Reductions to setbacks
Dear Ms. Palermo:
It has come to our attention that we have not provided you with a written response to your letter dated
July 13,2006, wherein you inquire about the above-referenced application, ask if setbacks are
consistent or differ city-wide, and ask if precedence is the motivation behind this request.
First, your understanding is correct regarding how the setback modifications differ for lakefront lots and
non-Iakefront homes. As for setback regulations, the setbacks are standardized for conventional
zoning districts (i.e. 25 foot minimum rear setback); however, the setbacks for each Planned Unit
Development (PUD) in the city, such as Boynton Lakes, Meadows 300, Nautica Sound, etc. are
established at the time of rezoning and typically differ as a function of design, unit type, and project
size, for example. Further, the minimum setbacks within the Boynton lakes PUD even are unique
within several of the different plats or tracts. With respect to precedence, exceptions or variances are
not processed for properties within a PUD, as theoretically, there should be no hardship for one
property owner unique to all others, which is necessary to support a variance request. Instead,
modifications to setbacks are through master plan modifications, and typically involve lots with similar
characteristics or constraints. For example, a request was approved in 2003 for the reductions in rear
setbacks for lot #6 through lot #23 within Plat 4 for Boynton lakes. lastly, please understand that such
requests must be endorsed by the respective homeowners association.

Thank YOll for the public hearing notification regarding Boynton l ~kesfBoard Member{s) request
for the "set back" standards modification.
Many residents including myself are unaware of this request and lack an accurate
understanding of the suggestion or its implications. I am thankfu to your staff for explaining and
found thern very courtesy and helpful.
For clarification purposes, I understand this to mean, owners of h kefront homes would be
permitted :0 use their land for building purposes, up to 2 feet to tJ e end of their property line
While non-lake front homes would have only up to 5 feet to the er ::J of their land. If I may please,
a couple cf questions please.
1. Are set back standards the same throughout Boynton 3each, from development to
development or do they differ from development to de 'elopment and also within a
specific development such as this request?
2. Has precedent already been established via a special lariance requests, alloWing
a, (Example) a room enclosure to be built within; feet of the exterior property
line?
b. Or a screen enclosure to the back property linE or to the side?

Boynton L:akes is a friendly and quiet place to live_ Many neighb Irs talk but unfortunately have
little time cr interest in the "political" arena. It would be nice if cor Iments be it written or in
attendanCEl to voice opinions or participation were to occur. Bus: lives, work, families and other
reason~ prevent this. But for what this is worth, if changes were 1 ) be approved, my neighbors
and I migh: agree that codes and standards should be the same f )r all homes. regardless of lot
location.

BOYNTON LAKES NORTH
Request:
The Boynton Lakes North Home Owner's Association requests
modification to each of it's master plans to allow the following:
Reduction in the rear yard setback for water lots (those abutting a canal or
lake) from ten (10) feet to two (2) feet for hard roof structures and from
five (5) feet to zero (0) feet for screened roof structures.
Reduction in the rear yard setback for interior or non-water lots from ten
(10) feet to five (5) feet for hard roof structures and from five (5) feet to
two (2) feet for screened roof structures.
Justification: Lots within this master planned subdivision do not back up to one another
or share a common property line, they either abut a water body or common
area owned by the home owner's association. Therefore, no building
addition associated with one property would encroach upon another
resident's property and appropriate separation between residential units
would be maintained. The relaxation of the rear setback will allow for
reasonable expansion of the homes within our subdivision to meet today's
needs for our families. The intended expansions would not encroach into
any drainage easements, therefore we do not believe the drainage as
designed for the subdivision will be affected. The utility easements at the
rear of any properties are simultaneously being requested for
abandonment, since we understand that no utilities are located within
them, as we believe all utilities are located at the front of our properties.
We understand we cannot encroach onto any drainage easements or tracts,
or any common area of the HOA, and have no intention with this request
to do so. Lastly, a portion of our subdivision (Lots 6 - 23 on Hastings Ln.)
received approval for a modification to the master plan in April of 2003,
which mirrors our request for the rest of lots abutting a water body. We
believe the proposed amendments will not have an adverse effect on
other properties within or outside our subdivision.
