Dear Mr. Fuqua:
We have reviewed the drainage plans for the above referenced project and do hereby approve of them
for connection to our facilities, subject to the following conditions:
(X) Permittee shall reconstruct canal(s) to approved design section along and adjacent to the
project's limits, including clearing and proper sloping of the maintenance berms. The cleared
canal berms and side slopes shall be stabilized. Type of stabilization shall be approved by
LWDD. This construction shall be completed prior to any building activity adjacent to LWDD
rights-of-way. Please be advised that any fill material scheduled to be removed from the
canal may not be relied on for site work.
(X) The emergency control type structure(s) shall remain closed at all times unless specific written
approval is granted by the Lake Worth Drainage District for its operation. At no time, shall the
structure(s) be operated to bypass the water quality detention requirements for the project or to
lower the lake levels below the permitted control elevation for the project. If for whatever
reason, it is determined that the permittee is not complying with the directives of the LWDD,
and/or is operating the structure(s) contrary to their intended purpose as an emergency outflow,
the structure(s) shall be modified by LWDD to render the emergency structure(s) inoperable. In
addition, the emergency structure(s) shall be equipped with a lock mechanism to prevent its
unauthorized use, and a staff gage shall be installed upstream of the structure(s) so that lake
levels within the project can be quickly determined. By accepting this permit, the permittee
and/or assigns agrees to allow LWDD to ingress/egress and render the emergency portion of
the structure(s) inoperable for non-compliance.
(X) The Permittee is to construct any sidewalk or pathway that is proposed within LWDD right-of-
way with six inch thick concrete, or to meet LWDD approved alternate loading and material(s).
The LWDD will not be held responsible or be held liable for any damage to the sidewalk or
pathway resulting from LWDD operations and maintenance procedures, or any property
damage or personal injury caused by any sidewalk or pathway damage within LWDD right-of-
way. All repairs are to be the responsibility of the Permittee.

(X) Permittee or Permittee's representative shall notify the LWDD Inspection Department 48 hours
prior to any work within District rights-of-way to coordinate the extent of work to be completed.
All facilities needing inspection must be observed prior to backfilling
(X) Permittee shall restore LWDD's rights-of-way to its original or better conditions where disturbed
by construction activity.
(X) The Lake Worth Drainage District cannot accept any water from dewatering either on or off-site
until written notification of approval from SFWMD has been submitted to this office.
(X) It shall be the responsibility of the permittee to locate and protect any underground facilities
within LWDD's rights-of-way prior to construction.
(X) Permittee shall take all reasonable precautions necessary to prevent turbidity or silting upstream
or downstream during construction.
(X) At the time of installation, a permanent benchmark shall be established on top of the control
structure(s) with the elevation c1earlv defined.
(X) Where improvements are erected on lots or parcels contiguous to LWDO canals, the developer
shall install gutters and downspouts eliminating surplus water overland flow, assuring the route
of said water into the on-site drainage facility and/or storm sewer system.
(X) Permittee shall submit "record drawings" within sixty (60) days of project completion. Drawings
should show perimeter grading at or above the design storm and control structure dimensions
and elevations. Failure on the Developer/Owner/Permittee's part to provide these drawings
within the time specified, will result in LWOD requesting that all permits involved within this
project be put on hold until they are received.
(X) Permittee shall obtain any and all permits required by EPA, FDEP, USACE, FOOT, SFWMD,
Palm Beach County, and/or any municipality that may be involved, prior to the commencement
of any construction.
(X) Permittee agrees that the stormwater discharge authorized by this permit shall comply with all
applicable provisions of Part IV of Chapter 373, Florida Statutes, as well as applicable
management and storage of surface water rules, including but not limited to, 40E-4.301, 40E-
400.215, and 40E-400.315, Florida Administrative Code, and Section 5.2 of the SFWMD Basis of
Review. All costs of correcting any violations of SFWMD law and rules shall be the exclusive
obligation of permittee.
(X) All unpermitted drainage facilities installed before or during construction shall be removed prior
to the project's final acceptance.
() Permittee has provided a bond in favor of LWDD in the amount of 110% of the cost of the pipe
and its installation. Bond can be released upon issuance of final inspection by LWDD and
developer's submittal of "record drawings" to LWOO.

