On June 7, 2007 a site improvement permit, No. 06-7180, was
issued by the Boynton Beach Building Division for Las Ventanas.
The issuance of this building permit, which requires compliance
with all of the Conditions of Approval of the original site plan
(Site Plan NWSP 05-021) I stops the clock from running on the site
plan expiration. Therefore, the approved site plan is no longer
subject to CRA or City Commission review, unless the applicant
requests major modifications to the approved site plan.

Describe in general terms the proposed project, system, or activity.
The existing site currently consists of a lumber yard, offices, and single family homes. Storm
water runoff flows with the topography falling from west near the Florida East Coast Railroad
R.O.W. to the east towards U.S. Highway 1 (Federal Highway).
The proposed project consists of a mixed-use residential and commereial development. Included
in the development are two 5 story residential towers with connecting parking garages,
townhouses, two 1 story resident community clubs, one 3 story building containing retail on
the first floor and residential units on the second and third floor, and a two level parking
garage.
If there have been any pre-application meetings, including at the project site, with regulatory

On May 25 2005 representatives from Kimley-Horn and Associates, Inc.. James Vitter and Ben

A minimum turning radius of 60 feet is required for the
approach to the dumpster. Provide a minimum backing
clearance of 60 feet. (measured from the front edge of the
dumpster pad.) (LDR, Chapter 2, Section IIJ2.b.).

Provide a notice of concurrency (Traffic Performance

Provide detailed off-site improvement plans, acceptable
to the City, for Woolbright Road, including proposed
signalization and striping. The off-site improvement
plans shall also include the following: extend the median
west of the railroad crossing (Woolbright Road)
terminating west of Southeast 1st Street, extend the
median east of the railroad crossing (Woolbright Road)
terminating east of the currently signalized intersection
entering Sunshine Square. Right-in / right-out
movements only will be allowed for southbound
Southeast rt Avenue, northbound exiting Sunshine
Square and southbound exitingfrom the west
development service drive.
Detailed off-site improvement plans will be submitted
at a later date.
The developer shall provide a surety in the amount of
110% of the engineer's estimate for the cost of this work.
Construction of the required improvements shall be
completed pending outside agency approvals and prior
to issuance of the final Certificate of Occupancy for the
project as required by the Amendments to the Building
Code. In the event outside agency approvals are not
granted the surety shall be returned to the Development
and an alternate off-site plan depicting site access
conditions shall be submitted for both the City and
County approval.

COMMENT 6: Full drainage plans, including drainage calculations, in
accordance with the LDR, Chapter 6, Article IV,
Section 5 will be required at the time of permitting.

UTILITIES
COMMENT 8: All utility easements and utility lines shall be shown on the
Site Plan and Landscape Plans (as well as the Water and
Sewer Plans) so that we may determine which
appurtenances, trees or shrubbery may interfere with
utilities. In general, palm trees will be the only tree
species allowed within utility casements. Canopy trees
may be planted outside of the easement so that roots and
branches will not impact those utilities within the
easement in the foreseeable future. The LDR, Chapter 7.5,
Article 1, Section 18.1 gives public utilities the authority to
remove any trees that inteifere with utility services, either in
utility easements or public rights-off-way.
RESPONSE 8: The utility easements are shown on the site plan. They
will also be shown on the landscape plan, which will be
submitted at a later date.
COMMENT 9: Palm Beach County Health Department permits will be
required for the water and sewer systems serving this
project (CODE. Section 26-12).

COMMENT 10: Fire flow calculations will be required demonstrating the
City Code requirement of 1,500 g.p.m. (500 g.p.m.. some
residential developments) with 20 p.s.i. residual pressure
as stated in the LDR, Chapter 6, Article IV, Section 16, or
the requirement imposed by insurance underwriters,
whichever is greater (CODE, Section 26-16(b)).
RESPONSE 10: Fire flow calculations are completed and will be sent
under separate cover.
COMMENT 11: The CODE. Section 26-34(E) requires that a capacity
reservation fee be paid for this project either upon the
request for the Departments signature on the Health
Department application forms or within seven (7) days of
Site Plan approval. whichever occurs first. This fee will be
determined based upon final meter size. or expected
demand.

capacity reservation fee application will be submitted at
a later date.
COMMENT 12: Comprehensive Plan Policy 3.C.3.4. requires the
conservation of potable water. As other sources are readily
available City water shall not be allowed for irrigation.

COMMENT 13: Water and sewer lines to be owned and operated by the City
shall be included within utility easements. Please show all
proposed easements on the engineering drawings, using a
minimum width of 12 feet. The easements shall be dedicated
via separate instrument to the City as stated in CODE See,
26-33(a).
RESPONSE 13: All proposed utility easements are shown on the plans
included in this submittal.
COMMENT 14: This office will not require surety for installation of the
water and sewer utilities, on condition that the systems be
fully completed, and given to the City Utilities
Department before the first permanent meter is set. Note
that setting of a permanent water meter is a prerequisite
to obtaining the Certificate f Occupancy.

