Site Characteristic: According to the survey, the subject site is currently vacant. The survey also shows
that a 30-foot wide road right-of-way, which traversed through the interior of the
property, was abandoned according to Official Record Book 2586, Page 1378.
However, a 10-foot wide utility easement currently runs in an east-west direction
along the south property line. This utility easement would not be altered and
would remain in its current state. Also depicted is a 35-foot wide canal easement
oriented in an east-west direction along the north property line.

BACKGROUND
According to public documents, the property was annexed in June 1992 and
acquired by Wal-Mart in November 1999. On September 2,2003, a site plan for a
21,600 square foot retail plaza named Winchester Commons was approved for the
site. The applicants failed to acquire the necessary permits or request a time
extension within a one (1) year timeframe and the project was abandoned. As a
result, Ms. Kim Glas-Castro, representing new ownership, is requesting site plan
approval for the construction of a 4,222 square foot bank and 13,709 square feet
of retail space on the 2AO-acre parcel.
ANALYSIS
A traffic statement was sent to the Palm Beach County Traffic Division for
concurrency review in order to ensure an adequate level of service. In a response
dated January 17, 2006, Palm Beach County Traffic Division determined that the
project meets the Traffic Performance Standards, provided the design of the site
encourages the use of the Winchester Park Boulevard ingress/egress for motorists
desirous of heading eastbound on Boynton Beach Boulevard. The approval also
suggests the incorporation of an exclusive westbound right-turn (deceleration) lane
into the site from Boynton Beach Boulevard, which the applicant has provided.
The City's water capacity, as increased through the purchase of up to 5 million
gallons of potable water per day from Palm Beach County Utilities, would meet the
projected potable water for this project. Local piping and infrastructure
improvements may be required, especially on the water delivery system for the
project, depending on the final project configuration and fire-flow demands. These
local improvements would be the responsibility of the site developer and would be
reviewed at the time of permitting. Sufficient sanitary sewer and wastewater
treatment capacity is also currently available to serve the project, subject to
the applicant making a firm reservation of capacity, following approval of the site
plan.
Staff reviewed the site plan and determined that current staffing levels would be
sufficient to meet the expected demand for services.

Drainage: Conceptual drainage information was provided for the City's review. The
Engineering Division has found the conceptual information to be adequate and is
recommending that the review of specific drainage solutions be deferred until time
of permit review (see Exhibit "C" - Conditions of Approval).
School: School concurrency is not required for this type of project.
Driveways: The site plan (sheet C-3) shows that one (1) point of ingress/egress is proposed on
Boynton Beach Boulevard. This driveway opening would allow for right turn only
ingress and egress. The Engineering Division of Public Works has reviewed and
approved the proposed deceleration lane and driveway opening, A second point of
ingress/egress is proposed on Winchester Park Boulevard, at the north side of the
property.
Parking Facility: According to the Land Development Regulations, retail uses require one (1) parking
space per 200 square feet of gross floor area. The site plan (sheet C-2) proposes
13,709 square feet of retail area, thereby requiring 69 parking spaces. Banks
require one (1) parking space per 250 square feet of gross floor area, Since the
bank is 4,222 square feet, 17 parking spaces would be required. The site plan
depicts 90 parking spaces, including five (5) designated for handicap use.
Therefore, there would be 4 excess parking spaces provided. A 12' x 35' loading
space has also been provided at the west end of the retail building.
Landscaping:
All spaces, excluding the handicap spaces, would be dimensioned nine (9) feet - six
(6) inches in width and 18 feet - six (6) inches in length. All proposed parking
stalls, including the size and location of the handicap spaces were reviewed and
approved by both the Engineering Division and Building Division.
The proposed open space or "pervious" area would be 26,990 square feet or
25.8% of the total lot. The front (south) landscape buffer would be approximately
12 feet wide west of the entrance off of Boynton Beach Boulevard. East of the
entrance, the front landscape buffer would be 7 feet wide as a result of the
deceleration lane. The landscape plan (sheet LA-1) shows that this buffer would
contain Live Oak shade trees. It would also contain a row of Redtip Cocoplum
hedges and Blue Plumbago shrubs planted in groups. The western perimeter buffer
would contain East Palatka Holly shade trees and clusters of Sabal palm trees with
a row of Redtip Cocoplum hedges installed at the base. The rear (north) perimeter
buffer would contain a row Sabal palm trees with Redtip Cocoplum hedges installed
at the base. The Cocoplum hedge would be planted at increased height to help
provide screening of the drive-thru teller operation on the north side of the bank.
The east perimeter buffer (along Winchester Park Boulevard) appears to be seven
(7) feet in width and would contain the same plant material as the south perimeter
buffer. Additional groundcover plants would also be required along Winchester
Park Boulevard, same as along Boynton Beach Boulevard (see Exhibit "C" -
Conditions of Approval). Other project trees would include Mahogany, Tree
Ligustrum and Purple Glory trees. The signature trees (Purple Glory trees) would
have to have six (6) feet of clear trunk installed within the safe-sight triangle. Other
"shrubs and groundcover" would include the following: Dwarf Yaupon Holly, Wax

