Petitioner's current gas tank is located on FEC property and must be moved. The Fire Department request that the tanks now be placed 50' feet from the building. Side and rear yard areas are too small to meet setback requirements, and rear abuts residential zoning. The proposed location will be adjacent to the street and is the safest location on the property for an outside tank, as it is the farthest point from any surrounding building. The tank will hold gas and diesel fuel. The Boynton Beach Fire Marshall has approved the location. The special conditions are not the result ofthe actions ofthe applicant. Granting the variance will not confer any special privilege on the applicant and surrounding property owners could also have outside storage of fuel. In addition, applicant has had a tank for over ten years and now must move it. The request for the move is beyond applicant's control.
