Dear Ed:
Please be advised that the undersigned law firm represents Lancore Nursery, LLC, a Florida
limited liability company ("Lancore"). As you may be aware, Lancore is the contract vendee to
acquire the Property.
The City of Boynton Beach, Florida has requested the opinion of this law firm, as counsel
to Lancore, regarding the status of title with respect to the Property. In that regard, we have
examined Attorneys Title Insurance Fund title commitment no. C-7037665 ("Commitment"),
effective as of December 13,2005, at 11 :00 p.m. ("Effective Date"), and that certain ALTAI ACSM
boundary survey prepared by Keith & Schaars, P.A., project no. 17557C, signed and sealed by
Robert K. Krisak, dated January 30, 2006 ("Survey").
To the best of our knowledge (without independent investigation by this law firm) and based
upon the Commitment, we are of the opinion as follows:
1, That Ocean Roulev?ni Propf.';rties, L.L.c., a Florida lin!ited liability company, is the
fee simple title owner of the Property.
2. That the portion of the Property described graphically by the crosshatching ENhibit
"B" attached hereto is wholly included within the legal description of the Property.
3. That the real property described by the Site Plan application submitted by Ocean
Boulevard Properties, L.L.C. regarding "Casa del Lago" on behalf of Lane ore, as applicant, describes
the same parcel of real property as the Property described in the Commitment.
This opinion purports only to show the owner of record, and does not attempt to pass opinion
on the validity or sufficiency of any documents, nor have the contents of any documents been
examined for agreements, exceptions, reservations, restrictions, covenants or conditions affecting
title. Further, this opiuion does not set forth any title exceptions affecting the rn i

After reviewing the above-referenced submittal, it is apparent to staff that the issue of
ownership of the property in question remains an unresolved issue based on the following:
The LUAR application requires a copy of the last recorded warranty deed. The legal description
on the deed submitted does not include the property in question (triangular area where
recreational amenity is proposed).
The property tax map does not include the property in question as part of parcel 0010 (Lot 1,
Hull's Subdivision).
The contract for sale of the property has a legal description of the property included within the
contract. The legal description for the sales contract does not include the property in question.
The legal description on current survey submitted does not include the property in question. In
addition, the survey clearly indicates a property line between parcel 0010 and the property in
question.
The application submitted is not in compliance with the following requirements of the LUAR
application: Section II.b., II.c.(2), II.d.(I), II.d. (2), and II.f. due to the discrepancy of the legal
description and the boundaries of the proposed development plan (which includes the property in
question).
The title opinion by a firm representing the buyer is baseless, and acknowledges no independent
investigation was performed by them. The following three points are made in their title opinion:
1. That Ocean Blvd Properties LLC is the fee simple owner of the property described in
Exhibit "A". (This is not disputed by the City, as the legal description attached to the
title opinion (Exhibit "A '') does not include the property in question).
2. That the portion of the property described graphically by the crosshatching (Exhibit "B")
is wholly included within the legal description of the property. (The attachment to the
title opinion as Exhibit "B" graphicallv depicts the property in question, and this exhibit
is not part of any recorded document. However, the property in question is not indicated
anywhere on the recorded plat for Hull's Subdivision (or any other plats for this area), or
in any written legal descriptions provided. Ownership is proved by the property in
question being included in a written legal description on a recorded warranty deed, or
researched title documents provided by the property owner/seller).
3. That the real property described by the site plan application describes the same parcel of
real property as described in the Commitment. (This is not disputed by the City, as the
site plan application's legal description Exhibit "A" and the Commitment's legal
description match the legal on the deed, however none of these legal descriptions include
the property in question).
Statement of Interest in Property and Authorization to File Petitions
OCEAN BOULEVARD PROPERTIES, LLC certifies that it is the Owner of the subject
property and authorizes LANCORE NURSERY, LLC, as contract purchaser, and/or RUDEN,
McCLOSKY, SMITH, SCHUSTER & RUSSELL, P.A to act as applicant/agent and submit
petitions for land use amendment, rezoning, and site plan approval to the City of Boynton Beach.
This authorization includes all related site plan and permitting considerations, including
necessary variances or technical deviations, concurrency applications and platting requirements.
OCEAN BOULEVARD PROPERTIES, LLC understands how the proposed land use
amendment and rezoning may affect the subject property.