Jasmine, New Gold Lantana, Dwarf Indian Hawthorne, Dwarf Schefflera and
Viburnum.
Building and Site: The building and site design as proposed would generally meet code requirements
when staff comments are incorporated into the permit drawings. The floor plan for
the retail building (sheet A4.0) shows that the building would contain multiple
tenants with bay sizes ranging from 1,400 square feet to 1,600 square feet in area.
However, the size of each bay could change depending on the needs of the
individual tenants. Additionally, the proposed retail building has been designed as a
one (l)-story structure. The elevations (sheet A5.0) show the top of the parapet
wall at 19 feet - ten (10) inches in height. The peak of the highest roof would be
30 feet in height, well below the maximum of 45 feet allowed in the C-3 zoning
district.
Design:
The Commerce Bank building is designed as a one (l)-story structure, with a taller
lobby area with volume ceilings. The elevations (sheet A300) indicate the top of the
typical parapet wall at nearly 17 feet in height and 26 feet at the entry/lobby, again
well below the maximum of 45 feet allowed in the C-3 zoning district. The covered
drive-thru teller accommodates four (4) drive lanes, located on the north (back)
side of the building. Placing this function to the rear of the building helps screen
this operation from Boynton Beach Boulevard and with the landscaping installed at
a taller specification than minimum code requirements, assists in the screening of
this operation from Winchester Park Boulevard.
Most of the newer commercial buildings constructed within the immediate vicinity
of the subject property (i,e, Wal-Mart, ABC Fine Wine and Spirits, Boynton
Commons shopping center) possess desirable architectural characteristics such as
arcades, barrel tile roofs, columns, score lines, and diamond accent markings. The
applicant and staff worked together to incorporate design elements that would
increase compatibility between the proposed building and neighboring commercial
buildings. The retail building incorporates the use of an arcade along the
storefronts, barrel tile roofs at the end caps, decorative columns, cornice and score
lines. As noted, the front fac;ade would be enhanced with an arcade, columns, and
two (2) hip roofs at each end of the building, at a height of 30 feet. The elevations
show that the hip roof red clay spanish tile roofs would reflect a terra-cotta color.
According to the "exterior finish color schedule" shown on sheet A5.0, the main
body color of the retail building would be a light beige: "Chapelle Tint" (MAB
98547-PG), The secondary wall color is proposed as a slightly darker beige:
"Vizcoino Desert" (MAB 98591-0). The accent color of the cornice, reveals and
banding, as well as the storefront frames would be white: "Classic White" (MAB
041-150). The side elevations (east and west) and also the rear elevation are
depicted with canvas awnings over the doors and windows. These arched awnings
are proposed as a black sunbrella material..
The Commerce Bank building utilizes many of the same design features as the
retail building, including colors, identical columns, scoring and reveals, same roof
tile and window frame colors and cornice work.

