We have removed the front tower element, as requested by BJ's Wholesale Club. And we have changed all of the canvas awnings to wood framed canopies with concrete tile roofs, as you requested. Actually you requested we change only four of the awnings, but we decided it looked better to change all of them. The concrete tile is the same style and color that was previously shown on the tower roof. The City reviewed and approved the original plans because they were in keeping with the other outparcels to the BJ's site. Whenever we review outparcels or numerous buildings on the same site, we look to incorporate design elements and colors from one building to another, not so they all are mirror images of each other, but in order that we do not have stark contrasts between buildings on the same site. In this particular case we were looking to incorporate the smallish entry tower feature with spanish tile roofs and buildings with some soft earthtone shade (as designed and constructed for the South Trust Bank and Applebee's buildings), all different, yet tied together to meet our code on community design through unity of character and design concepts. In each case, including the Chick-fil-A, these spanish tiled roof towers are only a very small portion of the roof surface, more of a decoration as opposed to a true roof and something that would not be detrimental to the visibility of the BJ's building. Additionally, BJ's has a sizeable monument sign along the Boynton Beach Boulevard right-of-way that is seen before anything else on the site. Please consider leaving the plans approved by the City as is. I believe it is in everyone's best interest. Thank you for your time and consideration. As I advised Mr. Levy, the entire project was approved as part of a master plan/rezoning process. The modification ofthe master plan to alter access and/or circulation characteristics within the project would require the request for same be submitted to this office and ultimately approved by the City Commission. Staff would review such a proposed modification, to ensure continued adequate circulation throughout the project as originally approved. A change that would lower the standards by which the original project was approved would represent a substantial change to the master plan, thereby requiring the complete rezoning process to be followed. This process would entail, in part, public notification measures including newspaper advertisements and site signage. Modifications to the master plan would be required to satisfy similar standards of access and circulation, which were originally followed, and on which affected parties would have an opportunity to comment. In the event of a condemnation, or sale or transfer in lieu thereof, that reduces the number of usable parking spaces below that which is required herein, the Party whose Tract is so affected shall use its best efforts (including using proceeds from the condemnation award proceeds or settlement) to comply with the parking requirements set forth above. If such compliance is not possible, such Party shall not be deemed in default hereunder, but shall not thereafter be permitted to expand the amount of Floor Area located upon its Tract; and if such Floor Area is thereafter reduced, then it may not be subsequently increased unless the parking requirement is satisfied. Each Party shall keep the Outdoor Areas on each improved Tract fully illuminated each day from dusk to at least one (1) hour after the last business operation thereon has closed, except that BI's shall keep both the Developer Access Way and the BJ'~ Access Way illuminated.
