Tthe front and side Exterior Elevations of Building #5, illustrates our sensitivity to the
residential - zoned property to the east. The east side of the building would be 20 feet
high and the third floor setback per CHAPTER 5.L.4.G. (2),
"Structures on the perimeter of an IPUD project, in addition to the basic setback
conditions, must be setback one (1) additional foot for each one (1) foot in height for
the perimeter structures that exceed 50 feet".
Landscape screening would be provided at the east side of the building.

Dear Laurinda:
Per the Preliminary Site Plan we reviewed with you, it was explained that in order to plan
a creative I-PUD project, a 35 ft. ROW was requested.
Justification
1. As reflected on the Site Plan, a central plaza is the key design element for Harbor
Cay. Lakeside Harbour, the interior private street, passes through the
development and is connected to the plaza, which will visually enhance its
appearance and make it part of the plaza.
2. Two 10ft. travel lanes, a 5 ft. landscape buffer and 10ft. for parallel parking will
be located within the ROW.
3. As outlined in items 1. and 2. above, the visual character of the proposed I-PUn
Village will provide an intimate complex, which is dependent on the proposed 35
ft. ROW.

I sent correspondence and a print regarding the area allocated for trash pickup.
I assume this response which illustrates how trash containers ( 2 ft. wide with a 3 ft.
clear space between each container) would be placed during restrictive pick-up times.
PLEASE CONFIRM that this satisfies your comment.
Also, I recognize that Jeff has been away but would appreciate a response ASAP regarding
OUR POSITION that the interior driveways are in fact, driveways
and not private streets. Until this determination is made, WE CANNOT PROCEED
TO ADDRESS ANY OUTSTANDING COMMENTS FROM STAFF.

Dear Mr. Atefi:
Kimley-Hom and Associates, Inc. is submitting a traffic impact statement
for the abovementioned 23-Unit Town home project pursuant to the
requirements of Article 12 of the Palm Beach County Unified Land
Development Code also known as the Palm Beach County Traffic
Performance Standards. The 1.43 acre parcel to be developed is located in
the north east comer of Gateway Boulevard and Federal Highway in the
City of Boynton Beach, Florida. Build out for the development is
expected to occur before the end of2009.
Trip Generation Analysis
A trip generation analysis was undertaken in which the trips associated
with the proposed development were calculated based on rates equations
contained in Article 13(Impact Fee Ordinance) of Palm Beach County's
Unified Land Development Code for daily trip generation and on equations
published by the Palm Beach County Traffic Division for AM and PM
peak hour trip generation.
Table 1 presents a summary of the trip generation associated with the
proposed site. As can be seen, the site is expected to generate 161 daily
trips and 16 AM peak hour trips and 18 PM peak hour trips.

Our response to the 1 st Review addressed general comments so we will not repeat
ourselves. Your correspondence of 3/9/06, in response to our correspondence of 3/8/06
outlined that comments 75, 82 and 83 are important. Since our Client does not agree
with the requirements pertaining to the south setback at Building 5, the Site Pian is
retaining the 10ft. setback, which was originally shown as 5 ft.
I also question why important planning issues were not fully discussed at the March 7th

Dear Mr. Brooks:
We are in receipt of your request for Administrative Waivers to various portions of the City's land
Development Regulations (lDR) and Engineering Design Standards, dated February 28,2006. We
have reviewed your request and the site plans to make a determination regarding the impact of
waiving the requested standards. Following are the requested waivers and the response for each:
. A waiver to the lOR, Chapter 2, Section 5.L.4.h (1) to reduce the right-of-way width from 40-ft. to
35-ft. Response: ALL roadways, both internal and for the private road Lakeside Harbour
Drive shall have a private right-of-way width no less than 35-ft. to accommodate ingress,
egress and public services. However, the Staff of the Engineering Division of Public Works
concurs with the requested waiver.
. A waiver to City Standard Detail P-1 to reduce the pavement widths of the private roadways from
the minimum required lane widths from 11-ft. to 10-ft. (from 22-ft. to 20-ft.) . Response: The
Staff of the Engineering Division of Public Works concurs with the requested waiver.
A copy of the original correspondence is attached to this waiver request and is hereby made a part of
the record. Please be advised that all other CODE, lDR and Engineering Standards still apply to this
project.

