Please be advised that site plan approval for the above referenced project will expire on November
1, 2007.
The City Commission granted site plan time extension approval on November 1, 2006. To date, no
building permit has been issued for this project. A building permit must be secured within one year of
site plan approval in order to maintain the vested status.
The Land Development Regulations Chapter 4, Section 5, provides for a one-year extension for site
plan approval if the application is submitted before the expiration date. Please call the Planning and
Zoning Division at (561) 742-6260 for more information regarding the site plan time extension
procedure.

Hi Tony, happy holidays to you!
Your request for site plan time extension is scheduled for the December 12, 2006 CRA and the
January 2, 2007 City Commission meetings. The following are very important items to complete
by the stated deadline dates to stay on these agendas:
1. Submit a revised justification letter by Friday, December 1, 2006 which
details the follOWing: accomplishments since City Commission approval which
demonstrate your "good faith" efforts in securing a building permit for the
project (i.e. purchased property, obtained other necessary permits, percentage
of construction drawings complete, building permits applied for, fees paid for
utility capacity reservations, impact fees paid, where revised building permit
drawings are in the review process, and when it is expected that the building
permit will be issued). Also explain in more detail what events occurred which
took considerably more time than expected (kitchen layout) and reasons why.
This justification will be the basis for the request and the length of the extension
considered (6 months, or 12 months).

10 days prior to the first public hearing, which means this Saturday,
December 2, 2006 is your deadline for noticing. Attached is a copy of the
previous notice for the site plan approval which can be modified and updated
(agent, request, proposed use, hearing dates, etc.). You may want to have us
review it for accuracy before mailing. Also attached is the sign information
needed. Photos of the posted sign(s), and a copy of the notice mailed should be
taken to the City Clerk by 12/5, where you will need to sign an affidavit that you
have completed the noticing required by the applicant.
Please keep me advised of your progress on the above. If you have any questions, or need
additional information, please give me a call. Sorry for the short notice, but this project was re-
assigned to me the day before Thanksgiving. Thank you for your prompt attention to this
matter.
NOTICE OF PUBLIC HEARING
George Brewer, agent for Anthony J. Mauro, applicant/owner, has requested the
following parcel to be considered for Major Site Plan modification approval
Legal Description: Lot 9 West 30 feet of Lot 10, Block 13, amended plat Boynton
Ridge, a subdivision of Boynton Beach, Florida, according to the plat thereof on
file in the office of the Clerk of the Circuit Court in and for Palm Beach county,
recorded in Plat book 24, Page 28.
Proposed Use: Requesting Major Site Plan approval for a 2,420 square foot
Restaurant in a C-2 zoning district.
A PUBLIC HEARING TO CONSIDER THE REQUEST IS SCHEDULED BEFORE THE
COMMUNITY REDEVELOPMENT AGENCY BOARD ON TUESDAY, OCTOBER 11,
2005 AT 6:30 PM.. THE CITY COMMISSION WILL ALSO CONSIDER THE REQUEST
ON TUESDAY, NOVEMBER 1, 2005 AT 7:00 PM IN THE CITY HALL COMMISSION
CHAMBERS, 100 EAST BOYNTON BEACH BOULEVARD, BOYNTON BEACH,
FLORIDA OR AS SOON THEREAFTER AS THE AGENDA PERMITS.
All interested parties are notified to appear at said hearings in person or by attorney and
be heard or file any written comments prior to the hearing dates. Any person who
decides to appeal any, decision of the Community Redevelopment Agency Board and
City Commission with respect to any matter considered at these meetings will need a
record of the proceedings and for such purpose may need to ensure that a verbatim
record of the proceedings is made, which record includes the testimony and evidence
upon which the appeal is to be based.
The City shall furnish appropriate auxiliary aids and services where necessary to afford

Dear CRA and Commission Mernbers,
We respectfully request a one year extension to our site plan modification approval. My
Partner Doug Peters and I have spent a great deal of time with restaurant consultants and
kitchen designers over the last year reviewing and modifying our kitchen layout and
service area to efficiently handle our extensive menu. Our original kitchen design
professional that was hired for the project was unable to fulfill his obligation. We
invested nearly six rnonths in a design that ultimately was not able to handle our needs.
Recently, with the help of a great design firm we completed our kitchen layout. Since the
finalization we have had the opportunity to purchase a coal fire pizza oven which will be
the centerpiece of the kitchen. Like the pizza oven each aspect of this project requires a
great deal of research and planning. However we are confident that this effort will help
ensure our long term success.
Unfortunately, my partner and I suffered a substantial amount of damage to our other
properties and businesses following the untimely arrival of hurricane Wilma. We were
forced to shift our focus to the repair and restoration of the losses that we incurred.
However, we were able to walk away from the experience with a great deal of knowledge
that we will use to improve our construction and hurricane preparedness to allow the
Chow Hut to reopen quickly after a disaster. The key to having a successful restaurant is
proper planning and we feel very confident that our plans and specifications are very
close to where they need to be.
As requested, we will also be revising the pages of our approved site plan to incorporate
all conditions of approval as applicable. A copy of the Development Order, including
these conditions, will accompany the subrnission of the fully amended site plan set. We
will also include all documents and third party letters listed in the conditions approval
that nee be submitted with our permit package.
