Promenade revised traffic statement

We received a revised traffic statement for the Promenade project. The data contained in the study would increase the
number of hotel rooms by nine (9) from what was originally approved. Pinder Troutman Consulting, Inc. is requesting we
(Boynton Beach) send the impact statement to Palm Beach County for their review and approval for concurrency
purposes. Won't they be required to submit a site plan modification for the increase in the number of rooms? If so, major
or minor if building square footage doesn't change.

Jeff, you are allowed one temporary project development sign (up to 10 feet high and max. 8 X 8 or 64 sq. ft.
dimensions). Could this not suffice for project name, using the screening for eye-catching graphics? Particularly
since you'd generally be limited to one screen panel for the project name anyway. The temporary sign is to be
conditioned upon filing of permits for construction; however, we are willing to construe your current permits as
related and in compliance with code. This stand-alone sign should be more visible than than what would be
provided on a screen.
Hope that helps and is acceptable. We commit to working with you, where necessary, to find the mutually
acceptable compromises to meet code and your advertising objectives.

We are having trouble getting the canvas covering for our construction fence approved. We are being told
that there can be no words at all on the fence, just pictures. It was our understanding that one of the

panels can show the name of the project with the starting prices as long as the remaining panels had
pictures; Marina Village was able to do this (we hired the same company to produce the artwork). We are
trying to open the sales office by the second week of February and we need to have this up before we do.
Could you please let me know who is in charge of handling this so I can get involved in finding a solution?

Regarding the standard rezoning application I have several questions as to what items
are required to be submitted with the application for the property located on the northeast
corner of Federal Highway and Boynton Beach Boulevard. There are several sections within
the application which indicate that some items may be waived pursuant to your approval and
some additional items which also may be requested. My inquiry is as follows:
1. Please advise ifthe Tree Survey can be waived with the rezoning application.

1. Not a formal tree survey. However, the ultimate landscape plans should indicate trees lost compared to new trees
planted. Depending on how you look at it, they are generally accounted for but just not required by the surveyor.
2. I don't see the necessity for anything special. Your applications should cover the basics. Of course at this time I cannot
anticipate if the Board/Commission will need something in addition to that provided.
3. Keep in mind that these items listed are typically warranted after inspection of the proposed project or in connection with
existing site characteristics. At this time, except for elevation information needed to determine ultimate building heights, I
do not sense the need for anything in addition to that stated by in application.
4. The Mixed Use High zoning district requires submittal of a site plan to be submitted concurrent with the application for
rezoning, not a master plan as required for a planned zoning district.
5. Fees are for the rezoning application ($750), conditional use/site plan application triggered by the boutique hotel rooms
and townhomes ($1,000 <3 acres; $1,500 3 or more acres), height exception ($250), and a code review if MX-H district to
be revised to accommodate project ($250).
6. Two sets of the applications and 12 sets of site plans.

Dear Mr. Atefi:
The purpose of this letter is to provide an equivalency letter for the above referenced project.
It is proposed to redevelop a site located in the northeast quadrant of the intersection of Federal
Highway (US 1) and Boynton Beach Boulevard in the City of Boynton Beach. Existing on the site is a
47,000 SF retail center. Proposed for the site is 21,000 SF of Retail Use, a 38 Room Hotel and 317
Condominium Units.
This site is located in the Coastal Residential Exception Area. Therefore, only the proposed Retail
and Hotel have to be considered in determining compliance with Article 12, T raffle Performance
Standards of the Palm Beach County Unified land Development Code (ULDC).
Exhibits 1A and 1 B provide a trip generation comparison for the AM and PM peak hours. For both
the AM peak hour and PM peak hour, the net new trips are less for the proposed uses than for the
existing use. Based on this analysis, the project is in compliance with the requirements of Article 12
of the ULDC.

The Palm Beach County Traffic Division has reviewed the traffic statement for the
proposed mixed use redevelopment plan entitled; Federal Highway/Boynton Beach
Boulevard Mixed Use Development, pursuant to the Traffic Performance Standards In
Article 15 of the Palm Beach County Land Development Code. This project is
summarized as follows:

Based on our review, the Traffic Division has determined that the residential portion of
the proposed mixed use redevelopment project is located within the Coastal Residential
Exception Areas of Palm Beach County, and the non-residential portion generates less
peak hour trips than the existing uses, therefore, the project meets the Traffic
Performance Standards of Palm Beach County. No building permits are to be is~ued by
the town, after the build-out date specified above. The County traffic concurrency
approval is subject to the Project Aggregation Rules set forth in the Traffic Performance