(X) Permittee agrees that significant construction must start within one year to the date of permit
issuance or this permit is void and a new permit must be applied for prior to any construction
activity on site. The new application must meet current operating policies.
(X) The Permittee, assigns, or successors in title agree to operate and maintain the drainage
system in perpetuity.
Permittee acknowledges that Lake Worth Drainage District is exempt from liability for personal injury and
damages that may arise as a result of the issuance of this Permit by virtue of Florida Statute, Chapter No.
2003-344.
In consideration of and by acceptance of the permit issued by the LWDD, the undersigned agrees to
perform the above; and further agrees to indemnify and hold harmless LWDD for any damages or
injuries emanating out of, or resulting from the permit herein granted. That any non-compliance by
permittee of the above conditions will result in the cancellation of this permit and the withholding of
Certificates of Occupancy. Further, undersigned represents that permittee is the owner of the project.

This permit is issued by L WOO as a temporary license to use or occupy l WOO works or lands to locate irrigation facilities, as
further described on Exhibit" A" (description of location) and Exhibit "B" (drawing). This permit does not create any right or
entitlement, either legal or equitable, to the continued use of lWDD works or lands by permittee. By acceptance of this permit,
the permittee expressly acknowledges that the permittee bears all risks of loss that may result from issuance and/or revocation of
this permit.
Permittee agrees to indemnify and hold harmless the Lake Worth Drainage District (lWDD) and its successors and/or assigns
from any and all damages, injuries, claims or liabilities which may arise by reason of the construction, maintenance or use of the
work or structure involved in this permit. The permittee, by acceptance of this permit, hereby agrees to promptly comply with all
orders of LWDD and shall alter, repair or remove its use solely at its expense within thirty (30) days of notification from LWDD.
Permittee shall comply with all laws, rules and policies administered by lWDD. This permit does not convey to permittee any
property rights or any rights, privileges, or interest other than those specified herein, nor relieves the permittee from complying
with any law, regulation, or requirement affecting the rights of other governmental entities or agencies. All structures and works
installed by permittee hereunder shall remain the property of the permittee.
l WOO makes no representations or warranties as to the continued availability, quantity or quality of any water being
withdrawn from its canal system. Permittee assumes all responsibility and liability for any water withdrawn from lWOD
canals. Permittee holds lWDD harmless and releases lWDO from any damages or injuries that may arise with withdrawal of
any water from LWDD's canal system in conjunction with the Consumptive Use Permit being issued by SFWMD.
l WOO retains the right to object to or otherwise challenge the issuance of any application for water use permit with SFWMD.
This permit is not valid until lWDD receives written confirmation from SFWMD that the Consumptive Water Use Permit
associated with this Irrigation Connection Permit has been issued by SFWMD.
Any violation of the SFWMD Consumptive Water Use Permit shall be considered a violation of this permit.
Af/ existing and future fees associated with this permit will be borne by the permittee.
All rights transferred herein to permittee shall be inferior to the rights of lWDD.
Permittee acknowledges that lake Worth Drainage District is exempt from liability for personal injury and damages that may
arise as a result of the issuance of this Permit by virtue of Florida Statute, Chapter No. 2003-344.
WORK PROPOSED, WilL BE COMPLETED ON OR BEFORE ,20 otherwise, this permit is void and all

l WDD's authorization to utilize lands and other works constitutes a temporary revocable permit. In consideration for receipt of
the subject temporary revocable permit, permittee agrees to be bound by the following standard limiting conditions; unless
expressly waived or modified by the Board of l WDD, as being not in furtherance of the objectives of Chapter 298, F.5., and/or
special acts creating l WOO:
By:
1. No open channel connections are allowed to l WOO's facilities. All conne<.1ions shall be made by pipe. culverts, etc.,
constructed of suitable material, as approved by L WOO authorized per'>Onnel.
2 No power poles and electrical lines are allowed in l WOO right-of-way.
3. Cover over facilities installed within l WDD maintenance areas shall be sufficient to withstand L WDO maintenance
operations. A minimum of thirty,six inches (36") of cover is required_ [Soil conditions may affect the minimum cover
required,)
4, All facilities on L WOO works or lands constructed by permittee shall remain the property of permittee, who shall be
solely responsible for ensuring that such facilities and other uses remain in good and safe conditions and comply with all
applicable federal, state, and local safety standards. L WDO assumes no obligation with regard to ensuring that such uS€s
are '>0 maintained and assumes no liability with regard to injuries caused to other<, by any failure of the facilities. L WOD
further assumes no duty to ensure that the permitted use complies with the safety standards of other governmental
entities.
5. Perm;t1ee agrees to abide by all of the terms and conditions of this permit, including any representations made on the
permit application and related documents. Permit1ee agrees to pay all investigative costs, cour1 costs and reasonable
at1orney's fees resulting from any successful action taken by L WDO to obtain compliance with the conditions of the
permit or removal of the permit1ed use.
6 1his permit does not create any vested rights, and is revocable at the sole discretion of LWOO within thirty (30) days

