all plans, specifications, drawings, engineering, and other data submitted with this application for review by the
City of Boynton Beach shall be reviewed by the various boards, commissions, staff personnel and other parties
designated, appointed or employed by the City of Boynton Beach, and any such party reviewing the same shall
rely upon the accuracy thereof, and any change in any item submitted shall be deemed material and
substantial.
The undersigned hereby agrees that all plans, specifications, drawings, engineering and other data
which may be approved by the City of Boynton Beach, or its boards, commissions. staff or designees shall be
constructed in strict compliance with the form in which they are approved, and any change to the same shall be

Either patty shall be entitled to revise their site plan i~ accordlflce: _~ any approvals of any

parties' roads or driveways. The owner of Parcel ~umbcr Two, subject to approval of all
required governmental authorities shall be entitled to, have access to Parcel Number One on
the north side of the property as shown on the site plan; provided, however, this access shall
be restricted to one-way Iraffic going west. The owner of Parcel Number Two agrees that his
use of the joint access provided by this Declaration shall not interfere with the free-flow of
the Declarant's drive-in facilities. There shall be no cross-maintenance obligations as to
ingress and egress and each owner of Parcel Number One and Parcel Number Two shall be
responsjble for maintaining his own property.
2. Thc Declarant has provided water and sewer to both Parcel Number One and Parcel Number
Two and the improvements have been pennitted, installed, and copies of the plana have been
furnished to the perspective purchaser of Parcel Number Two. Subject to the approval of any
governmental authorities, Parcel Number Two may cOMect to the water and sewer systems
and shall not be obligated to reimburse the owner of Parcel Number One for any cost which
the DeclardJIl incurred. Provided, however, the maintenance, repair or replacement of the
common facilities shall be born by the users of the common facilities in accordance with the
