We are in receipt of your request for an Administrative Waiver to the Engineering Design Handbook
& Construction Standards, Standard Detail K-2, dated October 12, 2006. The standard requires a
minimum aisle width (backup distance) of 22-ft, for 600 angled parking from which you wish a 4-ft,
reduction, You cite the fact that this is a private residential development with slow one-way traffic.
Please note that Standards K-1 and K-2 are designed specifically for private parking areas,
Additionally this development is a mixed use project with both residential and retail/commercial
components. Accordingly the design must consider that the general public will be using this space,
Subsequently, and in accordance with procedures established in the Engineering Design Handbook
& Construction Standards, your request is hereby denied.

This Firm is counsel to Boynton Ventures I, LLC, a Florida limited liability company (the
"Developer"), the owner of the 500 Ocean Plaza Project. Based upon the comments received
from Ken Hall to the proposed plat submitted by Shah Drotos Engineering for this project, the
Developer needs 22 ft. backup distance from the angle parking shown in the court yard of the
Project, when only 18 ft. is provided based upon the site plan, Since this is a private residential
development where there is slow one way directional traffic, we hereby request a waiver from
the City's requirement of 22 ft. back up distance allowing the 18 ft. back up distance from the
angle parking shown in the courtyard,

I have reviewed the above referenced plat and have the following comments:
1, Plat - There is no reference made to the Condominium Association responsibility for the
maintenance and liability responsibilities for the proposed sidewalks to be constructed within the
sidewalk easements along Ocean Avenue, NE 2nd Avenue and NE 4th Street.
2, Plat - There does not appear to be any easements for existing utilities, There was discussion of
some of the utilities being relocated, however the former alley that was abandoned with this
application had a BellSouth conduit located within it, which we were told could not be relocated and
was being accommodated within the approved site plan,
3, Plat - The sidewalk easements need to have a width dimension.
4, Plat - Survey Note #4 indicates no landscape planting in utility easements, Planting is allowed in
utility easements, however the types and sizes may be limited,

It brings me bll'eat pleasure to inform you that as of December 20, 2004 we have
successfully closed the Arches properties formerly owned by M.s. Christine Francois. We
at Boyntoll Ventures 1; LLC look forward to continuing our efforts in preparing our
property for the Arches development. It has been an enduring process to close on these
properties but now we have taken the necessary steps to ensure the development of the
Arches will be a defining achievement for both Boynton Ventures 1 and the City of
Boynton Beach.

Site Plan Approval

On June 3, 2003, the City Commission approved the project known as the Arches (NWSP 03-002). The site plan shows
that the project consisted of the following uses and intensities:
267 multi-family dwelling units (81 one-bedroom and 195 two-bedroom)
12,600 square feet restaurant
24,296 square feet retail (required parking was based on lease or "net" area of 20,652 square feet)
18,169 square feet office (required parking was based on lease or "net" area of 15,444 square feet)
This included a 9-story, 718 spaces parking garage. As you know, the parking was going to occur on levels\1 through 8.
The 9th story was earmarked for the apartment's recreation area. The project was going to provide 35 surface parking
spaces for a grand total of 753 provided parking spaces. The project required 750 spaces, so they were provided an
excess of 3 parking spaces.
The project also had 53 conditions of approval. One of the conditions (#40) erroneously read the following:
"Place a note on the site plan (sheet 3 of 6 prepared by Shah Orotos), that based on the parking methodology used, the
total number of seats for all restaurants shall not exceed 50 seats. Any additional seats will affect the required number of
parking spaces and may cause the project to fall below the development standard".
In the above referenced condition, the total number of restaurant seats s!'lOuld have been 315 seats rather than 50 seats.
You see, the plan provides for a total of 126 parking spaces baseg on the known square footage (for the restaurant use),
At the time or review, the applicant had not yet determined how much seating was proposed so staff had no alternative but
to base the required number of parking spaces on the square footage. Using the following parking methodology (12,600
s.f. @ 1/100), the restaurant use required 126 parking spaces. Therefore, since 126 parking spaces are required, the
maximum allowable number of seats shall be .315 (126 x 2.5 seats = 315 seats). When I drafted Condition #40, instead of
multiplying 2.5 seats to 126 spaces, I mistakenly subdivided 2.5 seats from 126 spaces).
I would double-check the attached revised d.o. letter with the numbers indicated in this email.This email is correct.