7. This permit does not convey any property rights nor any rights or privileges other than those specified herein. LWDD
approves the permitted use only to the extent of its interest in the works of lWDD. The permittee shall obtain all other
necessary federal, state, local, special District and private authorizations prior to the start of any construction or alteration
authorized by the permit. LWDD, however, assumes no duty to ensure that any such authorizations have been obtained
or are required.
8. Permittee agrees to hold harmless and indemnify lWDD from any and all damages, injuries, liabilities or claims which
arise from the ownership, construction, maintenance or operation of the pennitted use of facilities, whether caused by
the injured person or permittee, and whether occurring within the area of the permitted use or outside such area,
provided the activity originated from the permitted use. This obligation expressly includes any alleged or actual
negligence by LWDD as to all permitting activities regarding the subject use, including enforcement of pennit
conditions.
9. Prior to construction, a copy of the Consumptive Use Permit from SFWMD shall be submitted to L WOD.
10. The permittee shall not engage in any activity regarding the permitted use, which interferes with the construction,
alteration, maintenance or operation of the works of lWDD, including, but not limited to:
A. Discharge of debris or aquatic weeds into the works of l WDD.
B. Causing erosion or shoaling within the works of lWDD.
C. Planting trees or shrubs or erecting structures which limit or prohibit access by lWDD equipment and vehicles,
except as may be authorized by the permit.
Permittee shall be responsible for any costs incurred by lWDD resulting from any such interference.
11. Permittee shall allow LWDD to inspect the permitted use at any time.
12. LWDD has the right to change, regulate, limit, schedule, or suspend discharges into, or withdrawals from, works of
LWDD, in accordance with criteria established by LWDD and other regulatory agencies. Reasonable prior written
notice shall be given to permittee.
13. No encroachments shall be located within LWDD right-of-way, other than what is permitted on the design plans.
Existing facilities located within L WDD right-of-way shall be relocated within sixty (60) days of written l WDD
notification to relocate.
14. Permittee shall comply with any and all Limiting Conditions contained in lake Worth Drainage District's South Florida
Water Management District Consumptive Use Permit Number 50-00793-W.
15. Permittee releases and holds harmless L WDO for any damages caused by Permittee to the permitted facilities.
16. Permittee will restore right-of-way to its original or better condition where disturbed by construction activity.
17. Prior to commencement of construction, the Permitter will contact the proper authorities to locate all existing utilities
that may be located in the lWOO right-of-way

District staff has reviewed the information submitted in support of the referenced application for permit
modification(s) and determined that the proposed activities are in compliance with the previous permit and
the appropriate provisions of Rule 40E-20.331 (3)(a), Florida Administrative Code. The permit
modification(s) include the following:
The dewatering plan of the existing permit (Permit Number 50-07079-W) has been revised to include an
additional recharge trench/hydraulic barrier to completely surround an on-site contamination area and to
extend a recharge trench at the south side of the project to provide a hydraulic barrier between dewatering
activities and a potential off-site contamination site. The revised site plan is shown in Exhibit 4.
Hydraulic Barrier B will encompass the east end of the dairy barn where groundwater Impacts were
identified in an environmental site assessment (Application Number 050201-7). Water recovered during
construction and dewatering activities within Hydraulic Barrier B will be properly characterized, tested and
disposed. Hydraulic Barrier A will be extended to provide buffering between dewatering activities and an
off-site dry cleaner (Oakwood Cleaners). The water level in each trench will be maintained at 1.0 foot
above the existing water table elevation.
Please understand that your permit remains subject to the 25 Limiting Conditions and all other terms of the
permit authorization as previously issued.

10 million gallons per day.
6 Pursuant to Rule 40E-1.61 05, FAC., Notification of Transfer of Interest in Real Property, within 30 days
of any transfer of interest or control of the real property at which any permitted facility, system,
consumptive use, or activity is located, the permittee must notify the District, in writing, of the transfer
giving the name and address of the new owner or person in control and providing a copy of the
instrument effectuating the transfer, as set forth in Rule 40E-1.61 07, FAC.
Pursuant to Rule 40E-1.61 07 (4), until transfer is approved by the District, the permittee shall be liable for
compliance with the permit. The permittee transferring the permit shall remain liable for all actions that

