RECOMMENDATION
Recommend approval of reimbursement of escrow funds back to the developer of Manatee Bay, Olen ReSIdential Realty
Corp. in the amount of$20,228 75 for the re-establIshment of the historic natural area on the site. The remaming balance of
the funds would be deposited m the City recreatiOn unpact fee account.
EXPLANATION
The CIty was initially gIven $148,950 toward the required recreation impact fee for this project. A check from Olen
ResidentIal Realty Corp m the amount of $40,457.50 was deposited m escrow as part of the recreation impact fee for the
Manatee Bay project. In an agreement WIth the City, up to one-half of these funds would be reimbursed to the developer upon
their successful re-landscapmg of the lustoric natural area on the site, and the remainder would be kept by the City and
represent the balance owed for theIr recreatiOn impact fee Staff has inspected the sIte and recommends approval of the
reimbursement in accordance with the funds request from the developer's attorney

As discussed with you on June 30, 2000, please find the attached documents descnbmg the program for
payment of recreation Impact fee for the above-referenced proJect. ThIs alternative plan, as proposed by
the applicants, was approved by the City CommissIOn on May 16th. I have contacted Mr Norris to
mform hIm that the documents are m order and request the checks. I wIll have the check for $148,950
deposIted m the appropnate Impact fee account, and request that the FInance Department place the check
for $40,457.50 10 escrow (up to one-half of thiS amount will be returned to the developer/owner for
reimbursement of funds needed to re-establish the hIstonc natural area on site) Although both checks
are consIdered the Impact fee, up to one-half of the $40,457.50 IS to be used by the apphcant for the
natural area, and the remaInder IS available to the CIty If we feel It IS needed for further enhancement of
the natural area. Otherwise, If not needed for natural area enhancement, the remaInder shall also go

to Inspect the eXIstIng/relocated trees, as well as the Banyan preserve area. As we
dIscussed, there were some adjustments from the ongInal plan to reflect addItIOnal trees
found dunng the cleanng process and trees damaged by severe weather The Banyan
preserve area sustaIned cons1derable damage from last year's hUITlcane. We have
replanted the damaged areas wIth Stra~gler Fig trees, Royal POInCIana trees, Clunese Fan
palms, and numerous shrubs and ferns. You Ind1cated that the eXIstIng/relocated trees
and the Banyan preserve area pass InSpectIOn and you would sIgn-off on the permIts.

A check of escrow funds in the amount of $40 457.50 was deposIted m the City Fmance Department by Glen ReSIdential
Realty Corp. as part of the recreatIOn Impact fee for the Manatee Bay project. In an agreement WIth the City up to one half of
these funds would be re-Imbursed to the developer upon theIr successful re-Iandscapmg of the lustonc natural area on the
site City staff has inspected the SIte and recommends approval of the re-imbursement in accordance with the funds request
from the developer's attorney

RECOMMENDA nON Motion to approve staff recommendation of $229 865 recreation impact fee for the Manatee Bay
Development.
ANALYSIS: The Planning and Zoning Department in a letter dated September 29 1999 (attached) has detennined the
Recreation Impact fee for the Manatee Bay project should be $229,865 00 Olen Residential Realty Corporation has
proposed the fee to be $148,950 The difference between these two amounts is based on the interpretation of developable
acres discussed in an Engineering Division letter dated March 8, 1999 The value of 6 1 acres of submerged lands becomes
the pivotal issue in this case. The developer has been requested to provide a separate appraisal of only the submerged lands.
So far they have declined to provide a separate appraisal for this less valuable property
PROGRAM IMPACT Disagreement concerning the amount of the requirement is holding up the collection of the fee.
The project is nearing completion.
FISCAL IMPACT The difference between the staff recommended fee and the developer proposal is $80 915

