The Arches Revised extension letter
Dear Mr. Rumpf:
On June 3, 2003 a Development Order was granted by the City Commission which
granting site plan approval for Boynton Ventures 1, LLC (the "developer") for the project
commonly known as the Arches for the standard twelve (12) months.
In August/September 2003, the developer discovered that the property suffers from
serious environmental contamination, more specifically Benzene and toluene levels that are
above the maximum contaminant levels listed in Chapter 62-777 F AC of 1.0 ug/L for Benzene
and 40.0 ug/L for toluene [Exhibit A attached], which the Developer immediately brought to the
attention of the property owner (Ms. Christine Francois) as well as to the City of Boynton Beach
(the Mayor, the City Manager and the CRA Director).
Remediation of the properties contamination is the sole responsibility of the property
owner (Ms. Christine Francois) and sale of the property cannot take place until that remediation
is completed. However, the Developer made every possible attempt to assist the property owner
and her counsel to get that remediation started right away. Unfortunately, the property owner's
goals were far different (if not opposite) than the Developer's. In fact, she intentionally stalled
the process by trying to invalidate our contract. This led to a long legal battle that finally ended
in June 2004 in favor of the Developer. It was only after a court ruling in favor of Boynton
Ventures 1, LLC did Ms. Francois reopen discussions relative to the necessary remediation and
hired Ardaman and Associates to remediate all the environmental contaminates. None of these
delays were a result of the Developer's actions but rather Christine's. This created a need for the
original site plan approval to be extended and while the Developer requested a twelve month
extension at that time [which was a realistic request based on the issues that had been
discovered], the extension was granted only for six months.
In November of 2003 with full knowledge of the issues, environmental and seller, and
prior to signing any agreements, the city (CRA) and the developer mutually agreed that May

2006 was an acceptable outside date for construction on the arches to commence. This date was
set as a realistic outside target in light of the environmental issues with the property.
The clean-up of the property (a necessary precursor to any redevelopment) has finally
commenced, considerable progress has been made and continues. If not for the Developer's
efforts, this would not have happened. Ms. Francois advises that the remediation work is
expected to be completed some time within the upcoming weeks, enabling us to finally close on
the property shortly thereafter.
Since the current approvals are set to expire within the next few days, we are requesting
an additional twelve (12) month extension the approvals, this is still six (6) months prior to the
expiration of the May 2006 CRA agreements. The developer and the City of Boynton Beach
share a mutual desire to see this project completed as quickly as possible. Approving the site
plan extension will further the City's goal; to create a vibrant downtown. Without the adequate
extension of time, this project could be delayed a minimum of six months or longer or, ifmarket
conditions change, possibly indefinitely. Such action would be unnecessary and insupportable:
the developer's good faith commitment to the project has been reflected in the considerable
efforts and countless hours put forth by the developer and over 25 different professionals,
significant financial investment in the project (to date, over $1,000,000 in outside
disbursements) and in the anticipated acquisition of the property upon completion of that clean-
up.
This request is consistent with the goals and objectives of Chapter 4, Section 5 of the
City's Land Development Regulations, and we respectfully request your favorable consideration

Dear Mike:
A Development Order was granted by the City Commission on June 15,2004 which
extended the tine of site plan approval for Boynton Ventures 1, LLC and the Arches for
six (6) months from the date of the Development Order.
As you are aware Faison and Boynton Ventures 1, LLC entered into a contract for the
purchase of the Arches land are currently re-negotiating our contractual relationships
relating to the future development of this site. Faison has simultaneously put under
contract the "Katz Property" at the intersection of Ocean Avenue and 4th Street, and
Faison is currently negotiating to acquire the Leiffer parcel as well. The inclusion of
these properties has led to revisions to the currently approved site plan, which revisions
have been shared with the City, CRA and City Commissioners.
As the current approval will expire next month, we are collectively requesting an
additional twelve month extension of those approvals. We believe that a year's extension
is appropriate and authorized under the provisions of Section 5 of the Chapter 5 of the
City's Land Development Regulations. We are including a $100 check to cover the fee
for the extension request.