COMMENT 15: A building permit for this project shall not be issued until
this Department has approved the plans for the water
and/or sewer improvements required to service this
project, in accordance with the CODE, Section 26-15.

the Utilities Department and included on the submitted
plans.
COMMENT 18: 8-inch water mains proposed within the development and
connecting to 6-inch lines, in Woolbright Rd. and Federal
Hwy., and SE 12th Ave., are insufficient to provide 1,500
g.p.m. with 20 p.s.i. residual pressure as required by CODE.
External improvements will be required. In order to
accomplish this, a Hardy-Cross analysis will be required of
this region of the city to determine the extent of external
requirements.
RESPONSE 18: A fire flow analysis using WaterCad has been included
with this submittal. A soft dig investigation will be
performed at a later date to determine the size of the
existing lines. If it is determined that off-site utility
improvements are required, plans will be produced and
submitted accordingly.
COMMENT 19: A public lift station will not be permitted on this project. If
no alternative to using a lift station is found a private lift
station may be allowed. Additional information regarding
finish floor elevations and site elevations is needed for staff
to make an adequate analysis of the proposal.
RESPONSE 19: No alternative to a lift station is available. A private lift
station is proposed. The additional finish floor and site
elevation information is shown in the plans included in
this submittal.

construction acceptability at this time. All utility
construction details shall be in accordance with the Utilities
Departments "Utilities Engineering Design Handbook and
Construction Standards" manual (including any updates);
they will be reviewed at the time of construction permit

less than five (5) feet in height. Gable and hip roof heights
shall be measured to the midpoint between the eaves and the
ridge. At the time of permitting, on all elevation pages,
indicate the proposed building heights as defined by the
aforementioned code.
RESPONSE 61: The site plan has been revised to reflect the defined height.
The requested information will be inclnded in the

COMMENT 62: At the time of permitting and contingent upon the successful
abandonment of a portion of Alden Street, the site plan
tabular data should reflect the correct parcel size of 635,417
square feet or 14.58 acres.
RESPONSE 62: The correct parcel size is actually 643,010 square feet or
14.76 acres, which is reflected in the revised tabular data.
COMMENT 63: The Mixed Use-Low zoning district requires 20% pervious
surface for mixed use developments. The plan provides a
total of 18. 8% pervious swface. An extra 1.2% of pervious
surface shall be provided prior to the issuance of and
building permits.
RESONSE 63: The pervious area provided is now 22.2%.
COMMENT 64: All elevation pages shall indicate the exterior finishes, roof
material, paint manufacturer's name, and color codes. Staff
recommends using a color schedule (Chapter 4, Section
7.D).). On sheet A4.08, correctly label the direction (i.e.
north, south, east, or west elevations) of each building
elevation. Provide elevations of the south facade of the
dumpster service yard proposed along Woolbright Road.
Provide west elevation of the parking structure in great
detail, to fully depict what the eastbound motorist on
Woolbright would see as their first impression of the project.
A scaled drawing should depict the landscaping along this
elevation at proposed spacing and height.

COMMENT 65: The smallest sized loft unit is shown to be 712 square feet
(under Ale). The MU-L zoning district requires a unit size
of 750 square feet and therefore, these units do not comply

Section 2.B.3.). A landscape barrier is a near solid element
intended to block all direct and reasonable views to parked
vehicles. The landscape barrier shall be consisting of shade
and palm trees that when planted, is tip-to-tip spacing in
order to achieve a continuous visual screen. Also, staff
recommends installing additional palm trees at tip-to-tip
spacing around each side of this mixed-use parking garage.

COMMENT 67: Landscaping at each project entrance shall contain a
combination of coloiful groundcover plants and a minimum
of two (2) coloiful shrub species on both sides of the
entrance (if sufficient space is provided. Chapter 7.5, Article
IL Section 5.N). Revise landscape plans so that they comply
with the above referenced code.

COMMENT 68: All proposed wall signage is subject to the Community
Redevelopment Agency Board and City Commission review
and approval. Staff recommends creating a master sign
program that shows the number, location, dimensions,
exterior finish. and color(s) of all signs (Chapter 2, Section
5.H9.). The sign program would address all types of signs,
including commercial wall signs, identification signs,
residential subdivision signs, freestanding monument signs,
canopy signs, way-finding signs, directional signs, and all
other signs as regulated by Chapter 21 of the Land
Development Regulations. Also, the awning size, materials,
and color(s) should be included within the sign program as
well.

