This letter will serve as a request for a Minor Administrative Amendment to our previously
approved site plan for the Woolbright Grille restaurant. This site plan was approved by the
Boynton Beach City Commission on June 18, 2002 for improvements including a new two-story
restaurant with adjacent parking, site improvements, and waterfront dining deck.
This request for a Minor Administrative Amendment is for the addition of docks as outlined on our
attached site plan. These proposed docs have already received approval from the Army Corps of

MANATEE CONSTRUCTION CONDITIONS

ith the following manatee protection construction conditions:
a, The permittee shall in truct all personne.l.associated with the project of the potentia.I .
presence of manatee and the need to avoid collisions with manatees. All construction
personnel are respon ible for observing water-related activities for the presence of
manatee(s).
b. The permittee shall a vise all construction personnel that there are civil and criminal
penalties for harming harassing, or killing manatees which are protected under the
Marine Mammal Prot ction Act of 1972, The Endangered Species Act of 1973, and the
Florida Manatee San uary Act
c. Siltation barriers shall be made of material in which manatees cannot become
entangled. are prope y secured, and are regularly monitored to avoid manatee
entrapment. Barriers must not block manatee entry to or exist from essential habitat.
d. All vessels associate with the construction project shall operate at "no wakelidle"
speeds at all times wile in the construction area and while in water where the draft of
the vessel provides I $ than a four-foot clearance from the bottom. All vessels will
follow rout~s of deep ater whenever possible.
e. If manatee(s) are se within 100 yards of the active daily construction/dredging
operation or vessel vement, all appropriate precautions shall be implemented to
ensure protection of t e manatee. These precautions shall include the operation of all
moving equipment n closer than 50 feet of a manatee. Operation of any equipment
closer than 50 feet to a manatee shall necessitate immediate shutdown of that
equipment.t Activities will not resume until the manatee(s) has departed the project area
of its own volition,
1. Any collision with an or injury to a manatee shall be reported immediately to the FWC
Hotline at 1-888-404- CC, Collision and/or injury should also be reported to the U.S.
Fish and Wildlife Se ice in Jacksonville (1-904-232-2580) for north Florida or Vero
Beach (1-561-562-39 9) in south Florida.
9 Temporary signs con eming manatees shall be posted prior to and during all
construction/dredgin activities, All signs are to be removed by the permittee upon
completion of the pro ct. A sign measuring at least 3 ft. by 4 ft. which reads Caution:
Manatee Area will be posted in a location prominently visible to water related
construction .crews. second sign should be posted if vessels are associated with the
construction, and sho Id be placed visible to the vessel operator. The second sign
should be at least 81 "by 11" which reads Caution: Manatee Habitat. Idle speed is
required if operating vessel in the construction area, All equipment must be shutdown
if a manatee comes ithin 50 feet of operation. Any collision with and/or injury to a
manatee shall be rep rted immediately to the FWC Hotline at 1-88B-404-FWCC. The

Dear Ladies and Gentlemen:
This is in reference to your request for a permit for work
performed in or affecting navigable waters of the United States.
Upon recommendation of the Chief of Engineers, pursuant to
Section 10 of the Rivers and Harbors Act of 3 March 1899 (33
U.S.C. Section 403), and Section 404 (33 U.S.C. 1344), of the
Clean Water Act you are authorized to construct:
1. a "T"-shaped pier consisting of 5' by 50' access walkway
with grated decking and a 5' by 200' terminal platform.
The dock will accommodate 5 slips to be used only for
temporary mooring in conjunction with an upland restaurant.
2. Two cantilevered wooden "viewing" platforms are proposed
for construction. The viewing platforms will be elevated
7.5' above mean high water. The viewing platforms will be
constructed with wood decking spaced a minimum of I-inch.
One viewing platform will extend 5' over water depths of l'
maximum and the second viewing platform will extend 10'
over water depths of 1.7' maximum. The viewing platform
will have permanent handrails and No Mooring signs.
3. Repair and replacement of an existing seawall within one
foot.