Please find enclosed reduced copy of our proposed plat for "Manatee Bay" We will be processing the
boundary plat for approval by the City CommIssIon upon completIon of our reVIew and appropnate
signatures on the plat. It IS our understandmg that the park fee IS normally reqUIred as a conditIon of the
plat approval process. We have had several discussIons WIth Ken Hall andJohn Wildner WIth the CIty
of Boynton Beach regarding the park fee and we WIll proceed to conclude the payment of the fee upon
agreement by all partIes. We have calculated the fee based upon ArtIcle V of the Boynton Beach Code
and our recent closmg on the property ($1,890,000 for 17 13 acres or $110,333 per acre). Usmg the
formula In the code together WIth the pnvate space, we have estImated the Park Fee to be approxImately

vVe have submitted sewer, water, paVIng and dramage plans to the CIty for reVIew and approval as well
as the archItectural plans for the prmclpal buildmgs. Smce tImmg becomes an Issue WIth regard to
ordenng utihty structures and start of the underground work, we would commIt to finalIZmg the payment
of the park fee at eIther the plat approval process or pnor to the Issuance of a C 0 for the pnnClpal

Dear Mr Hansen
In response to your 313/99 letter, the $229,86500 park fee was derived by dividing your
purchase price by the number of developable acres (17 13 total acres less 6 1 acres of submerged
lands) or $170~270.27 per acre. This unit price was factored into the park fee equation using
o 15 acr~ per unit multiplied by 180 units less Y% for park credits, or S229 865 00 rounded.
The City feels that the reparian rights to the submerged lands lend little or no value to the upland
buildable area. That without the submerged acreage your purchase price would be
approxIma.tely the same based on a. falr market price per UIUt multiplied by the 180 units you
have been allowed to build.
Upon receipt of your appraiser list, the City will make a reconunendation and request that a fair
market value of only the submerged lands be submitted.

A reVIew of Plannmg's Via Lago file mdIcates the followmg
Based on the 66 urnt development contaIrnng 11.29 acres, no credIt for addItIOnal unItS was gIven to the
3.57 acres of submerged land. The number of uruts was determmed by the denSIty multIplIed by the 7 72
bUIldable acres (see the attached four documents from the Via Lago file).
As to the companson to the Hills of Lake Eden development and the preserve area, I don't see any real
companson. The 1:1: acres at the "Hills" was a set asIde requirement for the scrub area. There was no set
asIde reqUIrements for "Manatee" The one acre was on buildable land and represented 07 of the site.
The submerged lands at "Manatee" conSIst of6 acres, wluch IS 35% of the overall SIte.
The denSIty of "Hills" was reduced by the rezorung to P U.D and a reqUIrement that the homes have a
mmunum of 2400 sq ft. under aIr The denSIty at "Manatee" mcreased from the allowable 10 8 uruts/acre
to 16.36 uruts/acre because the urnts are all bemg bUIlt on the uplands.
It is my opmIOn that the recreatIon fee of$229,865 00 for 180 urnts built on 11 acres creatmg an Impact of
16.36 uruts/acre IS JustIfiable, and If challenged, the applIcant should take lus appeal to the CIty
ComnllssIOn.

Thank you for meetIng wIth staff on August 16th regardmg calculation of the appropriate
RecreatIonal Impact Fee for your new development. After further reVIew, It IS stIll staffs
position that the RecreatIonal Impact Fee for the Manatee Bay project should be $229,865
Staff's pOSItIOn IS based on the following
1 The number of umts has mcreased the Impact to the CIty because the 180 urnts are bemg
bUIlt on the uplands creating a density of 16.36 units per acre rather than the allowable
10 8 unItS per acre for your zomng.
2 The submerged lands are of relatIve lIttle value except for the dock out mto the
Intracoastal Waterway and cannot be valued at the same acre pnce as the bUIldable
uplands
3 Upon reVIeWIng the first phase of the abuttmg Via Lago development, there was no credIt
gIven for addItIonal umts for the 3 6 acres of submerged lands
4 TheoretIcally, the Impact fee IS to be used to mcrease recreatIOn resources Wltlun the
VICInItv from whIch the fees are collected, which could mclude land acqUIsItIOn. A fee
collected based, In part, on submerged lands, may be InsuffiCIent to acqUIre eqUIvalent
land on WhICh a park could be developed.