COMMENT 70: The subject site is located along Palm Tran Bus Route 1. A
bus stop should be shown on the site plan (sheet C-l), in
particular, along Federal Highway. Staff recommends that
the stop be placed at least 300 feet away from the
intersection of Federal Highway and Woolbright Road. Staff
also recommends that it be a substantial and attractive bus
stop, possibly constructed within the build to area of the
subject property. Coordination with Palm Tran is
recommended.

approximately 300 feet north of the Woolbright Road
intersection.
COMMENT 71: Staff recommends installing additional groundcover plants
at the base of each tree within the bulb-outs of the interior
street system. Also, staff recommends installing additional
trees (i.e. combination of Wash ingtonia and Travelers palm
trees) and Phillidendron selloum plants along the south
facade of the South Tower and the east facades of both
towers. The trees should be of substantial size
(approximately one-half of the height of the structure) at the
time of their installation to help soften the impact of the 63-
foot tall residential towers.

a greater palette of shrub material, especially those with

acres Lumber Yard, for which trip generation rates for "Light
Industrial" uses had been adequately applied. Provide
justification on why the uses are now being presented as a
separate "General Office" and "Warehouse Uses". Application of
general office and warehouse rates are usually justified if used for
separate business operations. In case of the same business
operation, and use of general office and warehouse rates, a much
higher rate of "Internalization" must be applied.

. Provide justification on why the existing traffic signal serving the
shopping center across the site on the south side of Woolbright
Road should be relocated to accommodate this project's
development plan. The logical approach seems to be revision of
the project site plan to utilize the existing signal on Woolbright
Road, especially considering the high number of peak hour left-
turns in and out of the project. In case of physical obstacles
limiting utilization of the eastern driveway on Woolbright Road as
the main project driveway, explain the impacts of relocating the
existing traffic signal, at the shopping center on the south side.
. Project traffic assignment on Federal Highway seems to be low.
We foresee a need for an exclusive southbound right-turn lane
along Federal Highway, onto the proposed project access
driveway.

Attached is a revised traffic statement for the Gulf Stream Lumber site, located
within the City of Boynton Beach Transportation Concurrency Exception Area.
Based upon verbal comments that you have provided, we obtained notarized
verification that the site has been operating within the last year and have also
attached a copy of the business license.
Furthermore, we have included a 2005 survey of the entire site and also obtained
further detail of the uses on site. The site includes one 11,493 square foot
building that functioned as an office and a total of 105,049 square feet of
building area that served warehouse functions. The vested trip generation
calculation has been revised to reflect this.
We trust that this information addresses comments that you had regarding vested

understand that Epoch Properties, as a condition of approval for its Project, is required to
relocate a traffic light on Woolbright Road further east. Ed Breese explained that the relocation
of the traffic light will align with the applicant's entrance.

I just wanted to pass on the answers to the setback questions raised at the pre-agenda meeting held Friday.
The distance between the southern portion of the west residential building and the property line is 3 1/2 feet and
approximately 26 feet to the easternmost rail. The northern portion of this residential pod is more recessed, and the
property line jogs east. Therefore the setback from the property line is 4 1/2 feet and approximately 48 feet to the
easternmost rail.
The subject project is a mixed-use project, and per the MX-L code, it is subject to a 0' setback to "other uses", as which
both the railroad ROWand the adjacent industrial uses would qualify.

We are in receipt of the comments from your review of our May 18, 2005 traffic
analysis for the Gulf Stream Lumber site. The traffic analysis has been updated
and is being transmitted with this letter for your review. We have also included
responses below to each of your comments:
Traffic Division Comments
1. Provide information on exlstiD.g uses.
The existing lumber yard use on site is documented in the revised letter
and is included in the trip generation calculations that are summarized in
Table 1.
2. The Internal capture rates between the residential and commercial
uses are too high and unjustified. Use a maximum rate of sev..
The trip generation calculations have been revised to reflect internal
capture between the uses of no more than 5%.
3. Provide a bulld~ut date.
The proposed build-out date of 201 0 is documented in the revised letter.
4. Provide a site plan to justify the proposed project driveway peak
hour traffic assignments.

