In response to your request dated June 3, 2005 for the
administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following:

Please be informed that the proposed changes on the revised
date stamped 6/9/05 are "minor" as defined within the

Dear Mr. Breese:
Weare pursuing a minor modification approval to allow exterior speakers for the Boynton Beach Mall
Expansion. This action is based on review comments from Karen Main, dated May 13, 2005, in which no
outside speakers are allowed in the City of Boynton Beach. This comment was made due to the fact that the
speakers in question were not part of the original submittal package for site approval.
In the design of a mall for Simon Properties Group, music is a very important aspect to the atmosphere they
wish to create for customers. At the Boynton Beach site, the purpose for sound is to serve as an audible
pathway from the shops and restaurants down to Muvico. The music creates a mood that entices one to sit on a
sidewalk bench to relax after hours of shopping and enjoy the surroundings. Iviusic also serves as an interest
point for the restaurant tenants to pull customers from outside into their establishment to dine. The music style
is limited to instrumental or easy listening to create a soothing atmosphere. The sound system is designed with
constant supervision from the Sound System Integrator to ensure a quality design that is not only audibly
pleasing but also compliments the surrounding landscape and overall design of the space.
Currently our drawings show three speakers down the main sidewalk between the new shops and Muvico, two
speakers south of the main sidewalk on an auxiliary sidewalk to Muvico and finally one speaker near park
benches in a courtyard setting up near the existing mall. Additionally, along the new storefronts, the drawings
show six building mounted speakers, mounted up underneath parapets and two speakers mounted undemeath
the entrance canopy.
The pole mounted speakers are approximately 60' -0" apart mounted on 14' -0 high lampposts, with final
mounting at 12'-0" (2'-0" from top of post). The sound radius of the speakers is 30'-0". Volume is controlled
at the main sound rack located in the mall office while speakers are operational during mall hours from 10:00
a.m. to 9:00 p.rn.

Simon takes great pride in designing their spaces ensuring that a shopping experience at a Simon Mall is one
of a kind. Music is one way that separates them from their competition. Enclosed are four sets of drawings
with highlighted speaker locations and cut sheets. We look forward to hearing your decision.
