Please know that when the impact of prior projects was considered, we also asked that they too evaluate capacity and movements at Boynton Beach Boulevard and Federal Highway. Past analysis suggested that improvements were not necessary because adequate capacity existed. In essence, because they developed first, they were the beneficiaries of excess capacity provided when the State widened Federal Highway a number of years ago. To answer your question about who pays for the other 70%, the taxpayer already has. The review process does not stop with you. When the next projects south and west of you move forward, we will once again recommend that these developers consider access conditions to their property. We will be recommending to the City Commission that traffic site access not impede or delay our new residents that will be living in the completed Promenade development because they were there first. You, personally, will likely be long gone and the individuals you sell to will be voicing their concerns about traffic to us and not you. I reference the projects to the south and west for one specific reason. Andrea's queuing analysis shows that the southbound left turn lane should be lengthened now, primarily as a result of additional traffic generated by your development. This proposed length will be the maximum that can be constructed because we must also consider a future need for a northbound left turn lane of adequate length to accommodate traffic generated by a project to the west of you on the west side of Federal at 4th Avenue. The two must balance, to a degree. So, to accommodate future growth in the southbound to eastbound movement at Boynton and Federal, it will likely require the construction of dual left turn lanes. In this scenario, City staff would recommend that the developer to the south dedicate right of way to accommodate the dual receiving lanes on the east leg of Boynton Beach Boulevard. Ultimately, when the property on the southwest corner of Boynton and Federal develops, staff would recommend that this developer also be required to dedicate sufficient right of way to allow for, and construct, two eastbound through lanes that will align with the two new receiving lanes east of Federal. As you can see, this becomes quite a puzzle. I try to anticipate development as a whole and plan for the future needs of our motoring residents. If I, or government in general, only considered each individual development in a vacuum, we will do nothing more than propagate existing traffic deficiencies into the future. As outlined above, your piece of the puzzle is very small. It is not unreasonable for you to make improvements necessary to support safe and efficient access for our future residents in your development. The condition of approval was specifically structured to address this. In fact, your project is large and you too are benefiting by available capacity on the surrounding arterial network. The study shows that the intersection will operate at Level of Service D. Furthermore, the County has issued its approval. However, the City Conditions of Approval specifically required evaluation of queuing on the southbound left turn lane of Federal Highway at Boynton Beach Boulevard. The analysis by Pinder Troutman confirmed that the left turn lane should be lengthened by 120 feet to provide satisfactory storage. I wanted to give you advance notice that you will need to increase the left turn lane storage on southbound Federal Highway approaching Boynton Beach Boulevard. This won't be particularly costly or difficult to build, just one more thing that we must coordinate, particularly when you start your permit process with the State. Committed development data for Marina Village was Included in the analysis. Attachment 3 provides the projected intersection volumes consisting of existing traffic counts, background growth, committed development and project traffic. Analyses' of the intersection for the AM and PM peak hours were conducted using the Highway Capacity Software, HCS+ showing inte"ectlon operation at level of seMce (LOS) D with the existing signal timing and number of lanes. The analyses are provided in Appendix B. Specific queuing analyses were completed for the southbound left tum movement as shown on Attachment 4. The analysis by Pinder Troutman confirmed that the left turn lane should be lengthened by 120 feet to provide satisfactory storage. I wanted to give you advance notice that you will need to increase the left turn lane storage on southbound Federal Highway approaching Boynton Beach Boulevard. This won't be particularly costly or difficult to build, just one more thing that we must coordinate, particularly when you start your permit process with the State. First, the Foundation Only Permit No. 06-4743 was issued to your contractor, Gezer Construction, on July 18, 2006. Under normal circumstances, one of the requirements for issuing a Foundation Only Permit is a properly recorded plat. In this case the permit was issued without the required plat filing. Accordingly, no inspections can be performed under this permit until the plat is presented and filed. It is our understanding that you have some concerns regarding the validity