Variance Request for a Fuel Tank at A.A.M. Industries, Inc.
225 SE 5th Ave.
In order to address code requirements for this installation, additional information is required such
as the following:
1. The capacity of the tank (gallons).
2. Type of tank.
3. Class of liquid to be stored as defined in NFPA 30 and the Florida Fire Prevention Code.
4. The information provided in the "Statement of Justification" indicates the tank will hold
gas and diesel fuel. How will this be accomplished using one tank?
5. City records do not show the existing tank was legally permitted or inspected.
The installation of the tank shall comply with the requirements for flammable and combustible
liquids as mandated in NFP A 30 and the Florida Fire Prevention Code. The distance shown
between the storage tank and the edge of the public way is not in compliance with the above
referenced code and standard. Therefore, I would recommend denial of this variance. You may

STATEMENT OF JUSTIFICATION
Applicant seeks to construct a gas tank enclosure in the front setback of the property.
Petitioner's current gas tank is located on FEe property and must be moved. The Fire
Department request that the tanks now be placed 50' feet from the building. Side and rear
yard areas are too small to meet setback requirements, and rear abuts residential zoning.
The proposed location will be adj acent to the street and is the safest location on the
property for an outside tank, as it is the farthest point from any surrounding building.
The tank will hold gas and diesel fuel. The Boynton Beach Fire Marshall has approved
the location.
The special conditions are not the result ofthe actions of the applicant. Granting the
variance will not confer any special privilege on the applicant and surrounding property
owners could also have outside storage of fuel. In addition, applicant has had a tank for
over ten years and now must move it. The request for the move is beyond applicant's
control.

In response to your request date-stamped October 20, 2004 for the
administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following:
· Addition of two (2) gas tank enclosures (as depicted on the

Please be informed that the proposed changes on the revised plan
date stamped 10/20/04 are not "minor" as defined within the Land
Development Regulations, Chapter 4 - Site Plan Review. This
project may not continue to be processed by the Building Division
as a permit application, due to the following conditions:
1. The survey submitted with the Minor Modification indicates