Signage:
The elevation page (sheet A300) shows the proposed location of the wall sign for
the Commerce Bank building. The sign would be channel letters and located over
the bank's entrance, The sign would be 32 square feet in size, with the Commerce
Bank script in black and the "C" logo in red. A monument sign is proposed at the
southeast corner of the site, visible from both Boynton Beach Boulevard and
Winchester Park Boulevard. The sign would be approximately six (6) feet in height
and six (6) feet in width, with the address prominently displayed at the top of the
sign. The extruded aluminum sign cabinet would be black, with a white sign face
depicting the same black lettering and red logo as the wall sign.
Sheet A5.0 depicts the typical signage for the retail building. A sign band has been
designed into the architectural details of the building, over the entrance to each of
the storefront bays. A note indicates that each tenant shall have one and one-half
(1- V2) square feet of sign area for each linear foot of building frontage. A sign
detail on the same sheet indicates that the signs are designed as reverse channel
letters, with the individual letters not exceeding 12 inches in height. These letters
are proposed to be "Mediterranean Blue" in color. The proposed signage area
would comply with the maximum allowable wall signage area permitted by the
Land Development Regulations. This would be consistent with Chapter 9, Section
10.1. of the Land Development Regulations.
RECOMMENDATION:
The Technical Application Review Team (TART) has reviewed this request for new site plan approval and
recommends approval contingent upon satisfying all comments indicated in Exhibit "C" - Conditions of
Approval, Any additional conditions recommended by the Board or City Commission shall be documented
accordingly in the Conditions of Approval.

2. Please provide a time line that clearly illustrates when water and sewer
services will be required to serve the proposed project. Your starting date
for the time line should be the date of City Commission approval. Also
provide milestone dates for permit application, the start of construction, and
the setting of the first water meter. This timeline will be used to determine
the adequacy of water and wastewater treatment capacity for your project
upon the project's completion, so please be as accurate as possible.
3. Palm Beach County Health Department permits will be required for the
water and sewer systems serving this project (CODE, Section 26-12).
4. Fire flow calculations will be required at the time of permitting
demonstrating the City Code requirement of 1,500 g.p.m. (500 g.p.m. some
residential developments) with 20 p.s.i. residual pressure as stated in the
LDR, Chapter 6, Article IV, Section 16, or the requirement imposed by
insurance underwriters, whichever is greater (CODE, Section 26-l6(b)).
5. The CODE, Section 26-34(E) requires that a capacity reservation fee be
paid for this project either upon the request for the Department's signature
on the Health Department application forms or within seven (7) days of site
plan approval, whichever occurs first. This fee will be determined based
upon final meter size, or expected demand.

6. This office will not require surety for installation of the water and sewer
utilities, on condition that the systems be fully completed, and given to the
City Utilities Department before the first permanent meter is set. Note that
setting of a permanent water meter is a prerequisite to obtaining the
Certificate of Occupancy.
7. A building permit for this project shall not be issued until this Department
has approved the plans for the water and/or sewer improvements required to
service this project, in accordance with the CODE, Section 26-15.
8. Utility construction details will not be reviewed for construction
acceptability at this time. All utility construction details shall be in
accordance with the Utilities Department's "Utilities Engineering Design
Handbook and Construction Standards" manual (including any updates)
and will be reviewed at the time of construction permit application.
FIRE

9. Because the retail building will be in excess of 12,500 square feet, an
approved NFP A 13 Fire Sprinkler system will be required. This system
shall be monitored by an approved central station and receive a Letter of
Certification from U.L. or a placard from Factory Mutual.
10. Provide hydraulic calculations for this site that include water for both the
fire sprinkler system and the fire hydrants. At least one new hydrant will be
required for this project. No portion of the building shall be further away
than 200 feet from a hydrant.

are signed and sealed by a design professional registered in the state of
Florida shall be submitted for review at the time of permit application.
18. At time of permit review, submit signed and sealed working drawings ofthe

19. CBBCPP 3.C.3.4 requires the conservation of potable water. City water may
not, therefore, be used for landscape irrigation where other sources are
readily available.
20. A water-use permit from SFWMD is required for an irrigation system that
utilizes water from a well or body of water as its source. A copy of the
permit shall be submitted at the time of permit application, F.S. 373.216.

25. The applicant should show an elevation cross-section detail of the actual
heights of the proposed landscape trees and vegetation at the time of
planting to (proper scale) visually buffer the proposed buildings and parking
lot from the Boynton Beach Boulevard and Winchester Boulevard road
rights-of-ways. The cross-sections and plant specifications should be
amended to reflect the appropriate size plant material necessary to
adequately screen the parked cars.

