Dear Mr. Belvin:
In response to your request dated August II, 2004 and updated March
21, 2005 for the administrative review and approval of the
modifications proposed to the above-referenced approved site plan,
depicting the following:

Please be informed that the proposed changes on the revised
date stamped 3/23/05 are "minor" as defined within the
Development Regulations, Chapter 4 Site Plan Review.

2. Paving, Drainage and site details will not be reviewed for
construction acceptability at this time. All engineering
construction details shall be in accordance with the applicable
City of Boynton Beach Standard Drawings and the "Engineering Design
Handbook and Construction Standards" and will be reviewed at the
time of construction permit application.
3. All proposed trees are required to be planted at a minimum of 12
feet in height.
4. The total of 86 inches of removed Slash Pines to accommodation the
construction associated with this request shall be replaced with a
comparable 86 inches of new Slash Pines. The City Forester
recommends replacement with 29 (3" dbh) Slash Pines. The City
Forester shall approve any deviation from this condition.

Dear Mr. Breeze:
In response to your comments regarding the proposed expansion of the Waste Management
facility located in the North Boynton Beach Industrial Park, we have revised our plans to
incorporate the following changes:
1. Sheet 6 has been changed to show 14 Slash Pines in lieu of the 14 Sabal Palms
originally proposed. A revised Sheet 6 has been attached for inclusion in the plan set.
2. Sheet 6 has been changed to show that the additional Sea Grapes to be planted are to
be 5' tall to match the height of existing Sea Grapes onsite. A revised Sheet 6 has been
attached for inclusion in the plan set.
3. The expanded parking area has had a note added stating that the new parking area will
serve as both truck parking and employee parking, as employees may park their
vehicles in the truck spaces once the trucks begin their routes. A revised Sheet 5 has
been attached for inclusion in the plan set.

Dear Mr. Breese,
This letter is in response to your request for information regarding the permit application for Waste
Management Inc. of Florida. Pursuant to your request please accept this letter as certification of
building square footage, number of office personal and parking spaces available.
The property located at 651 Industrial Way, Boynton Beach, Florida is comprised of approximately
12000 square feet of office space. There are approximately thirty-eight office employees at the above
address. Upon completion of renovations at the existing facility there are fifty-three spaces and an
additional six handicapped spaces available. We have also entered into a binding agreement with
Kenney Property to lease an additional twenty-eight spaces. I feel these arrangements provide more
than adequate parking spaces for Waste Management employees and visitors.

SECTION 01'.c - RENTAL
Lessor hereby rents and leases to Lessee, and Lessee hereby hires and leases from Lessor, for the
term and at the rental provided for under this Lease, twenty-eight (28) parking spaces located upon the
premises
("Premises") of Lessor. The address of said Premises is 505 Industrial Way, Boynton Beach, Florida
33426. The twenty-eight (28) parking spaces are particularly designated in Exhibit "A" attached hereto.
SECTION TWO - USE OF THE PREMISES
Lessee shall utilize the Premises only for the parking of its employees' vehicles. No commercial
vehicles, regardless of owner, may be parked in the designated leased spaces.
SECTION THREE - RENT
The total rent for the term shall be $12,000.00, plus applicable Florida Sales and Excise taxes,
payable in advance on the I::t- day of each month in monthly installments of$l,OOO.OO, plus
applicable State and Sales and Excise taxes. In the event Lessee fails to make a payment within ten (10)
days of its regular due date, then Lessor shall impose a late fee, which shall be paid concurrent with the
regular payment, offive percent (5%) of the monthly payment, together with applicable State Sales and
Excise taxes.

Lessee shall not make or suffer any alterations to the premises without the written consent of
Lessor. Lessee shall keep and maintain the premises in a clean and sanitary condition and shall not
permit the accumulation of rubbish, liquid waste, or refuse, and shall not store any live animals,
explosives, gasoline or other flammable materials thereon. Lessee shall, at the termination of this Lease,
leave the premises in a like condition as when first delivered to Lessee, reasonable wear and tear
accepted. Lessee hereby indemnifies and holds Lessor harmless from any damages or claims whatsoever
made on account of any hazardous waste, spilled, placed or left upon the demises premises, including
reasonable attorneys' fees and court costs incurred by Lessor in defending any said claim, and in
collecting said indemnification damages from Lessee. .

SECTION SIX - DESTRUCTION OF PREMISES
In the event the Premises shall be damaged by fire or other casualty during the term of this Lease,
whereby the Premises shall be rendered untenantable, either Lessor or Lessee may cancel this Lease by
written notice delivered to the other. Upon such cancellation, rent shall be paid only to the date of such
fire or casualty. Lessee in possession of the premises shall be held harmless by Lessor for damages to
the demised Premises occasioned by such fire or casualty except when such fire or casualty shall be the
result of the acts or conduct of Lessee, its employees, or invitees.
SECTION SEVEN - MISCELLA1'JEOUS
1. In the event any administrative or legal action is commenced under the terms of this
Agreement, then the prevailing party shall be entitled to collect its attorneys' fees and costs from the
other party.
2. This action shall be governed by the laws of the State of Florida.
3. Venue for any action arising out of this Agreement shall be Palm Beach County, Florida.
4. This Agreement contains all of the terms, provisions and covenants agreed to by the parties
and anything not contained herein shall not be binding upon either party.
SECTION EIGHT - lNDEMNIFICA TION
Lessee hereby indemnifies and holds Lessor harmless from any claims or damages arising from
any personal injury or bodily injury to any person or personal property, whether employee of Lessee or
belonging to Lessee, injured or damaged on account of any activity of any employee of Lessee using the
parking spaces whether said activity is legal or illegal, including all reasonable attorneys' fees and Court
costs incurred by Lessor in defending any of said claims or in collecting said indemnification damages
from Lessee.

The above referenced Site Plans, received on November 8, 2004, was reviewed for Public Works,
Engineering, and Utilities against the requirements outlined in the City of Boynton Beach Code of
Ordinances. Following are our comments with the appropriate Code and land Development
Regulations (LDR) referenced.
ENGINEERING
1. Please note that changes or revisions to these plans may generate additional comments.
Acceptance of these plans during the TRC process does not ensure that additional comments
may not be generated by the Commission and at permit review.
2. Drainage plans, including drainage calculations, will be reviewed at the time of permitting.
3. Paving, Drainage and site details will not be reviewed for construction acceptability at this time.
All engineering construction details shall be in accordance with the applicable City of Boynton

1. Lease for additional parking not executed by the property owner at 505 Industrial
Way.
2. No plan attached to the proposed lease indicating location, condition and number
of spaces to be leased.
3. No information provided as to the availability of excess parking at 505 Industrial
Way. Information should include the total square footage of building(s) and
number of paved and striped parking spaces. A site plan or survey may prove
beneficial.
4. The lease is for a period of one year only. What happens after that?
5. Engineering Division will review drainage calculations in the permit review
process, rather than now.
6. The new seagrape hedge material should be planted to match the size of the
existing material currently in place, not the 12" indicated.
7. City Forester recommends replacing the slash pines to be removed with slash
pines, as opposed to the sabal palms proposed.
