SITE DATA
The subject parcel is located between Federal Highway and Old Dixie Highway, just north
of Gulfstream Boulevard in the City of Boynton Beach, Florida, and contains approximately
9.99 acres. Proposed site development on the currently unimproved parcel consists of 199
multi-family dwelling units with a project build-out of2008. Site access is proposed via a
full access driveway connection to Old Dixie Highway and a directional driveway
connection to Federal Highway. For additional information concerning site location and
layout, please refer to the site plan prepared by Miller Land Planning Consultants.
PURPOSE OF STUDY
This study will analyze the proposed development's impact on the surrounding
thoroughfares within the project's radius of development influence in accordance with Palm
Beach County Land Development Code Article 12 Traffic Performance Standards.
The Traffic Performance Standards require that a proposed development meet two "tests"
with regard to traffic. Test 1, or the Link/Build-out Test, requires that no site specific
development order be issued which would, during the build-out period of the project, add
project traffic at any point on any major thoroughfare link within the project's radius of
development influence if the total traffic on that link would result in a peak hour traffic
volume that exceeds the adopted threshold level of service during the build-out period of the
project.

Test 2, or the Model Test, requires that no site specific development order be issued which
would add project traffic to any link within the project's model radius of development
influence if the total model traffic on that link would result in an average annual daily traffic
volume, as determined by the model, that exceeds the adopted level of service. For the
purposes of this analysis, the construction contemplated in the Modified 2025 Plan shall be
used.
This study will verify that the proposed development's traffic impact will meet the above
Performance Standards.
TRAFFIC GENERATION
The daily traffic to be generated by the proposed development has been calculated in
accordance with the traffic generation rates provided in Table 10.8-1 Fair Share Road
Impact Fee Schedule. The net external A.M. peak hour and P.M. peak hour traffic volumes
to be generated by the proposed development have been calculated in accordance with the
peak hour traffic generation rates provided by the ITE Trip Generation Manual, 7th Edition.
Tables 1, 2A and 2B show the daily, A.M. peak hour, and P.M. peak hour traffic generation
for the proposed development, respectively. Based on a proposed plan of development
consisting of 199 multi-family dwelling units, the traffic generation for the proposed
development may be summarized as follows:

RADIUS OF DEVELOPMENT INFLUENCE
Based on Tables 3A and 3B ofthe Palm Beach County Traffic Performance Standards, for
a net trip generation of 106 peak hour trips and 1393 daily trips, the radius of development
influence shall be two miles for Test 1 and one mile for Test 2, respectively.

the project entrances for the proposed development are shown in Tables 3A and 3B attached
with this report and may be summarized as follows:

As mentioned in the SITE DATA portion of this report, site access is proposed via a
directional driveway connection to Federal Highway and a full access driveway connection
to Old Dixie Highway. Based on the Turning Movement Worksheet attached with this
report, no additional turn lanes appear warranted.
CONCLUSION
This proposed development is expected to generate a total of 1393 net external trips per day,
90 A.M. peak hour trips and 106 P.M. peak hour trips at project build-out in 2008. The
proposed residential development qualifies for the Coastal Residential Exemption and is
therefore approvable with regard to traffic performance.

the annexations summarized below.

Upon review of the above annexations, County staff have not identified any
inconsistencies with Chapter 171, F.S., that warrant an objection. However,
Engineering staff have advised that adequate turn around should be provided for
Miller Road as part of the site planning process for the Parkside site. Please also
be advised that the County has approved the transfer of five lights in this vicinity
along Federal Highway to the City. However, FPL has yet to confirm the
completion of this transfer.
Although the City has been making significant progress towards the elimination
of enclaves in this area, a few enclaves still remain. Please feel free to contact
Lisa Amara, Principal Planner, at (561) 233-5334, to coordinate on the
annexation of enclaves less than 10 acres by interlocal agreement, or if you have
any questions.

