E. Use of adjacent properties including right-of-way lines for all streets and alleys,
sidewalks, turn lanes and driveways

4. Statement of special conditions, hardships or reasons justifying the requested exception or
variance. Respond to the seven (7) questions below (A-G) on a separate sheet (Please print

A. That special conditions and circumstances exist which are peculiar to the land, structure
or building involved and which are not applicable to other lands, structures or buildings
in the same zoning district;
B. That the special conditions and circumstances do not result from the actions of the
applicant;
C. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this Ordinance to other lands, buildings or structures in the
same zoning district;
D. That literal interpretation of the provisions of this chapter would deprive the applicant of
rights commonly enjoyed by other properties in the same zoning district under the terms
of the Ordinance and would work unnecessary and undue hardship on the applicant;
E. That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building or structure;
F. That the granting of the variance will be in harmony with the general intent and purpose
of this chapter and that such variance will not be injurious to the area involved or
otherwise detrimental to the public welfare.
G. Variances to minimum lot area or lot frontage requirements, that property is not
available from adjacent properties in order to meet these requirements, or that the
acquisition of such property would cause the adjacent property or structures to become
nonconforming. Applicant shall provide an affidavit with the application for variance stating
that the above mentioned conditions exist with respect to the acquisition of additional
property.

No quasi-judicial proceeding shall proceed until proof of notice of the proceeding, in affidavit form, has
been filed with the Office of the City Clerk. Proof of notice must include the name and address of each
property owner to whom notice was mailed and a photograph of each sign posted, as hereinafter
required. The following notices must be paid for and provided by the applicant:
1) All property owners, homeowner associations, and condominium associations that own property
within four hundred (400) feet of the boundary line of the property which is the subject of the
quasi-judicial hearing shall be mailed, by first class mail, a notice of hearing postmarked no less
than ten (10) calendar days prior to the hearing.
2) One (1) sign for each street frontage of the property shall be posted no less than ten (10) days prior
to the hearing. The sign shall be legible from a distance of 100 feet and shall contain a description
of the approval being sought, the date, time and location of the hearing, and a statement that the
application being considered is available for inspection in the Development Department of the City
of Boynton Beach.

Request for variance on non-conforming lot.
A. The subject property at 912 NW 13th Ave in Boynton Beach has no special
condition; however, circumstances do exist. According to the zoning chapter 419
section 11. 1 - zoning RIAA the front footage must be a minimum of 60ft; the
subject property has 50ft.
B. No special condition or circumstance exists; however, we're under the impression
that the City of Boynton were allowing non-conforming lots to be built upon
pending approval.
C. Granting the variance requested will not confer special privileges, the zoning
board evaluate each case as they arrive, this improvement will eliminate unwanted
debris and future clean-up to subject property.
D. The interpretation of the provision in the chapter is clear; however, we are in a
period where available land is scarce. We would like to see the area develop with
similar homes in the area.
E. By granting a 10ft variance makes it possible to develop the subject property.
Section 11.1 require 60ft frontage. We have a 50ft frontage; all other requirements
were met for the building structure. Minimum lot 7,500 sq ft Minimum front 25ft,
minimum rear 25ft, minimum side7.5 minimum living 1,250 sq ft. Maximum lot
coverage 40%.
F. By granting the variance the surrounding properties will not be injurious or
detrimental to the public welfare. The general intent and purpose of this chapter is
a guide; however, each case should be looked at differently.
G. We attempted to pursue 10ft of the property to the east; however, the owner was
unwilling. The property to the west has no room. See letter attached
