Dear Mike:
Our client, New Century Companies, LLC, has been diligently working to secure a
building permit for the project known as the "Boynton Dixie." However, it appears that they
will not have secured a building permit prior to the expiration of the site plan.
Pursuant to Chapter 4 Section 5 of the City of Boynton Beach Land Development
Regulations. this letter is our official request for an extension to the site plan for a period of
one (1) year to allow our client to secure building permits for this project. The following is a
list of accomplishments that we feel demonstrates our "good faith" efforts:
~ A tortoise relocation permit (#WR06027) was received from the State of
Florida Fish and Wildlife Conservation Commission on January 25,2006. All
three (3) tortoises were successfully relocated to the Boynton Beach Mall
Preserve on March 23, 2006;
~ The Environmental Resource Permit was submitted to the South Florida
Water Management District ("SFWMD") on January 30, 2006. All comments
have been addressed and our client is waiting on issuance of the permit;
~ The plat was submitted to the City of Boynton Beach Engineering
Department on February 1, 2006. Revised plans have been submitted to the
City for final plat approval;

~ The paving and drainage plans including the bond estimate was submitted to
the City of Boynton Beach Engineering Department on February 1, 2006.
Revised plans have been submitted to the City for final approval;
~ The on-site water and sewer plans were submitted to the City of Boynton
Beach Engineering Department on February 1, 2006. Revised plans have
been submitted to the City for final approval;
~ A Capacity Reservation Fee in the amount of Eleven Thousand Three
Hundred Sixty Five and 20/100 ($11,365.20) Dollars was paid in full to the
City of Boynton Beach on February 28, 2006;
~ The Water Use Permit was submitted to the SFWMD in March 2006. All
comments have been addressed and our client is waiting on issuance of the
permit;
~ The SE 34th Avenue water main plans were submitted to the City of Boynton
Beach on March 1, 2006. All revisions to the plans are complete other than
waiting for test results;
j;. The NPDES compliance permit was approved by the Florida Department of
Environmental Protection ("FDEP") on June 22, 2006;
j;. The SE 34th Avenue water main plans were submitted to the Florida East
Coast ("FEC") Railway on July 7,2006; and
~ Building permits for all sixteen (16) buildings were submitted to the City of
Boynton Beach Building Department on July 11, 2006;
Enclosed please find a check in the amount of Four Hundred and 00/100 ($400.00)
Dollars made payable to the City of Boynton Beach. Our office will be sending notices to
neighboring property owners and providing all signage that is required for the extension.
Please advise me of all respective dates that this extension request will be heard and
before which Boards.