of the plat requirement for this project. If this is the case, it is a legal issue that needs to be taken up with the City Attorney, Mr. Jim Cherof. We recommend a formal letter to him outlining your concerns with a request for an expeditious response. Second, following the payment of the required Plan Review Fee, on November 3,2006 staff initiated the review of building plans and specifications under permit No. 06-5274. Approximately 48 of the 72 comments provided to date in the Conditions of Approval are the direct result of this staff review. (Hotel extended slay).doc , I Due to the difficulty in obtaining conventional financing for hotel projects in recent years, the "condominium hotel" or "condo hotel" has a become a popular product in the hotel industry. A condo hotel is essentially a hotel where the individual rooms are owned by separate owners, as opposed to having the entire block of rooms owned by a single hotel owner/operator. Since the individual rooms are sold to separate owners, the overall condo hotel project can be financed more like a residential condominium project, rather than a hotel, which has led to a surge in their popularity among hotel developers in recent years. From an operational and appearance standpoint, a condo hotel essentially looks and functions like any other hotel, with a management company in place to operate the facility and make provisions for such things as a central reservation system, maid service, maintenance, etc. Typically, all units are furnished the same for consistency purposes such that a hotel guest would not be able to tell from outward appearance that the rooms were owned individually. Since condo hotels are a relatively new concept that are likely to continue to grow in popularity, many local governments in South Florida are now revisiting their land development regulations and making revisions as necessary to address the attributes of such projects and to ensure that the facilities truly operate as hotels and not residential developments. For example, since the condo hotel rooms are owned by individual owners who may choose to occupy the hotel room at some time during the year, local governments are putting maximum length of stay limitations in their code to ensure that individual owners do not take up permanent residence in the units. Since a condo hotel would likely take the form of an "extended stay hotel," City staff is recommending that the City Commission amend the City's definition of "extended stay hotel" as described below to address the attributes of the condo hotel and place appropriate limitations and requirements on such use. In addition, staff is recommending that the City Commission amend the permitted uses table for the "Mixed Use-High" zoning district to make it clear that "extended stay hotels", which would be the likely category to accommodate a condo hotel, are permitted in that district. The site plan approval for the project included 318 condominium units and 68 hotel suites (referenced in the Tabular Data on Sheet A.O as "Extended Stay Suites''). While the Land Development Regulations for the Mixed Use Districts contains a definition of" Hote~ extended stay', the use is not listed as a permitted use in Table 6F-1. Staff is currently evaluating zoning regulations against current market trends, and will subsequently process any necessary amendments. However, in the interim, to prevent the "hotel" units in this project from being considered as "dwelling units" and included in density calculations, the operations of the hotel functions must be managed by a single entity and all units designated as "hotel suites" on the approved site plan must participate accordingly. Additionally, minimum and maximum occupancy of the units must be in accordance with those listed for Extended Stay Hotels. In exchange for said transfers, the developer is willing to dedicate utility and roadway easements on their property to the City. The requested transfers from the City to the developer are as follows: 1. Transfer ownership of a small strip of land (784 square feet) from the City, the parcel being described on attached exhibit "A". The City is to retain easement rights on this parcel. It is an irregularly shaped piece of land and serves no other useful purpose. 2. Dedication of a franchise utility easement from the City, across the parcel described in exhibit "B". Utility lines and poles from franchise utilities already encroach across portions of the required easement. Formalizing the easement will rectify that encroachment and allow the developer to obtain service from various franchise utilities. In exchange for the two dedications referenced above, the developer is preparing the dedication of a utility and roadway easement as described in exhibit "C". This sketch and survey, and the accompanying plan view are provided solely for your information. At this time I am requesting your office prepare the legal documents required to effect the transfer of the property rights outlined in items 1 and 2 above. By copy of this memorandum to the Engineering and Planning Departments, I am also requesting their written concurrence of this action, which has been discussed through the TRC process.