In order to ensure efficient processing of your application, please provide the administrative information requested in RC-I A and
in RC-I W. If any of the proposed project is agricultural in nature, or if the project is in a Reduced Threshold Area (see Rule 40E-
20.302 Florida Administrative Code), water use permit applications must be processed concurrently with environmental resource
pennit applications.
SIGNATURE AND FEE
All applicants (or their authorized agents) must sign the application fonn in "Certification". Any agent must also submit, attached
to RC-IA, documentation signed by the property owner, which authorizes that agent to apply for the District permit(s) or
modification(s) for the property described in the application. No application for which a fee is required shall be considered filed
until the appropriate application fee is submitted.

GUIDANCE

Handicap Accessibility of Private Anached Garages
In Multi-family Dwelling Units
Dear Rick;
This letter is in response to your questions concerning the handicap accessibility of the
private, altached garages in the multi-family dwelling units proposed in the Gulfstream Gardens
development project. You inquir~d whether or not the garages anached to the accessible umts
are required, under the Fair Housing Act (FHA), to be accessible in terms of width and length
The regulations of the FHA do nO! require the garages to be handicap accessible.
If a multi-family dwelling unit covered by the FHA has an individual, private garag~
which is attached to and serves only that dwelling. it is not required to be handicap accessible
under the FHA. A private garage is not considered "finished living space," which is the only
space that the FHA addresses with regard to the interior of the dwelling unit. Therefore, it is not
a requirement of me FHA that a private garage be in compliance with handicap regulations.
I am enclosing a copy of the Supplement to Notice of Fair Housing Acce::>sibdity
Guidelines: Questions and Answers about the Guidelines C'Guidelines"). The Guidelines make
it clear that under Requirement 4 on page 9 that private anached garages serving only onl:
covered multi-family dwelling ar~ not finished living spaces and are not required TO be
accessible.

The FHA is consistent in its view oftbe accessibility of private, attached garages in that it
states that even the route leading from the garag~ to the dwelling unit does not have to be
accessible- See Section 2, lO(b) on page 6 of the Guidelines. Typically, a dwelling unit with a
private, attaChed garag~ has a separate entry that is considered to be the main emryway for the
dwelling unit. It is that separate. main entryWay which must be in comphance with FHA
regulations. However, the FHA is clear that the door connecting the garage to the dwelling unit,
as with all doors within the dwelling unit. would have to m~el the requirements for usabk doors.
Your willingness to assign a dedicated handicap covered. parking space TO some of the
accessible units exc~eds the requirements of the FHA We understand that the dedicated covered
parking will provide sufficient venicaJ clearance to accommodate vans and a clear path of travel
to the unit to which it is asSIgned.
In conclusion, private garages attached to a multi-family dwelling unit, arC (lot required
to be handicap accessible;: under the regulations of the Fair Housing Act.

Yes, briefly I think Christi's dates are a combination of dates for the land use submittal August 24 (November 8,
CRA and December 6 CC).
Since she wanted to bring the site plan in later (she told me Sept. 7) which she did (actually Sept 9).
Her submittal for the NWSP was midway between CRA submittal dates( on a P&D date).
I probably did tell her the site plan could go to CRA concurrent with the LUAR on November 8 but it would have to
be virtually perfect at the Oct 11 TART. (now it's getting late to even make that date).
Also told her the NWSP would have to wait for the LUAR to pass to 2nd reading, December 20, 2005.
With a wait until Dec. 20, there would be no reason for them to rush with TART.

following is our timeline for Annexation, Land Use Zoning and Site Plan:
Submission Date - August 24, 2005 for Land Use, Zoning and Annexation
September 7, 2005 for Site Plan
TAR.T. - October 11, 2005, but if Site Plan is not near perfect it will be pushed
back one month.
Planning & Development Board Mtg. - November 22,2005
City Commission - December 6, 2005
I've attempted several times to reach Mike Rose because I'll need 10 surveys signed
and sealed along with a word document with each PCN# and it's legal description but
have yet to receive anything from him. Maybe you can help here.
