SUBJECT: A.A.M. Builders
Per your request, I have reviewed the letter from David W. Schmidt regarding the City's
interpretation on the above-mentioned variance application. I have also reviewed our files
regarding the subject, and submit the following:
1. There does not appear to be a permit on file for the existing location of the diesel
fuel tank (outside of the building, along the RR tracks).
2. On October 19, 2004, A.A.M Industries, Inc. applied for a Minor Site Plan
Modification for two (2) gas tank enclosures, including a survey and
photographs. These documents indicate the existence of a diesel fuel tank and
enclosure inside a fenced area along the RR tracks. They also depict a proposed
location next to the diesel fuel tank for a gas fuel tank and enclosure.
3. On October 28,2004, staff addressed a letter to A.A.M. Industries, Inc. indicating
that the Minor Modification could not be approved due to the fact that the
proposed improvements, according to their survey, were not on their property and
did not meet setbacks.
4. On June 13, 2005, A.A.M. Industries submitted a Variance Application to
construct a fuel tank near their front property line along SE 5th Avenue. In the
justification statement, the applicant indicates that the new fuel tank
(approximately twice the size of the existing diesel fuel tank) will hold both gas
and diesel fuel.
5. During staffs review, it was determined that A.A.M. Builders is an industrial use
in a residential zoning district. On August 19, 2005, in a conversation with the
Legal Department, it was determined that the request from the applicant was an
expansion of a nonconforming use per Code Section l1.1.B. 2. & 3., which state:
2. No such nonconforming use shall be moved in whole or in part to any
other portion of the lot or parcel occupied by such use on the effective date
of the adoption or amendment to these regulations, nor shall such
nonconforming use be moved to any other parcel or located in any district
within which said use is not permitted.
3. No additional structures or buildings shall be erected in connection with
such nonconforming use of land.
As indicated in Mr. Schmidt's letter of December 12, 2005 to your attention, a gas fuel
tank was approved inside the building. No record of any permits for a diesel fuel tank
located outside the building on RR property can be found. As we previously discussed, it
would appear that the relocation and expansion of the fuel tank would trigger the
nonconforming language discussed above.

Dear David:
Thank you agreeing to take another look at this variance application.
-As we discussed, it appears that a gas tank was approved in 1993 to be located in the building.
However, it was eventually located outside, and my client later discovered that it was located in
the FEe right-of-way and not on his property. He now wishes to re-Iocate the tank. He needs a
variance because he cannot meet the distance requirement from the front of the building. Rick
Lee in the building department has reviewed the location with the Fire Marshall and they are
okay with it. .
Enclosed are copies of some documents from when my client initially sought approval to move
into the building. Should you require anything further, please contact me.

Dear Mr. Schmidt:
As a follow-up to our previous phone conversation, please be advised that the City of Boynton Beach
Planning & Zoning Division is returning your application for variance on behalf of A.A.M.
Industries. Again, as noted in our previous discussion, the City Attorney's office has determined the
project contemplated in your application to be an expansion of a legal non-conforming use, therefore
not eligible for a variance.
