Design:
(l)-story structure. The roof design consists of a hip-style mansard roof shown at a
typical height of 22 feet, a pair of parapet roof entrances at a height of 26 feet and
a pair of hip-roof entrances at a height of 30 feet - 3 inches and finally, the main
entrance/grand lobby with a hip-roof at 40 feet - 3 inches in height. The required
front setback in the C-3 zoning district is 20 feet; the building would be setback
approximately 60 feet. The required interior side setback (east) is zero feet. The
project far exceeds this requirement, with the building setback 56 feet from the
east property line. The required west side setback is also zero feet, and the site
plan provides approximately a 55 foot setback. The building would be nearly 61
feet from the north (rear) property line. The site plan shows that the dumpster
enclosure is proposed at the northeastern portion of the lot. It is landscaped on
three (3) sides as required by code. The Engineering Division of Public Works has
approved its location and angle with respect to the facilitation of trash removal.
The proposed building and site design would generally meet code requirements
when staff comments are incorporated into the permit drawings.
The proposed Mediterranean design is compatible with the surrounding built
environment and would generally enhance the overall appearance of the
commercial plaza. The principle building and trim colors are earth tones and are
consistent with the colors of the Forum Shopping Center. The body of the wall
area, which contains the greatest portion of mass, would be painted a cream color
(Sherwin Williams - "Napery" #6386). Other wall accent colors proposed along the
base of the building and the articulated portion of the building at a couple of
entrances is a tan color (Sherwin Williams - "Rose Tan"#0069). The accent
moldings and pre-finished cornice proposed at top of the parapet walls would be
white (Sherwin Williams - "Dover White" #6385) and the decorative shutters and
awnings would be a terra cotta color (Sherwin Williams - "Foxy" #2307 and
Sunbrella - "Terra Cotta", respectively). The barrel tile roof is proposed as a typical
Spanish blend (Hanson - "Addison Blend").
The sign elevations sheet indicates the proposed location and area for walls signs.

freestanding monumen sign is proposed at the southwest entrance to the

assistance in locating a specific suite. The sign is designed to match the monument

PART 6: Describe in general terms the proposed project, system, or activity.
Construction of a 20,000sf medical office building and associated modification to existing parking lot and existing
drainage system. Modifications to existing drainage system include relocating a portion of the existing exfiltration
trench to accommodate the new building location. The propoesed improvements also include an addition al ??LF of
exfiltration trench to accommodate for lost storage by the proposed building and pakring lot modifications. Refer to the
attached surface water management calculations for a comparison of pre-development vs post-development anaysis of
stage-storage characteristics. The proposed development will preserve the historic stage-storage volumes on the site
such that no weir modification is necessary and no negative impacts to the surface water management system will
occur.

This letter is in response to the above noted references. You are requesting a "waiver of platting" for the
proposed Forum Professional Center located at the northeast corner of North Congress Avenue and
Ocean Drive. It is also noted that this proposed development has met the City's Planning & Zoning
Division requirements, and has been approved by the City Commission at a public meeting for
development.
After a research review of this issue, this Division has no objection in supporting your waiver of platting
request pursuant to the City's LOR Chapter 5, Article II, Section 1.A & 1.A.3. and Section 1.B. As you
have noted in your correspondence supporting your request for waiver, there are reciprocal ingress and
egress, and utility easements that have been prepared for recording in the Public Records of Palm Beach
County, Florida. Please provide this office with a copy of the record documents when implemented.
Therefore, your proposed development as shown in Exhibit "B" will not constitute an illegal subdivision of

the property wherein the Fonnn Shoppes are located and where Forum Professional Center, LLC has
requested the City's approval to construct a 20,000 square foot office condominium. Based on my
review of the title update, I have concluded that the existing Cross Parking and Cross Access Easements
recorded in Official Record Book 2540, Page 463 and in Official Record Book 2545, Page 633, all of
the Public Records of Palm Beach County, Florida are in full force and effect as ofthe date of this letter.
This opinionlletter is being given in conjunction with the upcoming Planning & Zoning meeting

Dear Mr. Breeze:
Kimley-Hom and Associates, Inc. has undertaken a shared parking analysis for
the Forum Professional Center located in the southeast comer of Congress
Avenue and Boynton Beach Boulevard, in the City of Boynton Beach, Florida.
The existing development on the site contains a 23,595 square foot (2015 seat)
movie theater and 18,480 square feet of retail uses. The proposed development
plan for the site consists of adding 20,000 square feet of medical office to the
existing retail and theater.
Gross Parking Demand Evaluation
Application of the City of Boynton Beach Code parking requirements to this
proposed plan results in a parking supply requirement of 429 parking spaces. As
shown on the site plan, 407 parking spaces are currently being provided. This
results in a 22 parking space shortfall. Since the proposed development is to
accompany existing land uses that have different time-of-day parking demand
characteristics, an evaluation was undertaken to determine the extent to which
parking supply may be shared between the various uses. This analysis assumes
that all uses are built to their proposed size and are fully occupied.
Shared Parking Analysis
Shared parking analyses are typically based upon the methodology developed by
the Urban Land Institute (ULI). The ULI Shared Parking report contains parking
accumulation percentages by time of day for a number of different types of land
uses that have shared parking potential. For purposes of this analysis, it is
assumed that the peak demands for all uses occur during the same season of the
year. No discounts or reductions have been assumed for seasonal variations in
demand throughout the year. This assumption represents a conservative
approach.

