Please be informed that as a result of the above-referenced widening of Gateway Boulevard, in connection
with improvements for the Boynton Town Center/Boynton Village project, adjacent property must be
acquired and as a consequence, the buffer widths and landscaping elements will be reduced below minimum
development regulations. Specifically, the affected properties or portions of properties are understood to
include the landscape buffer for the north side of the existing Target Shopping Center at the southwest comer
of Gateway Blvd. and Congress Ave., and the north landscape buffer for the approved Renaissance
Commons project located at the southeast comer of Gateway Blvd. and Congress Ave.
In accordance with the City's Land Development Regulations, developments must include minimum buffer
widths and landscaping plantings in accordance with Chapter 2 and Chapter 7.5. However, given that the
subject improvements are not the result of actions taken by owners of the property to become substandard,
the deficiencies are not required to be addressed, nor would the deficiencies affect the continued use of the
properties as currently improved or approved by way of a valid development order. The affected properties
would become legal non-conforming and, alternatively stated, can be utilized, improved, and expanded in
accordance with city regulations if alterations would not constitute a further violation of city regulations.
Please understand that there is no specific remedy within city regulations that is applicable to this situation,
nor necessary for the continued use or development of the affected properties. If subsequent changes were
desired to the affected non-conformities, which would further reduce them below city regulations, variances
would be required and hardship proven.
Lastly, staff will work with representatives for the projects described herein, to achieve the minimum
reduction necessary to existing or approved landscaping through the minor site plan modification process.

Dear Mr. Rumpf:
Attached is a copy of the traffic equivalency letter for the above referenced project as well as the
standard parking analysis utilizing City parking rate and Urban Land Institute (ULI) utilization rates.
The traffic equivalency was submitted to Palm Beach County at the end of October. In speaking
with Masoud Atefi, Palm Beach County Traffic Division, he indicated the County's review would be
competed next week. I see no reason the equivalency analysis should not be approved.
The shared parking analysis shows a maximum demand for 1,789 spaces occurring at 1 :00 PM. The
supply is 1,804 spaces, which is adequate to satisfy the maximum demand. Note that the analysis
does not include sharing any of the spaces allocated for residential uses.

The purpose of this letter is to provide a traffic equivalency letter for the above referenced project.
The site has current approvals for 1,551 multi family residential units, 198,000 SF of Retail, 247,800
SF of Office and 15,000 SF Day Care Center. It is proposed to add 141 condominium units and
reduce the Office area by 40,500 SF.
Attachments 1 and 2 provide the AM and PM peak hour trip generation comparisons for the
approved and proposed land use scenarios. During the AM peak hour the proposed land use
scenario will generate 15 fewer new trips than the approved land uses. During the PM peak hour
there is no difference in the new trips. Based on no net increase in new trips the project is in
compliance with the requirements of Article 12, Traffic Performance Standards, of the Unified land
Development Code (UlDC).

An additional 141 dwelling units have been gained by converting office use to multi-
family residential use. The Use Conversion Matrix adopted in Ordinance 04-013 provides that
1,000 sJ. of office use is equivalent to 2.39 multi-family units. Therefore, it is necessary to
convert 59,000 s.f. of office to obtain 141 dwelling units.

The City had also requested a modified concurrency analysis be performed and approved
by Palm Beach County as confirmation of compliance with traffic performance standards. The
use conversion, based on the Use Conversion Matrix, resulted in the loss of 17 peak hour trips;
therefore, Pinder Troutman Consulting determined the additional office square footage that ,could
be retained (17,700 s.f.) so that there would be no net loss of vested trips.
The requested use conversion is within the 30% modification that is permissible without
undertaking an NOPC; and is simply reported in the next annual report.
We understand that the City will reflect the DRI/SMU use conversion" in the language of
the City Commission Resolution approving the Phase VI site plan, and that this document will
then represent the amended use entitlements for Renaissance Commons.

Dear Mr. Atefi:
The purpose of this letter is to provide a traffic equivalency letter for the above referenced project.
The site has current approvals for 1,551 multi family residential units, 198,000 SF of Retail, 247,800
SF of Office and 15,000 SF Day Care Center. It is proposed to add 141 condominium units and
reduce the Office area by 40,500 SF.
Attachments 1 and 2 provide the AM and PM peak hour trip generation comparisons for the

Determination Amendment on the above referenced project for 1700 units (1442 multi-family

Attached please find the approved Palm Beach County School District Concurrency
Application and Service Provider Form for Renaissance Commons. Previously, Renaissance
Commons was approved for 1501 units (1243 multi-family units and 258 high rise
apartments). They are now requesting the addition of 199 multi-family units, for a grand total
of 1700 units. This Concurrency Determination is valid for one (1) year from the date of
issuance. Once a Development Order has been issued for the project, the concurrency
determination will be valid for the life of the Development Order.

Service Area (CSA) 1 Consequently, the proposed conversion will not increase the number
