AUTHORIZING ABANDONMENT OF 20.18 FOOT

SUBDIVISIONj BEING MORE PARTICULARLY
DESCRIBED HEREIN; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A DISCLAIMER
FOR SAID ABANDONMENT; PROVIDING THAT
THE AlTACHED DISCLAIMER BE RECORDED IN
THE PUBLIC RECORDS OF PALM BEACH COUN1Y;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Rosa A. Bauer, Trustee for the property located at 811
North Federal Highway is requesting abandonment of a 20.18 foot wide alleyway
(Lakeside Addition), lying westerly of and adjacent to Lots 12, 13, 14, 15 and 16,
Block 1 of the Lake Addition Subdivision; and
WHEREAS, comments have been solicited from the appropriate City
Departments, and p~blic hearings have been held before the CitYs Planning and
Development Board and the City Commission on the proposed abandonment;
and
WHEREAS, it has been determined that said alleyway to be abandoned
no longer serve any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton Beach, Florida
by and thrvugh its City Commission, does hereby abandon and vacate a 20.18
foot wide alleyway (Lake Addition Subdivision) more particularly described as
follows:
20.18 foot wide alleyway lying westerly of and adjacent to iots 12, 13, 14,
15, and 16, less the east 17 feet of lots, Block 1 of the Lake Addition, a
subdivision of Boynton Beach, according to the plat thereof on fiie in the office of
the Clerk of the Circuit Court, in and for Palm Beach County, Florida in Book 11,
Page 71 of the Public Records of Palm Beach County, Florida.
Section 2. The Mayor and City Clerk are hereby authorized and directed

Ms. Covello advised that Enterprise does not do any repairs on their property, and they
do not sell any cars. The only place they have used car lots is in North Palm Beach
and Lauderhlll.
Chairman Wische opened the public hearing.
Lloyd Powell of Alpine Florist. 1112 N. Federal Highway, questioned jf the property
behind these lots is owned by FEC or the City. Mr. Lewicki advised that there is 20 feet
of right-of-way between the edge of FEC and the property.
Ramona Frederick. 1001 Railroad Avenue. has a small business in the area and asked
how this will affect her. Mr. Aguila advised her that Railroad Avenue is west of the FEe
Railroad right-of-way. This project is east of the railroad and Jhere is 20 feet of property

Mr. Rosenstock moved to approve the petition by Enterprise Rent-A-Car to be located
at 1009 North Federal Highway, to abandon a 20 foot wide strip of land just west of lots
3 and 4 of Block 1 of the Lake Addition to Boynton Beach subdivision in connection with
the Enterprise Rent-a-Car conditional use request. subject to all staff comments. Mr.
Aguila seconded the motion. which carried 7-0.
