I have reviewed you letter of April 9, 2008 with senior Development Department
staff, reviewed our City ordinances and fee schedules relative to your request of permit
fee refunds. Plan check fees and permit fees are non-refundable and non-transferrable
per City code.
The four building permits will be voided at this time. The City must by ordinance
retain the $142,216.78, but as a courtesy to SH Communities, we will place the amount in
a City escrow account as credit towards the 4 permits at a future time, Additional City,
County and State fees may be required when the 4 permits are eventually issued.

This letter is to inform you that SH Communities does have the intention of completing
the last four residential buildings (addresses attached) we have at our Waterside
Community which is located in the city of Boynton Beach, Florida as the current
approved site plan describes it. As you know, the current market conditions in the
housing industry would not make it feasible to do so at this time. Once these conditions
improve, SH Communities will re-evaluate the situation and proceed with construction.
In the meantime SH Communities will continue to service this community and its
homeowners with the excellence and professionalism our company exemplifies. If you

The Palm Beach County Traffic Division has reviewed the request for build-out extension
of the previously approved project entitled; Waterside, pursuant to the Traffic
Performance Standards in Article 12 of the Palm Beach County Land Development Code.

permits are to be issued by the town, after the build-out date, specified above. The
County traffic concurrency approval is subject to the Project Aggregation Rules set forth
in the Traffic Performance Standards Ordinance.

Waterside - Plat & Engineering Drawings Comments (2nd Review)
I have reviewed the above referenced plat & drawings and have the following comments,
1. Sheet 1 - There are no dedications for Tracts C, D & E.
2. Sheet 2 - It would seem that there should be tracts or easements between Lots 7 & 8, 21 & 22 and
101 & 102.
3, Sheet 2 - The wording of the sentence that begins "Plat Limits..................", along the southeast
edge of the plat, appears incomplete.
4. Sheet 2 - There appear to be Limited Access Easements (L.A.E,) at several locations around the
project where a six (6) foot high wall is also proposed as part of the original site plan approval. Will
the L.A.E, allow for construction of these required walls?
5. Sheet 2 - The required landscaping along the rear of the units does not appear to be in a dedicated
landscape easement. Without a landscape easement, we have no assurances that the landscape as
approved will be maintained. Is there language in the Association documents requiring maintenance
and preservation of the landscape material and barring the individual residents from removing any of
the required/approved plantings? Such language should be provided for City review and approval.