Enclosed is the City of Boynton Beach Development Order for site plan approval for a Mixed-Use
development consisting of 276 apartment units, 24,296 square feet of retail, 12,600 square feet of
restaurants, 18,169 square feet of office space, located on 3.515 acres. The City Commission approved
this site plan on June 3, 2003. Site plan approval is valid for one year from the date of final approval. In
order to maintain vested status, a building permit must be secured or an extension granted within one
year of final site plan approval.
To continue this project through the development process, please revise relevant pages of your approved
site plan to incorporate all conditions of approval as applicable. The full rectified site plan set is to be
submitted as part of your permit package to the Building Division. The person managing your permit
application should be made aware of any documents and third party letters listed in the conditions of
approval that need to be submitted with your permit package.
The Building Division is committed to speedy and efficient completion of the building permit process for
your project. However, please note that failure to meet all applicable development order conditions in
the submitted rectified plan set may produce unnecessary delays in permit insurance. Feel free to
contact any TRC member for additional clarification of comments.
Zmoortant: If you plan to introduce any changes to your approved site plan over and above those
required by conditions of approval please contact our staff before submitting a permit package to the
Building Division. All modifications to the site plan must be evaluated by our staff and processed
accordingly.

4. All utility easements shall be shown on the site plan, landscape plan, and X
water and sewer plans, In general, palm trees will be the only tree species
allowed within utility easements. Canopy trees may be planted outside the
easement to ensure that the roots and branches will not impact those utilities
within the easement in the foreseeable future. According to Chapter 7.5,
Article I, Section 18.1, the public utilities has the authority to remove any
trees that interfere with utility services, either in utility easements or public
rights-of-way,
5. Fire flow calculations will be required demonstrating the City Code X
requirement of 1,500 g.p.m, as stated in the LDR, Chapter 6, Article IV,
Section 16, or the requirement imposed by insurance underwriters, whichever
is greater (see CODE, Section 26-l6(b)).
6, The CODE, Section 26-34(E) requires that a capacity reservation fee be paid X
for this project either upon the request for the Department's signature on the
Health Department application forms or within 30 days of site plan approval,

8, Design documents shall demonstrate compliance with LDR Chapter 6, X
Section 16, which provides requirements for hydrants. In addition to
domestic requirements at a residual pressure of not less than 20 psi, a fire
flow of at least 1500 gpm is required.
9. Design documents where underground water mains and hydrants are to be X
provided, must demonstrate that they will be installed, completed, and in
service prior to construction work per the Florida Fire Prevention Code,
(2000) Section 29-2.3.2.
10. High-rise buildings shall be protected throughout by a Class I standpipe X

compliance with regulations of the code by adding specifications to the site
data that address the following issues [Section 3107.1.2, Chapter 31 of the

a) The design professional-of-record for the project shall add the
following text to the site data. "The proposed finish floor elevation
_' _ NGVD is above the highest 100-year base flood elevation
applicable to the building site, as determined by the South Florida
Water Management District's surface water management construction
development regulations."
b) From the FIRM map, identify in the site data the title of the flood zone
that the building is located within. Where applicable, specify the base
flood elevation. If there is no base flood elevation, indicate that on the
plans.
c) Identify the floor elevation that the design professional has established
for the building within the footprint of the building that is shown on
the drawings titled site plan, floor plan and paving! drainage (civil
plans).
18. On the drawing titled site plan, identify and label the symbol that represents X
the property line.
19, At time of permit review, provide a completed and executed City of Boynton X
Beach Unity of Title form. The form shall describe all lots, parcels or tracts
combined as one lot. A copy of the recorded deed with legal descriptions, of
each property that is being unified, is required to be submitted to process the
form. The property owner that is identified on each deed shall match,

abandonment is unsuccessful, modify site plan accordingly.

34. On the site plan (sheet 3 of 6 prepared by Shah Drotos), correct the required X

The number of required parking spaces shown in the above Shared Parking
Table may be subject to change due to unforeseen revisions made to the
plans during the permitting process. Also, the Table is subject to change
without Board or City Commission action if the project demands less
required parking due to decreased intensities (i.e. reduced office area,
reduced number of dwelling units). However, if the intensities further
increase and cause the project to become deficient in parking, any request to
pay a "fee in lieu" of (providing additional parking spaces) shall be subject
to the Community Redevelopment Agency and City Commission review and

This letter is to request a postponement of all matters pending before the City of Boynton
Beach Commission on The Arches at Boynton Beach, presently calendared on the
Commission Agenda for May 20, 2003
Our partner, Nancy Graham, has for family personal matters, been called out of town
and is not expected to return until after the Commission Meeting of May 20, 2003. Nancy is
essential to our presentation of the three items pending before the Commission on May 20th.
Specifically, Boynton Ventures 1 LLC has three (3) items pending before the Commission: (i)
New Site Plan, Item 03-002; (ii) Alley Abandonment, Item 03-0002; and (iii) Land Use
Amendment, Item 03-003.
We are requesting each of these items be postponed until the June 3, 2003 Commission
Meeting.