minimum of two (2) colorful shrub species, which will function as a

29. Please provide a detail of the typical freestanding outdoor lighting fixture,
including the overall height, exterior finish and color(s). The design, style,
and illumination level shall be compatible with the building design (height)
and shall consider safety, function, and aesthetic value (Chapter 9, Section
10.F.1.).
30. The decorative wall tiles previously depicted on the front and sides of the
retail building should be restored on the approved plan and carried through
onto the rear of the building, in the space between the reveal and the parapet
banding, in order to fill in the blank wall space.
31. Understand that should the properties be divided and sold at some point in
the future, appropriate setbacks, landscape buffers, parking counts and other
site issues must be taken into consideration.
32. Cross-access, cross-parking, drainage, and utility easements need to be
considered in any property transactions that could separate the bank parcel
from the retail building.
33. The applicant is responsible for compliance with Ordinance 05-060, the

likely to be generated it does seem that some sort of trash storage for pickup
will be needed for this site. Please address how this will be handled, roll-
out cart(s) being the logical alternative.

dumpster enclosure exists for the retail building.

1st Review Planning
An approval letter from Palm Beach County Traffic Division for traffic concurrency shall
be required prior to issuance of the first permit (Chapter 4, Section 8.F.).
Include a color rendering of all four (4) elevations at the Technical Review Committee meeting
(Chapter 4, Section 7.D.).
Provide paint swatches including manufacture, paint name and color number for the elevations of
all buildings (Chapter 4, Section 7.D.).
The elevation pages shall indicate the exterior finish, paint manufacturer's name, and color codes.
Staffrecommends using a color schedule (Chapter 4, Section 7.D.).
The landscape buffers along the rights-of-way must be a minimum of 7 feet in width and contain
a combination of colorful groundcover plants and a minimum of two (2) colorful shrub species,
which will function as a continuous hedge (Chapter 7.5, Article II, Section S.D.). Please correct
plans reflecting 5 feet.
One (1) tree is required for every 30 linear feet along rights-of-way, parking areas and drive
aisles/circulation drives (Chapter 7.5, Article II, Section S.D.).
Each landscaped island shall contain a minimum of 25 square feet of landscape area, including
one (1) tree having a clear trunk of at least five (5) feet (Chapter 7.5, Article II, Section 5.G.).
Staff recommends ultimately decreasing the width of the retention area, widening the interior
landscaped islands so that they contain both the tree and the walkway that leads to the sidewalk,
and inserting an additional interior landscaped island in rows of parking that contain more than 10
uninterrupted spaces.
A signature tree (such as a Yellow Elder, Tibouchina Granulsola, or Bouganvillea) is required at
both sides of each project entrance / exit. The signature trees must have 6 feet of clear trunk if
placed within the safe-sight triangle (Chapter 7.5, Article II, Section 5.N.). Alternative plant
material may be substituted if the above referenced plant material is not available or undesired.
Any substitution of plant material (for the signature tree requirement) will be subject to the City
Landscaper / Environmentalist review and approval.
All trees are required to be at least 12 feet overall height and three (3) caliper inches at the time of
installation (Chapter 7.5, Article II, Section 5.C.2.). This impacts the Crape Myrtle trees shown
on the landscape plan (sheet LA-I) tabular data.
All shrubs and hedges are required to be at minimum 24 inches in height, 24 inches in spread, and
planted with tip-to-tip spacing measured immediately after planting to adequately cover the
planted areas on the site (Chapter 7.5, Article II, Section 5.C.4.).
Fifty percent (50%) of all site landscape materials must be native species (Chapter 7.5, Article II,
Section 5.P). On the landscape plan plant list (sheet LA-I), indicate by asterisk, the native
species to ensure that at least 50% of landscape material is native. Separate and indicate the
proposed plant material into the following categories: Shade Trees, Palm Trees, Shrubs / Hedges,
and Groundcover. Please tabulate the amount of native material in each plant category.
Place a note on the landscape plan that all above ground mechanical equipment such as exterior
utility boxes, meters, transformers, and back-flow preventers shall be visually screened (Chapter
9, Section lO.C.4.).
Sheet LA-l indicates a planting prohibition in the visibility triangles of plant material between
30" and 6 ' in height. The code requires up to 8'. Please correct.
The Landscape plan (LA-I) and Site Plan (C-3) do not match relative to landscape islands,
planter areas in front of the covered walkway, building location and loading area. Please correct.
Sheet LA-I, under the heading Landscape Calculations, the noted interior landscaping square
footage indicates TBD (to be determined). Please calculate and provide appropriate figure.
Staff recommends the use of landscape material other than Crape Myrtle, due to its tendency to