INTRODUCfION
Ibis Environmental, Inc. was retained by SEA Diversified Inc., to conduct a
benthic resource survey at a vacant parcel located within the Lake Worth Lagoon
Section 2, Township 45 S, Range 35 E, adjacent to Lake Drive North in Hypoluxo,.
Palm Beach, Florida. The purpose of the survey is to identify and map submerged
resources within the proposed project area. The results of our site inspection are
described herein and on the enclosed Seagrass Map.
METHODOLOGY
Ibis staff conducted a field evaluation of the site on April 28th and May 1st
2006. The boundaries of the survey were as depicted on the attached Seagrass
Map. Ibis assessed the survey area with the use of snorkeling equipment. Random
serpentine transects were swum throughout the entire survey area. Areas that
contained benthic resources were investigated in greater detail. Seagrass species
and their locations were marked and recorded.
SURVEY RESULTS
The survey was conducted during a high tide with an outgoing current on the
first field day and a low tide on the second. Water temperatures were in the mid-
seventies. Water' visibility was fair (2-3 feet). The weather on the first day of work
was partly cloudy with high winds blowing on shore out of the northeast. Weather
conditions on the second day of work were sunny with a light off shore breeze.
There was relatively little boat traffic in the survey area, with the exception of an
occasional craft entering or exiting the adjacent marina. The property is a vacant
parcel with an abandoned house located on the north peninsula of the property. A
seawall surrounds the northern portions of the property and extends southward

along the property line to an outfall pipe. At this point the shoreline is stabilized
with rip rap. The seagrass survey area also includes the shorelines and waterward
extents of the two single family homes to the south. The vegetation on the property
consists mostly of herbaceous plants typically found in disturbed areas.
Several bottom types exist throughout the survey area. The area adjacent
and to the north of the outfall pipe consists of fine sand that has created a small
beach area waterward of the bulkhead. The sand continues east from the outfall
pipe creating a shoal that is exposed at low tide. A bottom type of course sand and
shell hash continues from the shoal area to approximately 150 ft. waterward of the
shoreline, The remaining areas consisted of deeper water with more significant
current influences. The bottom type in these areas tended to be hard sand with a
fine layer of silt deposits.
As displayed on the Seagrass Map, approximately 10% of the survey area is
composed of a continuous bed 'of shoal grass (Ha/odu/e wrightiJ). Aerial coverage of
seagrass within this bed is patchy throughout the waterward limits with less than
5% coverage. The landward portions of the bed follow the contour where the
course sand bottom type begins. Seagrasses in this area have a more concentrated
distribution with some areas containing as much as 20%-30% aerial coverage.
Portions of the landward edge also contain significant amounts of Ha/ophi/a
johnsonii mixed in with the shoal grass. The northern most extent of the bed
contains small amounts of Ha/ophi/a decipiens scattered among the shoal grass.
Several small patches of seagrass were found east of the main bed. The patches
have varying composition and distribution and were not found to be connected to
any larger seagrass bed. These patches are depicted on the attached seagrass map.
The depths east of the seagrass locations were significantly deeper than the
inshore areas. Much of the waterward survey area was at depths of 6.0-8.0 ft.
during low tide. Seagrasses rarely grow at such depths in water with low visibility.
With poor water clarity, depths greater than 5.0 ft. limit light availability to the
seagrasses. The seagrass bed itself was found to be in reiativeiy heaithy condition.
Some areas of the eastern portion of the bed were found to be covered in a light
layer of silt and some were significantly covered with filamentous algae.
A significant amount of marine life was observed within the survey area.
Schools of mullet, sardines, and other bait fish were observed during both field
visits, Several sheepshead were found using piling remnants within the survey area
for refuge. Within the H. wrightiibed, staff observed several large southern
stingrays, as well as mating horseshoe crabs. Shorebirds such as killdeer, terns, and
a little blue heron utilized the exposed shoal for foraging purposes during low tide.
There were no threatened or endangered wildlife species observed during either
field visit.

CONCLUSION
Permits from the Florida Department of Environmental Protection (FDEP), the
Army Corps of Engineers (ACOE), and Palm Beach County will be required for dock
construction. The presence of seagrasses will need to be considered when
designing the docking facility for the proposed project. Any docking facilities
originating from the southern property boundary will likely need to extend in excess
of 200.0 ft. waterward of the shoreline in order to obtain sufficient depths for
ingress and egress, as well as mooring. Specific walkway construction requirements
must be followed for any structures passing over seagrasses. Also, the agencies will
likely require consideration of endangered and threatened species, including the
manatee, when permitting this project. The draft Palm Beach County Manatee
Protection Pian should also be consulted with respect to creating a construction plan

on October 25, 1989. Findings of inconsistency must describe how the project conflicts with your
agency's statutory authorities in the Florida Coastal Management Program and provide
alternative measures, if any, which would make the project consistent. Commenting agencies

