9J-11 TRANSMITTAL REQUIREMENTS FOR THE SUBMISSION OF
ADOPTED SMALL- SCALE COMPREHENSIVE PLAN AMENDMENTS
November 2001
NUMBER OF COPIES TO BE SUBMITTED: Please submit one copy of the adopted small-scale
amendment package to the Florida Department of Community Affairs and one copy each to the
appropriate Regional Planning Council and any other local government or governmental agency in the
state of Florida that has filed a written request with the local government.
SUBMITTAL LETTER REQUIREMENTS: Please include the following information in the transmittal cover
letter transmitting the adopted small-scale amendment (9J-11.015(1), FAC.):
_A statement indicating that the local government is submitting the adopted small-scale amendment
in accordance with Section 163.3187(1)(c), F.S.;
_ A statement identifying the number of acres of the small-scale amendment;
_A statement identifying the cumulative total number of acres for small-scale amendments the local
government has approved for the calendar year;
_ The name, title, address, telephone and fax number of the local contact person.
ADOPTION: The amendment package must include the following (see 9J-11.015(1), (2), F.S.):
_ One copy of the executed ordinance(s) adopting the small-scale development amendment (Rule
9J-11.015(1), FAC.);
_ A Future Land Use Map depicting the newly adopted designation and boundaries and location of
the subject property in relationship to the surrounding street and thoroughfare network (Rule 9J-
11.015(2), FAC.);
_ Copy of the public hearing notice of adoption hearing Rule 9J-11.015(2), FAC.;
_ Other supporting information relative to the amendment (Rule 9J-11.015(2), FAC.);
_ Form RPM-BSP-Small Scale-1 (Rule 9J-11.015(2), FAC.).

That the Future Land Use of the following described land shall be designated as

Special High Density Residential (SHDR). Said land is more particularly described as

recorded in Plat Book 21, Page 73 of the Public Records of Palm Beach County, Florida,
Less a portion of Lot 57 for Right -of Way of State Road No.5 as shown on State of
Florida State Road Department right-of-way map section No. 9301-205.
Containing approximately 2.46 acres of land.
Section 3: That any maps adopted in accordance with the Future Land Use Element

shall be amended accordingly.

Section 4: All ordinances or parts of ordinances in conflict herewith are hereby

repealed.

Section 5: Should any section or provision of this Ordinance or any portion thereof

be declared by a court of competent jurisdiction to be invalid, such decision shall not affect

Section 6: This Ordinance shall take effect on adoption, subject to the review,

challenge, or appeal provisions provided by the Florida Local Government Comprehensive

Planning and Land Development Regulation Act. No party shall be vested of any right by

virtue of the adoption of this Ordinance until all statutory required review is complete and all
24
legal challenges, including appeals, are exhausted. In the event that the effecti ve date is
25
established by state law or special act, the provisions of state act shall control.

18 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
19 adopted a Comprehensive Future Land Use Plan and as part of said Plan a Future Land
20 Use Element by Ordinance No. 89-38 in accordance with the Local Government
21 Comprehensive Planning Act; and
22 WHEREAS, the procedure for amendment of a Future Land Use Element of a
23 Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed~
24 and
25 WHEREAS, after public hearing and study, the City Commission deems it in the
26 best interest of the inhabitants of said City to amend the aforesaid Element of the
27 Comprehensive Plan as adopted by the City herein.
28 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
29 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
30 Section 1: The foregoing WHEREAS clauses are true and correct and
31 incorporated herein by this reference,

Section 2:
Ordinance No. 89-38 of the City is hereby amended to reflect the
2 following:
3 That the Future Land Use of the following described land shall be designated as
4 Special High Density Residential (SIIDR). Said land is more particularly described as
5 follows:
6 Lots 62 & 63 (Except that part of said lots conveyed to State of Florida by deed dated
7 December 30, 1957 and recorded December 31, 1957 in Official Records Book 140, Page
8 17), of "Trade Winds Estates", a subdivision in Palm Beach County, Florida, according to
9 the plat thereof as recorded in the office of the Clerk of the Circuit Court in and for Palm
10 beach County, Florida, in Plat Book 21, Page 45.

12 Containing approximately 2.26 acres of land.

14 Section 3: That any maps adopted in accordance with the Future Land Use Element
15 shall be amended accordingly.
16 Section 4: All ordinances or parts of ordinances in conflict herewith are hereby
1 7 repealed.
18 Section 5: Should any section or provision of this Ordinance or any portion thereof
19 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect
20 the remainder of this Ordinance.
21 Section 6: This Ordinance shall take effect on adoption, subject to the review,
22 challenge, or appeal provisions provided by the Florida Local Government Comprehensive
23 Planning and Land Development Regulation Act. No party shall be vested of any right by
24 virtue of the adoption of this Ordinance until all statutory required review is complete and all
25 legal challenges, including appeals, are exhausted. In the event that the effective date is
26 established by state law or special act, the provisions of state act shall control.

City staff appreciates the opportunity you provided to review the "Study of Unincorporated Areas of
East Boynton Beach" as prepared by the Long Range Planning Section of the Planning Division of
Palm Beach County. The report contains a generous amount of factual information regarding services
and infrastructure that will be useful as the City coordinates with the County in developing annexation
strategies for the three areas covered in the report.
As a point of interest, the City staff would like to share some information of which we are aware, and
that was not included in the report.
. Section V, p. 3-Area I includes undedicated roadways, in addition to substandard
dedicated rights-of-way. Area III - All of Miller Road and most, ifnot all, of Palmer
Road are also undedicated roadways.
· Section VIII, p. 4 - Area I is primarily served by septic tanks for sewer. Two
condominiums on the eastern edge have private pumping stations that pump into a city-
owned and maintained force (pressure) main connecting to a main on A 1 A. All other
buildings aside from the condominiums are on septic tank. Area II - sewage system is
incomplete, serving some buildings and not others. Extension of the gravity sewer
main, and pumping station additions would be required to service the entire area.
· Section X.B., p. 6 - All areas - The number and locations of fire hydrants are not as
stated. Additional hydrants exist in and around all areas and we are including our most
recent mapping of those locations. Additional hydrants could be added as potable water
infrastructure is installed.
· Stormwater Drainage (not addressed in report) is problematic, with systems not existing
in any areas except the Tradewind Estates subdivision of Area III. Even there, residents
have some issues with the County regarding the operation and adequacy of the drainage
system. Poor drainage and the widespread use of septic tanks could become a serious
issue in Area I.
· The City of Boynton Beach has initiated a three-pronged approach to reducing
emergency response times citywide to four minutes. These measures include building
and staffing a fourth fire station, relocating an existing fire station and implementing a

citywide traffic light preemption system. At least one of the stations will be located east of
the Florid East Coast Railroad tracks.
The City staff was somewhat surprised and disappointed that there was only a brief mention of the
County's Annexation Incentive Program as a cost-sharing arrangement and no discussion of
annexation mechanisms. Absent a strong policy for annexation from the County, there is little desire
or incentive for some of the larger enclaves to favor becoming a part of the city. However, the City is
currently reviewing its options and will coordinate with the County Planning Division as we move
forward with our annexation program in these three annexation areas.