The determination of continuing public need for a street or right of way is reserved to the City Commission.
The City Commission may have an interest in the opinions of the adjacent property owners but the consent of
adjacent property owners should not be made a condition of the approval of an abandonment. It is my opinion
that imposing such a condition dilutes the Commissions' power in the abandonment process.

Kimley-Horn and Associates, Inc. has analyzed intersection volumes adjacent to
the proposed project referenced above. Per your request, the follow intersections
were analyzed:

Turning movement counts at the intersection of Federal Highway & Ocean
Avenue were supplied by the Palm Beach County Traffic Division, Turning
movement volumes at the intersections of Federal Highway and 151 A venue and
Federal Highway & 2nd A venue were collected by Kimley-Horn and Associates,
Inc. Northbound volumes on Federal Highway were not collected since they do
not affect the analysis. Volumes were adjusted to the equivalent looth highest
hour using weekly adjustment factors published by the Florida Department of
Transportation.
Existing level of service analyses were performed for weekday peak season A.M.
and P.M. peak hour conditions, The intersections were analyzed using the
signalized and unsignalized intersection methodologies from the 2000 Highway
Capacity Manual. The results of the intersection analyses are summarized in
Table 1, attached, Intersection summary sheets are attached.
Future level of service analyses were performed for weekday peak season A.M,
and P.M. peak hour conditions. Peak season turning movements were adjusted to
2005 background conditions using growth rates published by the Palm Beach
County Traffic Division. Project traffic reported in the February 2003 traffic
impact analysis was then added to develop total 2005 buildout volumes. The
intersections were analyzed using the signalized and unsignalized intersection
methodologies from the 2000 Highway Capacity Manual. The results of the
intersection analyses are summarized in Table 2, attached. Intersection summary
sheets are attached.

Dear Mr. Woodson:
The attached memo no. 02-262 from Timothy K. Large to Nancy Byrne outlines the capital
facilities charges paid to date on the Motorola site. Our records indicate only these two
payments have been made. For permit no. 82-0694, a total of $39,721.50 was paid
towards water and sewer capacity. Based upon the cost of $10001 equivalent dwelling unit
(EDU) in effect at that time, this value reflects a purchase of 39.72 EDU's. Regarding
permit no. 94-1811, filed in 1994, a total of $7299.20 was paid towards water and sewer
capacity. The cost per EDU in 1994 was $1099.00, yielding a purchase of 6.64 EDU's with
this permit.
The previous owners of the Motorola site have therefore purchased a total of 46.36 EDU's
to date. To calculate equivalent capacity, the factors are:
1 EDU for water = 312 gpd
1 EDU for sewer = 250 gpd
The net purchased capacity is therefore: water- 14,464 gpd and sewer- 11,590 gpd.
These values will be credited toward the demand of the Motorola property if the current
building is reconfigured into alternate uses. We do require that the purchased capacity
remain with the parent parcel, and not be transferred to another property, however.

The Palm Beach County Traffic Division has received and reviewed the traffic study for
the project entitled; Bovnton Beach Town .Q.enter, pursL.ant to the Traffic Performance
Standards in Article 15 of the Palm Beach Coullty Land Developmer.t Code. The prC'.I€'ct

Based on our review, the Traffic Division has the following comments:
· The Passer-by rate used for the Genera: Commerciai component of tI-Je existing
project traffic should be 43.8%>.
· According to the forecast of the future traffic the proposed project is expected to
generate 91 PM peak hour SB U-Turns on Federal Highway. This movement
can create traffic operational and safety problems, and needs to be evaluated to
introduce proper mitigation measures. As a potential solution, the County
suggests diversion of the outgoing project traffic (which ultimately travels NB on
Federal Highway) to Ocean Avenue, via 4th Street.
· The project is expected to ge.~emte significant PM peak hour ti8ff1C vo1ur;:es
(over 100 vpn) at the fol!owing locations.
