In support thereof, I submit the following information concerning the Boynton Beach Mall development, which information is true and correct to the best of my knowledge. Development of the Boynton Beach mall was substantially complete by 1987, and the retail square footage which is to be converted to a movie theater is now part of the Macy's Department Store. As the traffic study attached as Exhibit "A" indicates, the requested change will not result in an increase in the number of pm peak hour trips generated by the Boynton Beach Mall. 6. Complete the attached Substantial Deviation Determination Chart for all land use types approved in the development. if no change is proposed or has occurred, indicate no change. The Substantial Deviation Determination Chart is attached as Exhibit "B". 7 . List the dates and resolution numbers (or other appropriate identification numbers) of all modifications or amendments to the originally approved DRI development order that have been adopted by the local government, and provide a brief description of the previous changes (i.e., any information not already addressed in the Substantial Deviation Determination Chart). Has there been a change in local government jurisdiction for any portion of the development since the last approval or development order was issued? If so, has the TAL 49526:1 phasing, additional lands, commencement date, build-out date, development order conditions and requirements, or to the representations contained in either the development order or the Application for Development Approval. If so, has the TAL 49526:1 4 annexing local government adopted a new DRI development order for the project? The initial Development Order for the Boynton Beach Mall DRI: was approved by Palm Beach County on May 7, 1974 by Resolution No. R-74-343. That Development Order authorized the development of 1,108,000 gross leasable square feet of commercial uses. The Boynton Beach Shopping Mall was annexed into the City of Boynton Beach in 1982, and the County's Development Order was adopted by the City on November 16, 1982. All subsequent development orders have been issued by the City. On December 19, 1989 by Resolution No. 89-UOU, the Ci ty approved a substantial deviation which authorized the expansion of the mall to 1,244,449 gross leasable square feet. That Development Order was appealed by the Treasure Coast Regional Planning Council. On March 5, 1991, the City by Resolution No. R91-37 modified the conditions approved by Resolution No. 89-UUU to settle the appeal taken by the Treasure Coast Regional Planning Council. Like Resolution No. 89-UOU, Resolution No. R91-37 approved the development of 1,244,449 gross leasable square feet. On February 20, 1996, the City by Resolution No. R96-26 revised the provisions providing for littoral zone planting around detention ponds. On July 7, 1998, the City by Resolution No. R98-123 extended the traffic monitoring date to December 31, 2000 and the Development Order termination date to December 31, 2010. There has been no change in local government jurisdiction for any portion of the Boynton Beach DRI: since the annexation of the development. TAL:49526:1 5 8. Describe any lands purchased or optioned within 1/4 mile of the original DRI site subsequent to the original approval or issuance of the DRI development order. Identify such land, its size, intended use, and adjacent non-project land uses within 1/2 mile on a project master site plan or other map. Simon Property Group does not own or have an option on any other land within one-quarter mile of the DRI: site. 9. Indicate if the proposed change is less than 40% (cumulatively with other previous changes) of any of the criteria listed in Paragraph 380.06(19) (b), Florida Statutes. The proposed change isnot subject to the criteria listed in Paragraph 380.06(19)(b), Florida Statutes. Further, Subparagraph 380.06(19)(e)1., Florida Statutes, which established the 40% standard, was repealed by Chapter 2002-296, Laws of Florida. An updated master site plan or other map of the development portraying and dis tinguishing the proposed changes to the previously approved DRI or development order conditions. A revised master development plan is attached as Exhibit "C". 13. Pursuant to Subsection 380.06(19) (f), F.S., include the precise language that is being proposed to be deleted or added as an amendment to the development order. This language should address and quantify: a. All proposed specific changes to the nature, phasing, and build-out date of the development; to development order condi tions and requirements; to commi tments and representations in the Application for Development Approval; to the acreage attributable to each described proposed change of land use, open space, areas for preservation, green belts; to structures or to other improvements including locations, square footage, number of units; and other major characteristics or components of the proposed change; See the proposed resolution attached as Exhibit "D". The proposed resolution revises