The project is located within the Intracoastal Waterway (ICW)
adjacent to 700 Woolbright Road, in Section 33, Township 45
South, Range 43 East, Palm Beach County, Florida,
Latitude: 260 30' 49.92" North
West
Longitude: 800 3' 23.77"
in accordance with the plans and conditions which are
incorporated in, and made a part of, the permit. In addition,
the permittee must comply with the following:
1. The applicant shall adhere to the Standard Manatee
Construction Guidelines (attached) during the construction of
this project.
2. Within 60 days of completion of the work authorized the
attached Self-Certification Statement of Compliance must be
completed and submitted to the U.S. Army Corps of Engineers
(Corps). Mail the completed form to the Regulatory Division,
Enforcement Branch, Post Office Box 4970, Jacksonville, Florida
32232-0019, Attn: Lisa Abernathy.
3. The permittee understands and agrees that, if future
operations by the United States Army corps of Engineers require
the removal, relocation, or other alteration, of the structures
or work herein authorized, or if, in the opinion of the Secretary
of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation
of the navigable waters, the permittee will be required, upon due
notice from the Corps of Engineers, to remove, relocate, or alter
the structural work or obstructions caused thereby, without
expense to the United States. No claim shall be made against the
United States on account of any such removal or alteration RE:

4. The permittee agrees that there shall be no more than 5
vessels moored at the dock at one time as shown on the attached
project drawings. The dock shall be used for temporary transient
mooring. The permittee agrees that NO OVERNIGHT mooring shall
occur at any time for any reason.
5. The permittee agrees to install permanent handrails
(rope handrails are not sufficient) along both sides of the
access walkway to preclude mooring in areas adjacent to seagrass

and to preclude prop dredging by mooring of vessels in water
depths not sufficient for safe boating operation.
6. The permittee agrees to install permanent "NO MOORING"
signs along both sides of the permanent (non-rope) handrail along
the access walkway. The signs shall be a minimum of 2' by 2' ,
shall be visible to boaters approaching the area, and shall be
maintained in perpetuity
7. The permittee agrees to install permanent handrails
(rope handrails are not sufficient) around both wooden viewing
platforms. The viewing platforms MUST be elevated to a minimum
of 7' above mean high water (MHW) and must be installed with
wooden decking as shown on the project drawings. The wood
decking shall have a minimum of 1-inch spacing. The permittee
agrees to install "NO MOORING" signs on both viewing platforms to
preclude any and all mooring. The signs shall be a minimum of 2'
by 2', shall be visible to boaters approaching the area, and
shall be maintained in perpetuity.
8. The permittee agrees to install grated decking over the
entire access walkway (5' by 50') and shall elevate the access
walkway to a minimum of 5' above mean high water (MHW) , to
protect the seagrass at the project site. See: "Key for
Construction of Docks and Other Minor Structures Constructed in
or Over Johnson's Seagrass (Halophila johnsonii), October 2002.
9. There shall be no fish cleaning stations anywhere on the
dock or viewing platforms.
10. The permittee shall install and maintain a display that
provides information on the characteristics of manatees and the
potential threat to this endangered species from boat operation.
Permittee agrees to install and replace the signs in the event
the signs fade or become damaged, and maintain these signs for
the life of the facility. Permittee shall install and display
signs within 30 days prior to completion of construction. The
number, type, and procedure for installation should be in
accordance with the handout "Permanent Manatee Signs", which can
be obtained from the Bureau of Protected Species Management, OES-
BPS, 620 S. Meridian Street, Tallahassee, FL 32399-1600 (phone
850/922-4330) .

11. A literature display shall be installed to distribute
(at no charge) the "Palm Beach County Manatee Protection Zones"
booklets to boaters using the docking facility. The booklets
area available free of charge from the Florida Inland Navigation
District (561/627-3386).
12. To reduce the risk of entrapment and drowning of
manatees, grating shall be installed over the existing 24",
partially submerged pipe to restrict manatee access.
It is noted that this authorization is being given based on
the position of the structure as located using the X-Y State
plane coordinates furnished with the application. Should the
completed structure have less clearance to the Federal channel
than the coordinates show, the permittee shall be deemed to be in
violation of this permit.
By accepting this authorization, the permittee agrees to
furnish the Corps, at the letterhead address, an As Built Survey
of the completed structure(s) including a certified/sealed
drawing, which includes the X-Y coordinates. This survey shall
be furnished within 30 days of completion of the work for
verification and acceptance by the Corps. No vessel(s) may
utilize the facility prior to acceptance by the Corps. No
vessel(s) may utilize the facility prior to acceptance by the

Since a portion of the proposed work is located within the
Federal right-of-way for the lCW, a Department of the Ar.my
Consent to Easement is also required prior to commencement of
construction. By copy of this letter, the proposal is being
forwarded to the Corps' Real Estate Division for action on the
Consent.
Enclosed is a Notice of Authorization, which should be
displayed at the construction site. When you begin work, you
must notify the District Engineer's representative, at the above
letterhead address, of:
a. The date of commencement of work;
b. The dates of work suspensions and resumptions if work is
suspended over a week; and;
c. The date of final completion.

If the work authorized is not completed on or before May 4,
2009, authorization, if not previously revoked or specifically
extended, shall cease and be null and void. Please refer to the
attached form, Notification of Administrative Appeal Options and
Process, concerning your options on acceptance of this permit.
