Given that an interior location of the container would avoid aesthetic, parking, and screening issues, and would not affect the approved site plan, staff does not object to an interior location for the proposed collection container. Of course the ultimate location of the container should not interfere with required pathways or points of ingress/egress. Regretfully, we must deny your request. The benefits of Goodwill Industries and other benevolent organizations are extensive and very important to the community; however, the City must be consistent in its review of requests that potentially impact capacity and function of improved sites, and in particular, consider the ramifications of such precedence. Prior requests have been denied due to issues involving property appearance, visibility, parking space use, and site activity. Although the mall is unique with respect to its size, actual availability of parking spaces, and availability of space distant from adjacent rights-of-way, we do not have regulations that facilitate the impartial treatment of such requests. Please realize that significant effort contributes to the thorough review of each site plan to ensure complete application of all city regulations, and that each project has optimal appearance, traffic circulation, and predictable performance. Changes to these attributes subsequent to site plan approval circumvent the formal approval process, and may lower the standards represented by the original approval. Therefore, and again regretfully, we must deny your request for the above-referenced container at the Boynton Beach Mall.
