Dear Mike:
Our client, New Century Companies, LLC, has been diligently working to secure a
building permit for the project known as the "Heritage Club at Boynton Beach." However, it
appears that they will not have secured a building permit prior to the expiration of the site
plan and height exception.
Thus, this i:;; our 0ffic;Cl: reqUt~st [~r an extension to the site plan and height
exception for a period of one (1) year to allow our client to secure building permits for this
project. The following is a list of accomplishments that we feel demonstrates our "good
faith" efforts:
~ Site Permit, Plat and other Engineering Permits have been submitted (see
attached engineering permit schedule);
~ Construction Documents are approximately sixty percent (60%) complete;
~ Environmental Report approved for remediation of Dry Cleaners; and
~ Capacity Reservation Fees in the amount of Thirty Thousand One Hundred
Twenty and 55/100 ($30,120.55) Dollars has been paid in full to the City of
Boynton Beach.

Enclosed please find a check in the amount of Four Hundred and 00/100 ($400.00) Dollars
made payable to the City of Boynton Beach. Please advise me whether notices to
neighboring property owners and signage are required for the extensions. Please let me

Site Plan Time Extension
Michael S. Weiner, Esquire (Agent) is requesting a one-year time extension for the
Heritage Club at Boynton Beach Site Plan Development Order (NWSP 05-014) which
was approved by the City Commission on August 2, 2005.
The site plan approval is valid for one (1) year from the date of approval. If this
request for a one (i)-year time extension were approved, the expiration date of this site
plan, including concurrency certification would be extended to August 2, 2007.
The proposed Heritage Club at Boynton Beach is a Planned Unit Development approved
for a large scale, mixed-use project containing 19,538 sq. ft. of commercial (office, retail
and restaurant) and 166 multi-family residential units.
The project has been approved for the following:
· Land Use amendment (LUAR 05-005) from Local Retail Commercial (LRC) to Special
High Density Residential (SHDR - 20 dujac) classification,
· Rezoning (LUAR 05-005) from Community Commercial (C-3) to Planned Unit
Development (PUD) zoning district,
· New Site Plan (NWSP 05-014),
· Height Exception (HTEX 05-004).
Justification states that the property owner j developer, New Century Companies LLC,
has been "diligently working to secure a building permit for the project" and lists the
following accomplishments as demonstrating their "good faith" efforts:
(1) site permit, plat, and other engineering permit applications have been
submitted;
,..
(2) construction documents are approximately sixty percent (600/0)
complete;
(3) environmental report approved for remediation of dry cleaners, and
(4) capacity reservation fees in the amount of $30,120.55 have been paid
in full to the City.
The site plan time extension is still subject to the original 71 conditions of site plan
approval, with the exception of Condition #9, regarding payment of the utilities
reservation fee. Lastly, no new land development regulations are now in place against
which the project should be reviewed and modified.
If this request for extension were approved, the expiration of this site plan, including
concurrency certification, would be extended to August 2, 2007.
If this request for site plan time extension is approved, all outstanding conditions of
approval from the original site plan must still be satisfactorily addressed during the
building permit process.
Staff recommends APPROVAL with 2 ADDITIONAL CONDITIONS: (1) still subject to 71
original conditions of site plan approval and (2) utilities reservation fee to expire
8/31/06 and require renewal (unless full capital facilities fees paid or building permits
issued by 8/31/06).
