such must accompany the petition.
4. Statement of special conditions, hardships or reasons justifying the requested exception or
variance. Respond to the seven (7) questions below (A-G) on a separate sheet (Please print
or type ):
A. That special conditions and circumstances exist which are peculiar to the land, structure
or building involved and which are not applicable to other lands, structures or buildings
in the same zoning district;
B. That the special conditions and circumstances do not result from the actions of the
applicant;
C. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this Ordinance to other lands, buildings or structures in the
same zoning district;
D. That literal interpretation of the provisions of this chapter would deprive the applicant of
rights commonly enjoyed by other properties in the same zoning district under the terms
of the Ordinance and would work unnecessary and undue hardship on the applicant;
E. That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building or structure;
F. That the granting of the variance will be in harmony with the general intent and purpose
of this chapter and that such variance will not be injurious to the area involved or
otherwise detrimental to the public welfare.
G. Variances to minimum lot area or lot frontage requirements, that property is not
available from adjacent properties in order to meet these requirements, or that the
acquisition of such property would cause the adjacent property or structures to become
nonconforming. Applicant shall provide an affidavit with the application for variance stating
that the above mentioned conditions exist with respect to the acquisition of additional
property.

No quasi-judicial proceeding shall proceed until proof of notice of the proceeding, in affidavit form, has
been filed with the Office of the City Clerk. Proof of notice must include the name and address of each
property owner to whom notice was mailed and a photograph of each sign posted, as hereinafter
required. The following notices must be paid for and provided by the applicant:
I) All property owners, homeowner associations, and condominium associations that own property
within four hundred (400) feet of the boundary line of the property which is the subject of the
quasi-judicial hearing shall be mailed, by first class mail, a notice of hearing postmarked no less
than ten (10) calendar days prior to the hearing.
2) One (1) sign for each street frontage of the property shall be posted no less than ten (10) days prior
to the hearing. The sign shall be legible from a distance of 100 feet and shall contain a description
of the approval being sought, the date, time and location of the hearing, and a statement that the
application being considered is available for inspection in the Development Department of the City
of Boynton Beach.

3) When a quasi-judicial hearing is tabled or continued at the request of an applicant, re-notice of the
hearing shall be provided by the applicant in the same manner as original notice.

STATEMENT OF JUSTIFICATION
Applicant seeks to construct a gas tank enclosure in the front setback of the property.
Petitioner's current gas tank is located on FEC property and must be moved. The Fire
Department request that the tanks now be placed 50' feet from the building. Side and rear
yard areas are too small to meet setback requirements, and rear abuts residential zoning.
The proposed location will be adjacent to the street and is the safest location on the
property for an outside tank, as it is the farthest point from any surrounding building.
The tank will hold gas and diesel fuel. The Boynton Beach Fire Marshall has approved
the location.
The special conditions are not the result ofthe actions ofthe applicant. Granting the
variance will not confer any special privilege on the applicant and surrounding property
owners could also have outside storage of fuel. In addition, applicant has had a tank for
over ten years and now must move it. The request for the move is beyond applicant's
control.
