this condition, by showing all hydrants.

10. PVC material is not permitted on the City's water system. All lines shall be
DIP.
11. Appropriate backflow preventer(s) will be required on the domestic water
service to the building, and the fire sprinkler line if there is one, in
accordance with CODE Sec. 26-207.
12. A building permit for this project shall not be issued until this Department
has approved the plans for the water and/or sewer improvements required to
support this project, in accordance with CODE Sec. 26-15.
13. LDR Chap. 3, Art, IV, Sec. 3(P) requires a statement be included that
utilities are available and will be provided by the appropriate agencies, This
statement is lacking on the submitted plans.

This letter is to inform you that the Planning and Zoning Division have received your application
for Site Plan Time Extension on May 4,2004. After reviewing the submitted request, staff is
informing you that this request is solely for a one (1) year time extension of the site plan
approval for the New Alliance Haitian Church.
The site improvement permit referenced in your letter will not be considered within this
application. The Building Division of the City of Boynton Beach handles Building/site
improvement permit.
In conclusion, your request for Site Plan Time Extension is schedule to be heard at the Planning
and Development Board on July 27,2004, and at the City Commission on August 3rd, 2004.