be bare during certain months.
Additional landscaping/greater height of landscape material should be utilized along the north
landscape buffer to minimize the view of the drive-through operation.
The base of the monument signs should be totally surrounded and enhanced with colorful
groundcover and a minimum of two (2) colorful shrub species.
Please provide a detail of the typical freestanding outdoor lighting fixture, including the overall
height, exterior finish and color(s). The design, style, and illumination level shall be compatible
with the building design (height) and shall consider safety, function, and aesthetic value (Chapter
9, Section 10.F.1.).
A Photometric Plan should be submitted, depicting compliance with City Codes and ensuring no
light spillover onto adjacent properties.
The dumpster enclosure shall resemble with respect to the color and materials, the design of the
principal buildings and shall be integrated with other site elements (Chapter 9, Section lO.E.3.).
On the site plan, place a note indicating this requirement. Provide a detail of the dumpster
enclosure
All signage is subject to review and approval of the Planning & Development Board and City
Commission. No detail of the monument sign proposed for the Boynton Beach Boulevard
entrance has been provide. Please provide a detail of the sign area, including the dimensions,
exterior finish, and letter color(s) (Chapter 4, Section 7.D.).
Please provide, in tabular form, a breakdown of sign calculations for all signage for the entire
site, depicting the code requirement and that being proposed, indicating compliance with all code
requirements.
The three-sided monument sign for the bank is not permitted; it may have no more than two
faces.
All monument signs shall clearly indicate the project street address at the top of the sign.
Neon tubing outlining the decorative molding around parapet of building is not allowed. If the
applicant would want to use accent lighting such as up lighting, sconces or other forms to
highlight architectural features, staff will consider it. The applicant may wish to look at some of
the accent lighting utilized on the buildings within Boynton Commons to the east, as a way of
emphasizing compatibility with surrounding developments.
Non-word depictions on signs shall be limited to 20% of the area of the sign. Additionally, non-
word depictions (ie.logos) may not be independent of verbiage on walls or signs. Please correct.
What is the area along the north/rear elevation on Sheet A-300 with the wording "illumination
sign box by others", and what function does it serve? What type of signage would be
contemplated?
Directional signs are limited to four (4) square feet and a total of four (4) per site, located at
points of ingress/egress. Their location needs to be depicted on the site plan and reference to other
signs and neon that will not be used should be removed from the submittal package for clarity.
Stacking or vehicle queing at the drive-through facility for the bank would appear to stack into
the drive aisle along the east side of the bank and potentially congest the entry from and exit to
Winchester Park Boulevard. Please depict vehicle templates on the site plan to denote
stacking/queing operations and capacity.
Staff recommends additional use of architectural features between the two structures, including
the decorative tiles, window treatments, roof tile colors, building colors, stucco texture, use of
outlookers/decorative brackets, etc.
Staff recommends the use of decorative upligting on both buildings as opposed to standard
wallpacks.
It would appear as though bold stripes or banding is being applied to the covered drive-through
columns, which does not appear appropriate.
There are too many large expanses of blank wall on various elevations of the bank building. Staff
suggests utilizing architectural features from the retail building in these areas.
Please explain the smaller islands in the drive-through lanes -vs- the larger islands and the
operations conducted at each.
The decorative wall tiles depicted on the front and sides of the retail building should be carried
through onto the rear, in the space between the reveal and the parapet banding, in order to fill in
the blank wall space.
Proposed walkway connections from the sidewalks within the road rights-of-way to the walkways
in front of the bank and retail shops should be depicted crossing the parking lot drive aisles. Staff
suggests the use of pavers for the entire distance.
The bank is depicted as Phase I and the retail space as Phase II. No phase lines are indicated as to
what improvements are to be completed in which phase. Please provide phase lines, a phasing
plan indicating timing of the improvements and proposed timing for construction of Phase II.
Understand that should the properties be divided and sold along phase lines, appropriate setbacks,
landscape buffers, parking counts and other site issues must be taken into consideration.
Cross-access, cross-parking, drainage, and utility easements need to be considered many
property transactions.
At the technical advisory review team (TART) meeting, provide written responses to all staffs
comments and questions. Submit 12 sets of revised plans. Each set should be folded and stapled