We are in receipt of your request for an Administrative Waiver to the Land Development
Regulations (LDR), Chapter 2.5, Section 9.F., dated June 6,2006. This code specifies a minimum
right-of-way width of 40-ft. You are requesting a deviation of 4-ft., Le. a reduction from 40-ft. to 36-ft.
The LDR allows a reduction in right-of-way width so long as health, safety, welfare, or public services
are not jeopardized. You have provided a commentary showing how the above concerns have been

Casa del Mar Administrative Waiver
Minimum Right-of-Way Width
Lancore Nursery LLC, the Applicant, in conjunction with a redevelopment project,
requests an administrative waiver from Section LDR, Chapter 2.5, Section 9.F., pertaining to
minimum roadway widths for internal project roadways. Section 9.F. requires 40' right-of-way width for
all roadways, including private access roads. The Applicant is requesting a waiver to allow 36' right-of-
way widths for the internal, private roadways in the proposed Casa del Mar project, which represents a
deviation of 4'.
Concerns were raised by staff related to the adequacy of the right-of-way to handle solid waste
storage, truck movement, utility maintenance, and the sight distance for backing out of garages. The
turning movements identified on the Site Plan are the most conservative cases; the movements do allow
for trash trucks, emergency vehicles, and large SUV s. The edge of the pavement is 8' from the face of the
building. The site plan (A-I ,0) shows Garbage truck and fire truck travel trajectories throughout the site,
as laid out by AutoTurn software. The software demonstrated that 7' of minimum driveway distance
between the edge of the street and the town homes facades is enough for safe pickup and handling of
garbage containers. No obstruction or impediment is foreseeable with the use of pick-up claws. The
Public Works Department reviewed and confirmed that the trajectories are correct.
Regarding utility maintenance concerns, it has been shown on Site Data sheet (A1.3) that the
right-of-way shows adequate distances to handle utilities maintenance. The stormsewer is in the centerline
of the driveaisle. Both water and sewer are 8' offset on opposite sides of the stormsewer; a 10' separation
exists between the face of the building and water and sewer.
In response to the site distance for backing out of garages, the dept of the driveway has increased.
The site plan also shows an AutoTurn layout for a full size Sports Utility Vehicle maneuvering in and out
of a town house garage. Thus proving the sight distance for safe backing up.
The applicant believes that this request for a waiver to allow 36' right-of-way widths for internal,
private roadways does not jeopardize public health, safety, welfare, or the efficiency of public services.
The requested deviation would allow for a larger open space in the center of the site which allows for the
provision of sidewalks and connectivity within the central commons area. The argument of reducing the
street section by four feet (as worst case scenario) on behalf of the open spaces provided revolves around
the improvement of the environmental conditions of the site, without impacting the technical capabilities
of the road, as shown in the plans. This request allows for the units to front on the central common area or
the roadway while allowing for parking in the rear. This urban flair of the complex is in tune with a
growing trend favoring re-densification in a way that is "harmonious" with improved quality oflife.

Height Exception
Lancore Nursery, LLC (the "Petitioner"), in conjunction with a townhome and
condominium project within the City of Boynton Beach community redevelopment area IS
requesting an exception from Chapter 2, Section 6.F.5 pertaining to building height.
The property is located at the northeast comer of Dimick Road and Federal Highway, and
comprises 4.12 acres, within Planning Area 1. The general use and zoning pattern in the area can

Section 4.F of the City's Zoning Code ("Code") provides for height limitations and
exceptions. Electrical and mechanical support systems, as well as parapets and similar structures
may be erected on top of a structure, above the district height limitations with City Commission
approval. The Infill Planned Unit Development ("IPUD") zoning district limits heights to 45
feet.
The Petitioner is seeking a height exception that would allow a proposed four-story
condominium to exceed the aforementioned provisions. The Petitioner is proposing one four-
story building with a pitched, mansard roof that measures 53'6" at the mid-point of stair and
elevator roof and mid-pont of balcony roof. The proposed project is within the CRA. The
City's Code provides for a height of 45' for projects zoned with the IPUD to provide residential
uses in proximity to the downtown area that will provide synergy between downtown uses and
enhance economic viability of downtown businesses. Height exceptions for rooftop mechanical
equipment, parapets and similar structures are permissible, subject to City Commission approval.
The Petitioner is requesting an exception of (up to) 8'6" for a total of 53'6" height (at midpoint
of peaked roof) to accommodate rooftop mechanical equipment, elevator shafts, stairwells and
roof profiles on the proposed condominium building. The 3-story townhome buildings are
consistent with height limitations and do not require an exception.