Dear Mr. Breese:
Kimley-Hom and Associates, Inc. has completed a site-specific traffic evaluation
of the proposed redevelopment of the Gulf Stream Lumber site. This site is
located in the northwest quadrant of Woolbright Road and Federal Highway/US
1 in Boynton Beach, Florida, as shown in Figure 1. Currently, the site serves
as a 637,584 square foot (14.64 acres) lumber yard and it is proposed to be
redeveloped to contain a mix of residential, retail, and restaurant land uses with
a buildout date of 2010. The property is located within the Cily of Boynton
Beach Transportation Concurrency Exemption Area (TCEA); therefore, the
entire site, including the non-residential component, is exempt from the
standard transportation concurrency requirements of the Palm Beach County
Traffic Performance Standards Ordinance (TPSO). Based upon requirements
for development within a TCEA set forth in Chapter L, Section 5 of the TPSO,
the following traffic evaluation quantifies the trip generation, traffic assignment
and traffic volumes on the site access driveways.
Trip Gellel'tltioll
The daily and peak ham traffic generation for the development was based upon
trip generation rates published in the Institute of Transportation Engineers' (ITE)
Trip Generation ('J'I' Edition). The proposed development plan consists of the
following mix ofIand uses:

The internal captUre calculations were based upon rates from the ITE Trip
Generation Handbook. Pass-by rates published by Palm Beach County were used
to account for traffic already on the roadway network. The proposed development

hour trips and 308 net new PM peak hour trips when compared to the existing
development on site. Table I summarizes the daily and peak hour trips associated
with the proposed project. In addition, Table I also summarizes the trip
generation potential of the existing 14.64 area use, which has been evaluated as a
general light industrial use for the pmposes of determining the existing trip
generation potential.
Project Traffic Assignment
Based upon the net traffic generation potential, it was determined that the
maximum radius of development influence for Test I of Palm Beach County's
Traffic perfonnance Standards is two miles.
The am. and p.rn. peak hour project trips were assigned to the surrounding
roadway network in terms of a.m. and p.rn. peak hour external trips. Project
assignment was based on the characteristics of the surrounding land uses and
roadway network. Project traffic assignment and the percent impact of the project
traffic impact on each roadway link are reported in Table 2.
Driveway E'I1fllualion
Project traffic was assigned to the driveways serving the site. The proposed
driveway volumes are depicted in Figure 2. For reference purposes, a copy of the
currently proposed site plan is also attached. Following is a sutnmaIy of each of
the site driveways.
. Western driveway on Woolbri2ht Road-
This driveway aligns with the existing signal on Woolbright Road. It is
proposed to shift the signal further east to align with the eastern site
driveway and an existing driveway of the shopping center on the south
side of W ooIbright Road. This driveway would only provide service
access to the south residential tower and garage. This driveway is
proposed to be right-in/right-out only and is expected to carry only
minimal traffic volumes. Based upon standards contained in the Palm
Beach County "Guide to Parking lot and Street Access Design Criteria
and Standards", this driveway would be classified as a minor driveway.
. Eastern drivewavon W oolbri~t Road -
This driveway is proposed to align with an existing driveway to the
shopping center on the south side of Woolbright Road Full access would
be provided at this driveway and it is proposed to relocate the existing
signal to this driveway. Based upon the expected volume of traffic, this
would be classified as a major driveway according to Palm Beach County
standards. According to these standards, dual egress lanes should be
provided and the driveway throat should be a minimum of 100 feet in
length. Based upon the expected volume of traffic, an exclusive

eastbound left turn. lane should be provided on Woolbright Road at this
signalized driveway entrance.
. Driveway on U.S. 1 -
This driveway is proposed to align with the existing directional median
opening on U.S. 1. It is proposed to function as a right-in, left-in, right-
out driveway. Based upon the expected traffic volumes, it will be
classified as a major driveway. The traffic volumes warrant an exclusive
left turn. lane on U.S. 1, which is a1readyprovided at the proposed project
entrance.
. Western driveway on SE 12111 Avenue-
This driveway is proposed to provide service access to the north
residential tower and garage. Full vehicular access is proposed to be
provided. Because this driveway will only provide service a<:cess, the
traffic volumes are expected to be minimal and this is expected to
function as a minor driveway.
. Eastern driveway on SE 121h Avenue-
This driveway is proposed to provide full access for site traffic on SE 1211I
Avenue. Based upon the volume of traffic that is expected to utilize this
driveway, it is expected to be classified as a minor driveway. No
additional turn lanes are expected to be necessary based upon the site
traffic.
Conclusion
The Gulf Stream Lumber site that is proposed to be redeveloped is located within
the Boynton Beach Transportation Concurrency Exception Area. Although the
site is exempt from standard concurrency requirements, this traffic evaluation bas
been prepared to evaluate the overall trip generation assignment of traffic on
surrounding roadways and the volume of traffic at the site access points. As
documented in this letter, it is proposed to relocate the signal on Woolbright Road
to the east concurrent with development on this site.
Based upon expected site volumes, exclusive left turn lanes to serve the site
driveways are warranted at the eastern site driveway on Woolbright Road in
conjunction with the relocated signal and at the directional median opening on
U.S. 1. No other turn lanes are expected to be required based upon County
criteria.