The above referenced Site Plans, received on December 16, 2005, was reviewed for Public Works,
Engineering, and Utilities against the requirements outlined in the City of Boynton Beach Code of
Ordinances. Following are our comments with the appropriate Code and Land Development Regulations
(LDR) referenced.
PUBLIC WORKS - GENERAL
1. Prior to permit application contact the Public Works Department (561-742-6200) regarding the
storage and handling of refuse per the CODE, Section 10-26 (a).
2. The applicant has indicated that no refuse collection is required or necessary as documents will be
shredded and disposed off-site. The applicant however does not address "incidental" trash such as
lunch refuse and the like. While a dumpster may not be required to handle the small volume likely to
be generated it does seem that some sort of trash storage for pickup will be needed for this site.
Please address how this will be handled, roll-out cart(s) being the logical alternative.
3. The loading zone on the northwest corner of the proposed retail building overlaps the area needed
for the solid waste trucks to approach and back from the dumpster enclosure. Relocate the loading
zone further south to avoid this conflict.
4. Remove or relocate the Live Oak proposed adjacent to the dumpster enclosure to eliminate vertical
conflicts for the Solid Waste trucks.
PUBLIC WORKS - TRAFFIC
5. Provide a notice of concurrency (Traffic Performance Standards Review) from Palm Beach County
Traffic Engineering.
6. The provided traffic analysis indicates that a right-turn lane at the driveway on Boynton Beach Blvd.
will be required. The traffic study should reconsider the addition of a right-turn lane at the driveway
on Winchester Park Blvd. Queuing and stacking for the drive-through lanes that may cause backing
onto Winchester Park Blvd. should also be addressed in the traffic study.
7. Revise all plans to show the required right-turn lane on Boynton Beach Blvd. into the site.

8. On the Site and Civil plans, show and identify all necessary traffic control devices such as stop bars,
stop signs, double yellow lane separators striping, directional arrows and "Do Not Enter" signage, etc.
See City Standard Drawings "K" Series for striping details.
9. Add painted "STOP" messages on the pavement at each of the stop bars leaving the drive-through
lanes for the bank.

ENGINEERING
11. Add a general note to the Site Plan that all plans submitted for specific permits shall meet the City's
Code requirements at time of application. These permits include, but are not limited to, the following:
paving, drainage, curbing, site lighting, landscaping and irrigation. Permits required from other
permitting agencies such as Florida Department of Transportation (FOOT), South Florida Water
Management District (SFWMD), Lake Worth Drainage District (LWDD), Florida Department of
Environmental Protection (FDEP), Palm Beach County Health Department (PBCHD), Palm Beach
County Engineering Department (PBCED), Palm Beach County Department of Environmental
Resource Management (PBCDERM) and any others, shall be included with the permit request.
12. All comments requiring changes and/or corrections to the plans shall be reflected on all appropriate
sheets.
13. Please note that changes or revisions to these plans may generate additional comments.
Acceptance of these plans during the Technical Advisory Review Team (TART) process does not
ensure that additional comments may not be generated by the Commission and at permit review.
14. Provide a photometric plan so that lighting levels can be evaluated against the LOR requirements.
15. Show sight triangles on the Landscape plans (LOR, Chapter 7.5, Article II, Section 5.H.) Reference
FOOT Standard Index 546 for the sight triangles on Boynton Beach Blvd. and City Standard P-14 for
the sight triangles on Winchester Park Blvd.
16. Indicate, by note on the Landscape Plan, that within the sight triangles there shall be an unobstructed
cross-visibility at a level between 2.5-ft. and a-ft. above the pavement (LOR, Chapter 7.5, Article II,
Section 5.H.)
17. The medians on Boynton Beach Blvd. have existing irrigation and plant material belonging to the City
of Boynton Beach. Any damage to the irrigation system and/or plant material as a result of the
contractor's operations shall be repaired or replaced to the equivalent or better grade, as approved
by the City of Boynton Beach, and shall be the sole responsibility of the developer. The contractor
shall notify and coordinate with the City of Boynton Beach Forestry & Grounds Division of Public
Works a minimum of six (6) weeks in advance of any underground activities. Please acknowledge
this notice in your comments response and add a note to the appropriate plan sheets with the above
stated information.
18. Only 2.5-ft. has been allowed to place landscaping along the north property line. A minimum of 10-ft.
should be provided to allow sufficient room for the proposed canopy trees to mature. The following