the plan of development to decrease the retail use by 151,982 gross leasable square feet and to add a 79,500 square foot multi screen movie theater with 3,650 seats. b. It should be noted that the proposed change consists of adding a movie theather while eliminating approximately 170,000 square feet of retail. The result of the analysis indicates that the proposed change will result in less PM peak hour trips than the approved project. The year 2006 projected traffic volumes (for background traffic) were calculated using the growth rates taken also from the website for each one of the links analyzed in the 1998 study. The net difference in project traffic was calculated for the PM peak hour using the proposed project minus the approved project. As previously stated, this difference is minus 26 trips. This difference was distributed in the roadways around the project using the trip distribution used in the 1998 study and subtracted from the 2006 PM peak hour traffic and compared to the capacity of the segment. Figure 1 illustrates the traffic volumes for 2006. As seen in this figure, most roadways will be working above acceptable levels of service. Two of the segments operate over LOS D capacity: Gateway Blvd east of Congress Avenue and Woolbright Road west of 1-95, however, the proposed change does not worsen the level of service on these links. Intersection analysis In the 1998 study, three intersections were analyzed because those intersections were improved but with different laneage than identified in the Development Order. So, those intersections were evaluated to determine that those intersections were operating at acceptable LOS. These intersections are Hypoluxo Road at Congress Avenue, Old Boynton Road at Congress Avenue, and Boynton Beach Boulevard at 1-95. R05-_ A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING THE BOYNTON BEACH MALL DEVELOPMENT OF REGIONAL IMP ACT DEVELOPMENT ORDER, ADOPTED BY THE CITY ON NOVEMBER 16, 1982, AND AMENDED ON DECEMBER 19, 1989, MARCH 5, 1991, FEBRUARY 20, 1996, AND JULY 7, 1998; MAKING FINDINGS OF FACT AND CONCLUSIONS OF LAW PERTAINING TO THE BOYNTON BEACH MALL DEVELOPMENT OF REGIONAL IMP ACT, ADDING MULTISCREEN THEATER AS AN APPROVED USE AND REDUCING THE RETAIL SQUARE FOOTAGE, AND CONSTITUTING THIS RESOLUTION AS A DEVELOPMENT ORDER BY THE CITY OF BOYNTON BEACH IN COMPLIANCE WITH LAW; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Development Order (the "Original Development Order") was approved by the Board of County Commissioners of Palm Beach, County (Resolution No. R-74-343) on May 7, 1974 and thereafter adopted by the City of Boynton Beach ("City") on November 16, 1982; and WHEREAS, the Original Development Order was amended on December 19, 1989 by Resolution No. 89-UUU; on March 5, 1991, by Resolution No. R91-37; on February 20, 1996 by Resolution No. R96-26; and on July 7, 1998, by Resolution No. R98-123 (collectively "Development Order"); and WHEREAS, Thomas Marsicano, Vice President of URS Corporation Southern, Inc., agent for Simon Property Group, the property owner, has filed with the City a Notice of Proposed Change to the previously approved development order for the Boynton Beach Mall Development of Regional Impact, in accordance with Section 380.06(19), Florida Statutes; and WHEREAS, Simon Property Group proposes to convert ~ square feet of gross -1- q~Olo TAL:50186:1 leasable retail to a 79,500 square foot multi screen movie theater with 3,650 seats; and WHEREAS, this amendment request is governed by Chapter 380.06(19), Florida Statutes, for a substantial deviation determination; and WHEREAS, the City Commission as the governing body of the City of Boynton Beach has jurisdiction, pursuant to Chapter 380, Florida Statutes, and is authorized and empowered to consider Notices of Proposed Change to the Development Order for the Boynton Beach Mall Development of Regional Impact; and WHEREAS, the City Commission has determined that the proposed change does not constitute a substantial deviation under Chapter 380, Florida Statutes; and WHEREAS, the City Commission on , 2005, held a duly noticed public hearing on the Notice of Proposed Change and has heard and considered the testimony taken thereat; and WHEREAS, the applicant has submitted a traffic study which complies with all ordinances and requirements of the City; and WHEREAS, the City Commission has received and considered the recommendations of the Treasure Coast Regional Planning Council and made the following Findings of Fact and Conclusions of Law: FINDINGS OF FACT 1. The proposed Development is not in an Area of Critical State Concern designated pursuant to the provisions of Section 380.05, Florida Statutes. 2. The State of Florida has not adopted a land development plan applicable to the area in which the proposed Development is to be located. 3. The proposed Development is consistent with the report and recommendations of the Treasure Coast Regional Planning Council submitted pursuant to Section 380.06(12), Florida TAL:S0186:1 -2- Statutes. 