Boynton Village Building Permits Dear Mike and Jeff: The issuance of the Building Permits for the above referenced Projects, including both Commercial and Residential Approved Site Plans, shall be "subject to the limitations and timing at which development may proceed as outlined of the Palm Beach County Traffic approval letter or the conditions contained within the CRALLS amendment upon its adoption.>> As we've discussed prior, it us Sembler's understanding that the CRALLS language supercedes the Letter of Concurrency language with respect to these requirements. One particular condition of the CRAW requires that the letting of the Old Boynton widening occur as a certain phasing condition, Please review the attached letter from John Corbett of Corbett & White, p,c. for further delineation on this pOIDt, John's background and knowledge in this field is well established. The design documents for this improvement are complete and have 100% approval from Palm Beach County, subject to the procurement of the necessary temporary construction easements from the various property owners. A competitive bid process has occurred and a Contractor has been selected. We intend to place that Contractor under Contract within the week. In accordance with the County adopted CRAllS language, we thus would achieve the prescribed milestone to allow building permits that generate in excess of 963 new external PM peak hour trips, I am confident that the City of Boynton Beach will concur with this analysis and allow for the release of further building permits, At the same time, we will be aggressively pursuing the necessary temporary construction easements, starting on the west side, to accommodate the maintenance of traffic plan desired by the City, Thank you for all of your consideration and assistance in this matter. Foreman Senior Development Manager The Sembler Company 1450 South Johnson Ferry Road Suite 100 Atlanta, Ga, 30319 Re: Boynton Town Center/Boynton Village Building Permit Limitations for Old Boynton Road Improvements Dear Richard: The County's traffic approval letter, dated February 1,2005, (County Traffic Letter) and the CRALLS adopted by the County Commission contain different required improvements for Old Boynton Road and have different triggers for the issuance of building permits tied to these improvements, You asked me to address which set of requirements are to be followed by the City in issuing building permits for the Boynton Town Center and Boynton Village projects. The County Traffic Letter specifies the improvements that are required to meet the Palm Beach County Traffic Performance Standards, A CRALLS is adopted by the County Commission when the County dt:sires to modify the improvements required by the County Traffic Performance Standards. Where the CRALLS language modifies the requirements in the County Traffic Letter, the CRALLS language supersedes conflicting language in the County Traffic Letter. Both the County and the City recognized that the County Commission might modify the requirements of the County Traffic Letter through adoption ofa CRALLS. The City's approvals of both the Boynton Town Center and Boynton Village projects contain a condition of approval that each project is subject to the limitations and timing at which development may proceed as outlined in the Palm Beach County Traffic approval letter or the conditions contained within the CRALLS amendment upon its adoption, December 20, 2006 Page 2 The County Traffic Letter contains a phasing condition related to the construction of Old Boynton Road. Specifically, the County Traffic Letter reads as follows: No building permits for more than 963 new external PM peak hour trips until construction begins for 5-laning of Old Boynton Beach Boulevard, from Congress Avenue to Boynton Beach Boulevard, or adoption of appropriate CRALLS, for all or some links along this arterial segment. This condition phases the issuance of building permits to the commencement of construction of 5 lanes on this segment unless a CRALLS is adopted for all or some links along this segment. Palm Beach County did subsequently adopt a CRALLS for all of the links along this segment of Old Boynton Road. This CRALLS was adopted by the County Commission as part of Policy 1.2-f 36 of the Transportation Element in the County Comprehensive Plan, Specifically, paragraph 4) b) of this policy requires posting of performance security and then contains the following improvement requirements and phasing language: and prior to issuance of building permits that generate more than 963 new external PM peak hour trips per County Engineer's determination for the Boynton Town Center and Boynton Village (Winchester Property), contracts shall be let for: 1, Construction of 5-laning Old Boynton Road from Congress A venue to spine road, with appropriate transition to 3-lane section east of spine road. 2, Construction of 3-lane Old Boynton Road from spine road to Boynton Beach Boulevard, As part of this construction, the Boynton Town Center and Boynton Village (Winchester Property) at its own cost must offer all Homeowners, where geometrically feasible, to install circular driveways of"T" turn arounds. Once the CRALLS was adopted by the County Commission, the language in the CRALLS supersedes any conflicting language in the County Traffic Letter relating the improvement requirements for Old Boynton Road and the phasing to those improvements, The CRALLS modified the County Traffic Letter requirement by only requiring 3 lanes instead of 5 lanes east of the project spine road. Also, the CRALLS clearly phased the issuance of building permits to the letting of the contracts for the required improvements rather than the commencement of construction as required in the County Traffic Letter. We are currently considering re-Iocating 64 of those units from one parcel to another now that the "Fire Suppression System" requirement has been deleted from six (6) stories structures, However, we are concerned that subsequent to our approvals, City Commission passed an Arts Commission Ordinance, Given that we "commenced" our project, pursuant to the definition in the Public Art Fee Ordinance, several months ago, we believe we should be exempt from this ordinance. There is no provision in the ordinance for the re-design or modification of an approved project. Notwithstanding the foregoing, in an effort to cooperate with the "spirit of the ordinance", we would ask that The Arts Commission consider establishing the Arts Fee for a modification of an existing approved project by calculating the Arts Fee based upon the "changed element" in the approved plan only. Accordingly, the Arts Fee would be based upon the 64 units we are re-Iocating within the project instead of the total number of units in the project.
