RECOMMENDATION: Please place this request, authorizing the City Manager to execute the appropriate
documents pertaining to the maintenance of the drainage system and the wetlands for the Monterey/Congress Community
Development District (CDD), on the January 4, 2005 City Commission Agenda under Legal.
EXPLANATION: The Monterey/Congress CDD was approved by the City Commission on January 18,2005. The City
Commission requested that a maintenance agreement for the drainage and wetlands between the City and the CDD be put in
place.

RECOMMENDATION: Please place this request on the January 18,2005 City Commission Agenda under
Legal/Ordinance-Second Reading. Staff recommends that the petition for the passing of an ordinance to establish the
Monterey/Congress Community Development District be approved.
EXPLANATION: The subject petition requests establishment of a Community Development District (CDD)
for the "Monterey Development", a residential project approved for 300 townhomes on a parcel located on Congress Avenue,
north ofL.W.D.D. Canal L-30. A CDD is an independent district authorized by Chapter 190, Florida Statutes, for the purpose
of planning, constructing, acquiring, operating and maintaining infrastructure in large planned community developments. The
proposed District will fmance drainage and potable water supply and sanitary sewer systems as well as wetlands mitigation
and offsite improvements which include turn lanes and placement of certain utilities. The District will operate and maintain
drainage system for the development; potable water and sanitary sewer systems will be operated and maintained by the City.

. Lynn Phillips Jr., my dad, died on Saturday of
natural causes. 35 years ago Red Smith of the
Herald Tribune in New York described dad in Ilis
column. A pleasant man, Cheerfully friendly,
handsomely and quietly dressed, Impeccably
scrubbed and barbered'. He was that and much
more. A lo~lng'husband andfllther, he and my
mom Mary made their home In Manhattan on
East 57th Street for more than fifty years, where I
grew up in an exciting atmosphere of love and
encouragement. During World War II Dad served
as a lIeutenantl!l the Army sign/ilcorps., His,
career In advertising spanned' networlls and
publishing. " ' "
Dadmo'v'sd to Jupiter Florida after mom died
in 1992. He was always ,known for his qui(:k wit
and penchant for 'practical jokes, Dad loved .to
make. people laugli.' He was a self taught
muslclanon a myriad of instruments. He was a
great piano, playe.r and'a menace on the

with two speaial relationships, one with his care-
taker PattY ):Irigham who became the daughter
he never had .and one with Marge Bazaan the
romailce of his, final years. ,

brother Chick; his: grandchildran: Lisa Pam Amy,
and Brian; and his great grandchildren: Kevin,