Although the medical office land use does not match any of the general
categories provided in the ULI Shared Parking report, it is anticipated that the
use of this facility will follow the patterns seen within the office land use
category.
During the weekday, the peak shared parking demand is 354 parking spaces,
which occurs at 2:00 p.m., as shown in Table 2. On Saturdays, the peak expected
demand is 335 parking spaces, which occurs at 1 :00 p.m., as shown in Table 3.
The Forum Professional Center includes a total of 407 parking spaces on the
proposed site development plan. Based on the expected peak shared parking
demand of 354 parking spaces, the site is expected to have a surplus of 53
parking spaces.
Conclusion
The foregoing analysis shows that the parking supply provided on the site is
expected to adequately accommodate the parking demand with the proposed plan
of development. It should be noted that the required buffer of an additional 10%
of demand is already included since the per unit demand used in the analysis was
based on parking rates from the City's Land Development Code.

Kimley-Horn and Associates, Inc. was retained to prepare a traffic impact
concurrency evaluation for the proposed medical office building development
located on the southeast comer of Congress Avenue and Boynton Beach
Boulevard in the City of Boynton Beach, Florida. Based on the information
provided by Kenneth R. Carlson- Architecture, P.A., we understand that the site
currently contains approximately 18,480 square feet of retail uses and a movie
theater with approximately 2,015 seats. These uses have existed and been in
operation for more than five (5) years. The proposed project will add 20,000
square feet of medical office to the existing site. Build out for the addition is
expected to occur at our before the end of 2009. Please see attached site plan.
Trip Generation Analysis
A trip generation analysis was undertaken in which the trips associated with the
proposed expanded development were compared to the trips associated with the
existing development. Pass by capture was determined based on rates contained
in Article 13(Impact Fee Ordinance) of Palm Beach County's Unified Land
Development Code. Internal capture calculations for the site were based on
worksheets contained in the Institute of Transportation Engineers (ITE) Trip
Generation Handbook in which the internal capture rates for any given use was
restricted to 10% pursuant to Article 12.C.l.c.2.d of Palm Beach County's Traffic
Performance Standards. The internal capture worksheets for the proposed land
uses and currently approved land uses for daily, AM and PM peak hours are also
attached.

Table 1 presents the proposed expanded development and current development
trip generation. As can be seen in Table 1, there are net increases of 662 daily
trips, 45 AM peak hour trips and 60 PM peak hour trips.
Project Significance
According to the net peak hour trip generation for the site (60 vehicles per hour),
the maximum radius of development influence (RDI) was found to be one (I)
mile for Test 1 and the directly accessed link for Test 2. Based on a review of the
travel time characteristics and complementary land uses in the project's radius of
influence, it was determined that approximately 25% of project trips would be
distributed to the north, 20% to the south, 30% to the east and 25% to the west.
Figure 1 presents a graphic depiction of the assignment of project trips to the
surrounding roadway network. Table 2 depicts the traffic assignment on links
within the project's maximum radius of influence for Test 1 and presents a
summary of those links significantly impacted by the proposed project
expansion. As can be seen in Table 2, none ofthe roadway links within the
project's radius of influence will be significantly impacted by the proposed
expansion. Therefore, no further link or intersection analyses are required.
None of the links directly accessed by the project appear on the Palm Beach
County Test 2 map of deficient links. Therefore the proposed expansion meets
the requirements of the Test 2 standard.
Evaluation of Driveways
The site is served by three (3) primary driveways and one (1) shared driveway.
There are two full access driveways that abut Ocean Drive to the south, a right-in
right-out access directly on Congress Avenue, and one shared right-in right-out
access directly on Boynton Beach Boulevard via the adjacent plaza to the north.
It is anticipated that the northern most driveway along Boynton Beach Boulevard
will serve as a secondary access point for those traveling to/from the medical
office building via the existing plaza to the north.
It is also expected that the project related driveway volumes will follow slightly
different distribution patterns than the entire site as a whole considering the
existing retail/theater uses versus the proposed medical office uses. To illustrate
the different distribution patterns, we have included three (3) site driveway
assignment figures. Figure 2, depicts the trip assignment for only the project
related traffic traveling to/from the proposed medical office. Figure 3, depicts the
estimated traffic traveling to/from the existing retail center and theater. Figure 4,
depicts the total driveway volumes as a result of the proposed and existing
development.

The total driveway volumes assigned in Figure 4, are 6,075 daily trips, 66 AM
peak hour trips, and 395 PM peak hour trips. According to Palm Beach County's
"Guide to Parking Lot and Street Access Design Criteria and Standards," it is
necessary to classify project entrances as minor, intermediate, or major according
to the following criteria:
1. Minor - Provides for a maximum average daily traffic of 500.
2. Intermediate - Provides for a maximum average daily traffic from 501 to
2,000.
3. Major - Provides for a maximum average daily traffic greater than 2,000.
Using these criteria, all site driveways will be classified as intermediate.
The Palm Beach County code requires a right-turn lane when inbound peak hour
right-turning traffic is 75 vehicles or more and a left-turn lane when inbound
peak hour left-turning traffic is greater than 30 vehicles. Figure 4 illustrates the
proposed project AM and PM peak hour total volumes assigned to the project's
driveway locations. In consideration of these volumes, with respect to the Palm
Beach County access design standards results, it has been determined that no
additional turn lanes are need at the site driveways.
Conclusion
This analysis demonstrates that the proposed site expansion of the Forum
Professional Center medical office building development meets the requirements
of Article 12 of Palm Beach County's Traffic Performance standards though the
end of 2009.