three comments assume that the plans have been revised to provide additional space for planting
along the north property line.
19. Canopy trees should be placed a minimum of 10-ft. inside property lines to allow for maintenance as
the trees mature.
20. Palm trees should be placed a minimum of 5-ft. inside property lines to allow for maintenance as they
mature.
21. The Live Oaks proposed along the north property line will present a vertical conflict with high profile
vehicles. Staff strongly recommends use of a different Live Oak cultivar, such as Cathedral or High-
Rise to minimize the potential for vertical conflicts with high-profile vehicles. Alternately use of a
palm species should be considered in this space.
22. Note 12, Sheet C-3, states that Kimley-Horn is making assumptions about the ultimate drainage
outfall. The City sincerely hopes that the Engineer of Record is not guessing about how his drainage
design will work.
23. Full drainage plans, including drainage calculations, in accordance with the LDR, Chapter 6, Article
IV, Section 5 will be required at the time of permitting.
24. Paving, Drainage and Site details will not be reviewed for construction acceptability at this time. All
engineering construction details shall be in accordance with the applicable City of Boynton Beach
Standard Drawings and the "Engineering Design Handbook and Construction Standards" and
will be reviewed at the time of construction permit application.
UTILITIES
25. Please provide a timeline that clearly illustrates when water and sewer services will be required to
serve the proposed project. Your starting date for the timeline should be the date of City Commission
approval. Also provide milestone dates for permit application, the start of construction, and the setting
of the first water meter. This timeline will be used to determine the adequacy of water and
wastewater treatment capacity for your project upon the project's completion, so please be as
accurate as possible.
26. No utility plan was included with this submittal, therefore this plan is considered incomplete as
submitted. However, the proposed Site Plan is an existing site located within the Utilities' service
area, is located where utility support is available, and has a utility plan which has previously been
reviewed and permitted for this site. We are providing only a cursory review of the proposed site plan
as submitted at this time. Additional comments may be required after a utility plan has been
submitted.
27. All utility easements and utility lines shall be shown on the site plan and landscape plans (as well as
the Water & Sewer Plan when submitted) so that we may determine which appurtenances, trees or
shrubbery may interfere with utilities. In general, palm trees will be the only tree species allowed
within utility easements. Canopy trees may be planted outside of the easement so that roots and
branches will not impact those utilities within the easement in the foreseeable future. The LDR,

Chapter 7.5, Article I, Section 18.1 gives public utilities the authority to remove any trees that
interfere with utility services, either in utility easements or public rights-of-way.
28. Palm Beach County Health Department permits will be required for the water and sewer systems
serving this project (CODE, Section 26-12).
29. Fire flow calculations will be required demonstrating the City Code requirement of 1,500 g.p.m. (500
g.p.m. some residential developments) with 20 p.s.i. residual pressure as stated in the LOR, Chapter
6, Article IV, Section 16, or the requirement imposed by insurance underwriters, whichever is greater
(CODE, Section 26-16(b)).
30. The LOR, Chapter 6, Article IV, Section 16 requires that all points on each building will be within 200
feet of an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition,
by showing all hydrants.
31. The CODE, Section 26-34(E) requires that a capacity reservation fee be paid for this project either
upon the request for the Department's signature on the Health Department application forms or within
seven (7) days of site plan approval, whichever occurs first. This fee will be determined based upon
final meter size, or expected demand.
32. Comprehensive Plan Policy 3.C.3.4. requires the conservation of potable water. As other sources
are readily available City water shall not be allowed for irrigation.
33. Water and sewer lines to be owned and operated by the City shall be included within utility
easements. Please show all proposed easements on the engineering drawings, using a minimum
width of 12 feet. The easements shall be dedicated via separate instrument to the City as stated in
CODE Sec. 26-33(a). For the applicant's information, there is an existing 12-in./15-in. VCP sewer
across the front of the property (along Boynton Beach Boulevard), an 8-in. water main and a 16-in.
force main, none of which are shown on their site plan. More than one of these utility mains will
affect their proposed landscaping plan on both roadways adjacent to the property.
34. This office will not require surety for installation of the water and sewer utilities, on condition that the
systems be fully completed, and given to the City Utilities Department before the first permanent
meter is set. Note that setting of a permanent water meter is a prerequisite to obtaining the
Certificate of Occupancy.
35. A building permit for this project shall not be issued until this Department has approved the plans for
the water and/or sewer improvements required to service this project, in accordance with the CODE,
Section 26-15.
36. PVC material not permitted on the City's water system. All lines shall be DIP.
37. Appropriate backflow preventer(s) will be required on the domestic water service to the building, and
the fire sprinkler line if there is one, in accordance with the CODE, Section 26-207.
38. The LOR, Chapter 3, Article IV, Section 3(0) requires Master Plans to show all utilities on or adjacent
to the proposed tract. The plan must therefore show the point of service for water and sewer, and
the proposed off-site utilities construction needed in order to service this project.