Dear Mr. von Rospeunt:
The property owners of lakeside Harbor would like to clarify the situation
regarding the community dock. As it stands now, it appears to us that you are
not willing to fully cooperate with us as an entity for the repair/replacement
project as we have recently discussed.
On February 20,2006, you sent a letter to the property owners of Lakeside
Harbor stating that you were offering to undertake the community dock project by
assuming the bulk of the work to deal with the proper authorities and future
funding. You also stated in the letter that the current dock is in bad condition and
needs immediate work to insure safety of anyone using the dock.
However, over one year has passed since we received this letter and you have
not followed through with the project. Therefore, we met with you at your office
on March 19, 2007 and we extended our offer to divide the cost of the community
dock project among all property owners. You agreed to this proposal. We are
prepared and ready to begin the project immediately. Therefore, we must set a
time limit on the commencement of the project.
We have provided you with your share of the estimated cost and request your
payment of $5407.75 by April 10, 2007. We will proceed with the project at that
time. Please make your check payable to Ray Qualmann Marine Construction,
Inc. and give to John Yull as he is collecting all checks to make full payment to
the contractor when project is completed.
We will be working directly with Ray Qualmann Marine Construction, Inc. and
therefore cancel any authority by Harbor Cay to act as agents for the community
on this project.

Re: Repair to the Dock at the Eastern End of the Easement to Dixie Highway
A letter authorizing the agency of Harbor Cay, LLC was presented to the community a few weeks ago,
and then a revision to address the concerns of some neighbors. The authorization is for the SOLE
PURPOSE of obtaining permits to "Remove and Replace" (R&R) the dock. The authorization does NOT
grant favored status to ANY property owner vis-a-vis rights, access, future obligations or ownership. The
latest Authorization of Agency will be reprinted, and a meeting will be held at the Development Office of
Harbor Cay at 9:00 am on Saturday, June 3rd, 2006. Your attendance is required only in that your
signature is. However, the entire community has much to lose; a plan of action is to be devised, as an
entire community, which must not fail.
Be advised that our community is running out of time before the dock will be ordered condemned by the
City of Boynton Beach. If this comes to pass, and the dock is actually removed, there is a significant
possibility that the Florida DEP or the Army Corps will not allow what will be considered to be a 'new'
dock to be built.
Despite assertions to the contrary, the damage to the dock is not reparable with a band-aid, it must be
rebuilt from scratch. We have researched the subject of the R&R of the current dock structure. The
FLDEP and Army Corps, for an R&R, are generally accepting for petitions to exactly replace an existing
damaged dock. The City of Boynton Beach will not accept an application for the permit to R&R without
prior approval from the FLDEP and Army Corps. The FLDEP, and through their auspices the Army
Corps, will not accept a petition without the dock owner's signature. Our dock has no 'owner'. The loose
affiliation of property owners on Lakeside Harbour each have access rights to the easement, and
therefore the dock. Thus, an 'Authorization of Agency' must be signed so that a recognized entity may
submit the petition. It is improper for any individual property owner to extort or hold hostage the rights
of the majority of the owners, as the loss of the dock will adversely affect the property values of all owners.
Litigation to resolve such issue will take time that we do not have. We will lose our dock. Don't let this
happen.

Reference: DOCK AT LAKESIDE HARBOR DRIVE
Inspection of subject dock has revealed the following:
....
This is a wooden structure supported by many poured in place pilings.
Piles are 3" in diameter casings filled with concrete and at least one #5
reinforcing bar.
Probing showed that piles penetrate the berm adequately.
9 piles have been vandalized shattering the P.V.c. casing and exposing steel
reinforcing.
None of the affected piles were damaged below the berm line.
An 8" min. diameter repair casing can be slipped over the affected piles at least
12" above the broken section and filled with a 3,000 psi concrete. The sleeve
will penetrate the berm at least 6" on each repaired pile.
The remainder of the piles supporting this structure appear to be in good
condition.
This structure has been intact as built for at least 12 years.