As discussed below, approval of the height exception will adhere to the standards set
forth in Section 4.F of the Code. The Petitioner will demonstrate that the height exception:

Will not be a deterrent to the redevelopment of adjacent properties;
Will not adversely affect property values;
Will not adversely influence living conditions in the neighborhood;

Is needed for the proposed redevelopment project.

The proposed Casa del Mar project is located within the City's CRA. A general objective
of the CRA is to create a transition in intensity from the downtown to single-family
neighborhoods. The proposed condominium building fulfills these objectives and represents the
logical progression of uses that are less intense than the central business district but greater than
surrounding properties. The proposed building will blend well with existing and proposed uses.
Special care has been given to encompass function, style and urban appeal, which makes for a
more harmonious elevation.
The requested exception is not applicable to the entire building. Roof-mounted equipment
located within the central portions of the flat roof will be screened by the parapet. Roof profiles
over the balconies provide shelter and architectural interest on what would otherwise be a flat
fa9ade. The centralized stairs and elevators on the front and rear of the building extend above
the parapet and the gabled roof provides the necessary height to protect these from the elements.
Balcony roofs provide shelter and roofline variation. The requested 8'6" exception will not have
an adverse effect on existing or proposed land uses.
(2) Whether the height exception is necessary. .
Conformance with the height provisions would limit the aesthetic quality of the
condominium building. The proposed roof heights are necessary provisions to grant access to
the roof and room to the building's stairwells and elevator shafts, as well as provide cover for the
proposed balcony towers, all of which are important elements of the building elevation in terms
of functionality and aesthetics. A minimal parapet could be provided to screen roof-mounted
equipment, however, the result would be a flat, uninteresting elevation. The proposed gabled-

roof profiles have aesthetic purpose and increase the compatibility of the four-story building with
the surrounding three-story townhomes and nearby two-story single family homes.
(3) Whether the height exception will severely reduce light and air in adjacent areas.
The proposed exception of 8'6" will not affect adjacent properties. The highest points
over the elevator shafts and stairwells are centralized on the rooftop, and not immediately
adjacent to abutting properties. The balcony roofs which are lower in height, similarly, will not
pose a barrier to reduce light or air - they represent subtle changes in the elevation which only
enhance the geometry and spatial appeal of the project. The parapet screens roof-mounted
equipment from view, but will not affect other properties.
The requested building height exception will not create shadows or affect air circulation
in a manner that negatively impacts adjacent properties.
(4) Whether the height exception will be a deterrent to the improvement or development
of adjacent property in accord with existing regulations.
The requested height exception does not affect or impact the redevelopment potential of
adjacent properties. The requested exception (up to 8'6") will not be injurious to the
surrounding properties or public welfare. The proposed height is compatible with the building
heights envisioned for the Special High Density Residential land use category.
(5) Whether the height exception will adversely affect property values in adjacent areas.
The requested height of the elevator/stairwell areas, parapet, and balcony roof profiles
will not adversely affect property values. Rather, the Casa del Mar redevelopment project will
have a positive impact on property values in the area. This project along with other
redevelopment efforts in the immediate area may spur other property owners to redevelop their
parcels with structures and uses that are more consistent with the vision the City has established
for this portion of the Federal Highway corridor.
(6) Whether the height exception will constitute a grant of a special privilege to an
individual owner as contrasted with the public welfare.
The requested building height does not establish a substantial mass increase and is not
applicable to the entire building. The maximum height is located at the elevator/stairwell areas
in the central portions of the building. The balcony roof profiles are only 51' in height and only
located over the balcony elements. The gabled roof elements provide a better, more

aesthetically-pleasing architectural solution to screening elevator/stairwell areas and providing
protection from weather.
The exception (up to 8'6") will not impact other properties and is consistent with the public
welfare.
(7) Whether sufficient evidence has been presented to justifY the need for a height
exception.
The requested height exception is in keeping with the spirit of the height provisions for
infill redevelopment projects in the eRA, and is permissible pursuant to Section 4.F.
The requested building height will accommodate the elevator/stairwell areas, screen
mechanical equipment, and provide shelter for ten (10) fourth-story balconies. The result is an
aesthetic, varied roofline that provides interest to each building fa9ade. The requested height
exception will promote function, style and urban appeal, and increase the four-story building's
compatibility and harmonious relationship to abutting buildings.
Therefore, the requested Height Exception is consistent with the criteria contained
in Section 4.F.

to be issued by the town, after the build-out date, specified above. The County traffic
concurrency approval is subject to the Project Aggregation Rules set forth in the Traffic
Performance Standards Ordinance,