4. The proposed Development is consistent with the City's comprehensive plan and zoning and development regulations. 5. The Notice of Proposed Change does not constitute a substantial deviation from the previously approved Development Order. 6. The premises are correct and hereby accepted by the City. CONCLUSIONS OF LAW NOW THEREFORE, be it resolved by the City Commission of Boynton Beach, that said City Commission makes the following conclusions of law: 1. That in a public meeting, duly constituted and assembled this ,2005, the Development Order for the Boynton Beach Mall Development of Regional Impact is hereby amended as follows: 1.1. The Notice of Proposed Change by Simon Property Group is incorporated herein by reference, and relied upon by the Parties in discharging their statutory duties under Chapter 380, Florida Statutes. The Applicant is Simon Property Group and shall hereafter include the successors and assigns of Simon Property Group. Substantial compliance with the representations contained in the Notice of Proposed Change as modified by the terms and conditions herein is a condition of approval. For purposes of this condition, the Development Order shall include those matters submitted in all previously approved Development of Regional Impact Notice of Proposed Changes. 1.2. The Developer is authorized to construct 1,074,939 square feet of retail gross leasable space and a 79,500 square foot multi screen movie theater with 3,650 seats on the real property within the Boynton Beach Mall Development of Regional Impact. 2. Except as specifically amended herein, all conditions specified in the Original TAL 50186:1 -3- Development Order (Resolution No. R-74-343) approved by the City on November 16, 1982 and subsequent amendments to the Original Development Order for the Boynton Beach Mall Development of Regional Impact shall remain in full force and effect. BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: 1. Any modifications or deviations from the approved plans or requirements of the Development Order shall be submitted to the Planning Director for a determination by the City Commission of the City of Boynton Beach as to whether the change constitutes a substantial deviation as provided in Section 380.06(19), Florida Statutes. The City Commission of the City of Boynton Beach shall make its determination of substantial deviation at a public hearing after notice to the Applicant. 2. The City of Boynton Beach shall monitor the development of the project to ensure compliance with this Development Order. The City of Boynton Beach Planning Director shall be the local official assigned the responsibility for monitoring the development and enforcing the terms of this Development Order. The Planning Director may require periodic reports of the Applicant with regard to any item set forth in this Development Order. 3. This Development Order shall terminate on December 31, 2010 unless extended by the City Commission. Nothing herein shall limit or extinguish any vested rights of the Applicant or its successors or assigns regarding the development authorized by the Development Order and this amendment to the Development Order. 4. The definitions found in Chapter 380, Florida Statutes, shall apply to this Development Order. 5. The City of Boynton Beach hereby agrees that before December 31, 2010, the Boynton Beach Shopping Mall Development of Regional Impact shall not be subject to down T AL:50186: 1 -4- zonmg, unit density reduction, or intensity reduction, unless the City demonstrates that substantial changes in the conditions underlying the approval of the Development Order have occurred, or that the Development Order was based on substantially inaccurate information provided by the Developer, or that the change is clearly established by the City of Boynton Beach to be essential to the public health, safety or welfare. 6. This Development Order shall be binding upon the parties and their assignees or successors in interest. It is understood that any reference herein to any governmental agency shall be construed to mean any future instrumentality which may be created and designated as successor in interest to, or which otherwise possesses any of the powers and duties of any referenced government agency in existence on the effective date of this Development Order. 7. The approval granted by this Development Order is conditional and shall not be construed to obviate the duty of the Developer to comply with all other applicable local, state and federal permitting requirements. 8. In the event that any portion or section of this Resolution is deemed to be invalid, illegal or unconstitutional by a court of competent jurisdiction, such decision shall in no manner affect the remaining portions or sections of this Resolution, which shall remain in full force and effect. 9. A certified copy of this Resolution shall be transmitted immediately by certified mail to the Department of Community Affairs, the Treasure Coast Regional Planning Council, and Simon Property Group. 10.
