Box 310 Boynton Beach, Florida 33425-0310 TEL: 561-742-6260 FAX: 561-742-6259 www.boynton-beach.org May 26, 2005 Mr. Joseph Mattei American Awning Co., Inc. 537 Pine Terrace West Palm Beach, FI 33405 Re: Duffy's Sports Grill MMSP 05-040 Dear Mr. Mattei: In response to your request dated May 17, 2005 for the administrative review and approval of the modifications proposed to the above-referenced approved site plan, depicting the following: · Addition of green vinyl awnings to the fa<;ade of the Duffy's storefront in the Boynton Lakes Plaza (as depicted on the attached plan); and Please be informed that the proposed change to the building facade on the revised plan date stamped 5/18/05 is not "minor" as defined within the Land Development Regulations, Chapter 4 - Site Plan Review. The awnings may not continue to be processed by the Building Division as a permit application, due to the following: 1. In accord with the Community Design Plan section of the Code, similar, unifying design elements shall be incorporated into centers or plazas with a number of tenants or structures. When a distinct architectural pattern has been established, consistency shall be required. The numerous tenants wi thin the principal building of the plaza have fairly uniform storefronts, none of which have awnings. The City may potentially look favorably upon a request by the owner of the plaza to place uniform awnings between the columns throughout the entire plaza, again to maintain consistency in the appearance of the fa<;ade for all tenants. However, the request for just one tenant of many in the same structure to have an altered fa<;ade through the use of awnings is inconsistent. Should you desire to continue the awning request/site plan modification as presently submitted, you must apply for a Major Site Plan Modification and a Community Design Plan Appeal. As part of the application, you will need detailed plans, application fees in the amount of $1,150, and an understanding that the process takes approximately 90 to 120 days.