39. The LOR, Chapter 3, Article IV, Section 3(P) requires a statement be included that utilities are
available and will be provided by all other appropriate agencies. This statement is lacking on the
submitted plans.
40. Utility construction details will not be reviewed for construction acceptability at this time. All utility
construction details shall be in accordance with the Utilities Department's "Utilities Engineering
Design Handbook and Construction Standards" manual (including any updates) and will be
reviewed at the time of construction permit application.

9 CBBCPP 3.C.3.4 requires the conservation of potable water. City water may not, therefore,
be used for landscape irrigation where other sources are readily available.
10 A water-use permit from SFWMD is required for an irrigation system that utilizes water from
a well or body of water as its source. A copy of the permit shall be submitted at the time of
permit application, F.S. 373.216.
11 If capital facility fees (water and sewer) are paid in advance to the City of Boynton Beach
Utilities Department, the following information shall be provided at the time of building
permit application:
A The full name of the project as it appears on the Development Order and the
Commission-approved site plan.
B If the project is a multi-family project, the building number/s must be provided. The
building numbers must be the same as noted on the Commission-approved site plans.
C The number of dwelling units in each building.
D The number of bedrooms in each dwelling unit.
E The total amount paid and itemized into how much is for water and how much is for
sewer.

12 At time of permit review, submit separate surveys of each lot, parcel, or tract. For purposes
of setting up property and ownership in the City computer, provide a copy of the recorded
deed for each lot, parcel, or tract. The recorded deed shall be submitted at time of permit
review.
13 Add a general note to the site plan that all plans submitted for permitting shall meet the
City's codes and the applicable building codes in effect at the time of permit application.
14 Pursuant to approval by the City Commission and all other outside agencies, the plans for
this project must be submitted to the Building Division for review at the time of permit
application submittal. The plans must incorporate all the conditions of approval as listed in
the development order and approved by the City Commission.
15 The full address of the project shall be submitted with the construction documents at the
time of permit application submittal. If the project is multi-family, then all addresses for the
particular building type shall be submitted. The name of the project as it appears on the
Development Order must be noted on the building permit application at the time of
application submittal.
16 Show the proposed site lighting on the site and landscape plans. (LRD, Chapter 4, Section
7.B.4) If possible, provide photo metrics as part of your TART plan submittals.
17 I ndicate on the site plan the number of parking spaces provided for the bank. The required

tabular data should show the individual species oftrees proposed to be preserved in place, relocated or

CAPACITY: 17,900 square feet on a 104,000sqft lot.
COMMENTS
1. Provide Emergency Vehicle access lane to this building.
2. Because this building (#1) will be in excess of 30' in height an
approved NFPA 13 Fire Sprinkler system will be required. This
system shall be monitored by an approved central station and
receive a Letter of Certification from U.L. or a placard from Factory
Mutual.
3. Roads and gate access during and after construction shall be 20 feet
wide if two way and 12 feet wide if one-way.
4. Provide hydraulic calculations for this site that include water for both
the fire sprinkler system and the fire hydrants. At least one new
hydrant will be required for this project. No portion of the building
shall be further away than 200 feet from a hydrant.
5. Show the location of the fire hydrants for this project.
6. Any construction gates shall be fitted with either a Knox Lock or a
Knox Box with an entrance key, for emergency access.
7. All roads shall be compacted to 32 tons and maintained so that
emergency vehicles can access all areas of the site under
construction at all times. The responsibility for any emergency
vehicles that become stuck because of poor roads will fall to the
owner of the property of the general contractor to have it towed by
an authorized towing agency.
