The greenway may have to be developed using alternate side of the tracks. For instance, if the property along SE 5th Ave.
is developed on the east side of the tracks, the greenway would have to go on the west side. If the Zill propoerty is
developed on the west side of the tracks, the greenway may have to switch from the west side to the east side at some
appropriate crossing. I'm not sure that one side is better than the other. As you mentioned, the trail should switch sides to
be closer to other park and greenway opportunities. Our thinking is to ask the FEC for greenway area in their right-of-way
(but to the outside). Given that, no development would encroach into the right-of-way and the greenway could be placed
where deemed appropriate.
We could certainly include a clause in the development order that reserves a portion of the development for use as a
greenway. Again, the intention is to use the FEC right-of-way as the greenway Boca has done a similar project - so that
private development will not be impacted.

Which side of the RR is a logical side for greenways vis a vis future plans? If on the side where we want, then we
have an obligation to bring to the attention of the City Commission. If the area is on the same side as Pence Park is
that where the greenway will radiate outward or are we planning to stay on the west side of the RR to pick up the SE
Park site? I ask this question because I'm, also aware of the fact that the balance of the Zill property may be in for
development and the site plan for any development needs to factor greenway.
. It is likely that if the property is developed, a future green way can be developed around it.
My concern with the above statement is how? Would the City be required to purchase more property? Can the
release of the property include a clause that:
Identifies the property abandoned to be future use as greenway with a prohibition against building on the area
abandoned?
Now I'm asking Mike Rumpf and Jim C. to wade in depending on your response to my first question of which side of
the RR ROW is the greenway.
