EXPLANATION: The Monterey/Congress CDD was approved by the City Commission on January 18,2005. The City Commission requested that a maintenance agreement for the drainage and wetlands between the City and the CDD be put in place. Staff recommends that the petition for the passing of an ordinance to establish the Monterey/Congress Community Development District be approved. EXPLANATION: The subject petition requests establishment of a Community Development District (CDD) for the "Monterey Development", a residential project approved for 300 townhomes on a parcel located on Congress Avenue, north ofL.W.D.D. Canal L-30. A CDD is an independent district authorized by Chapter 190, Florida Statutes, for the purpose of planning, constructing, acquiring, operating and maintaining infrastructure in large planned community developments. The proposed District will fmance drainage and potable water supply and sanitary sewer systems as well as wetlands mitigation and offsite improvements which include turn lanes and placement of certain utilities. The District will operate and maintain drainage system for the development; potable water and sanitary sewer systems will be operated and maintained by the City.