8 Permittee shall mitigate interference with existing legal uses that was caused in whole or in part by the
permittee's withdrawals, consistent with the approved mitigation plan. As necessary to offset the
interference, mitigation will include pumpage reduction, replacement of the impacted individual's
equipment, relocation of wells, change in withdrawal source, or other means.
Interference to an existing legal use is defined as an impact that occurs under hydrologic conditions
equal to or less severe than a 1 in 10 year drought event that results in the:

(1) Inability to withdraw water consistent with provisions of the permit, such as when remedial structural
or operational actions not materially authorized by existing permits must be taken to address the
interference; or
(2) Change in the quality of water pursuant to primary State Drinking Water Standards to the extent that

9 Permittee shall mitigate harm to existing off-site land uses caused by the permittee's withdrawals, as
determined through reference to the conditions for permit issuance. When harm occurs, or is imminent,
the District will require the permittee to modify withdrawal rates or mitigate the harm. Harm as
determined through reference to the conditions for permit issuance, includes:
(1) Significant reduction in water levels on the property to the extent that the designed function of the
water body and related surface water management improvements are damaged, not including aesthetic
values. The designed function of a water body is identified in the original permit or other governmental
authorization issued for the construction of the water body. In cases where a permit was not required,
the designed function shall be determined based on the purpose for the original construction of the water
body (e.g. fill for construction, mining, drainage canal, etc.)
(2) Damage to agriculture, including damage resulting from reduction in soil moisture resulting from
consumptive use; or
(3) Land collapse or subsidence caused by reduction in water levels associated with consumptive use.
10 Permittee shall mitigate harm to the natural resources caused by the permittee's withdrawals, as
determined through reference to the conditions for permit issuance. When harm occurs, or is imminent,
the District will require the permittee to modify withdrawal rates or mitigate the harm. Harm, as
determined through reference to the conditions for permit issuance includes:
(1) Reduction in ground or surface water levels that results in harmful lateral movement of the fresh
water/salt water interface,
(2) Reduction in water levels that harm the hydroperiod of wetlands,
(3) Significant reduction in water levels or hydroperiod in a naturally occurring water body such as a lake
or pond,
(4) Harmful movement of contaminants in violation of state water quality standards, or
(5) Harm to the natural system including damage to habitat for rare or endangered species.
11 If any condition of the permit is violated, the permit shall be subject to review and possible modification,
enforcement action, or revocation.
12 Authorized representatives of the District shall be permitted to enter, inspect, and observe the permitted
system to determine compliance with special conditions.
13 The Permittee is advised that this permit does not relieve any person from the requirement to obtain all
necessary federal, state, local and special district authorizations.

14 The permit does not convey any property right to the Permittee, nor any rights and privileges other than
those specified in the Permit and Chapter 40E-2, Florida Administrative Code.
15 Permittee shall submit all data as required by the implementation schedule for each of the limiting
conditions to: S.F.W.M.D., Supervising Hydrogeologist - Post-Permit Compliance, Water Use Regulation
Dept. (4320), P.O. Box 24680, West Palm Beach, FL 33416-4680.
16 The Permittee is advised that this Permit does not relieve the Permittee of complying with all county,
state, and federal regulations governing these operations, maintenance, and reclamation of the borrow
pit.
17 All dewatering water shall be retained on the Permittee's land. Off-site discharge of dewatering effluent
shall not be made.
18 The excavation shall be constructed using sound engineering practice. If the excavation endangers the
properties of adjacent owners through erosion, side wall collapse, etc., the Permittee shall cease
operation upon notification by the District until a method to prevent such occurrences is found and
instituted.
19 Permittee shall immediately cease dewatering when continued dewatering would create a condition
hazardous to the health, safety, and general welfare of the people of the District.
20 Permittee shall be responsible for clearing shoaling if the Permittee's dewatering operation creates
shoaling in adjacent water bodies.
21 Permittee shall comply with turbidity and general water quality standards for surface discharge into
receiving streams, as established by Chapter 62-302, Florida Administrative Code.
22 Permittee shall not lower the water table below the following depths:
-11.5 feet NGVD (approximately 22.5 feet below land surface).
23 A copy of the permit, its limiting conditions, and dewatering plan is required to be kept on site at all times
during dewatering operations by the lead contractor or site manager.
24 In the event of a declared water shortage, water withdrawal reductions will be ordered by the District in
accordance with the Water Shortage Plan, Chapter 40E-21, FAC. The Permittee is advised that during
a water shortage, pumpage reports shall be submitted as required by Chapter 40E-21, FAC.
25 The Permittee shall construct the proposed recharge trenches prior to dewatering and maintain water
levels during active dewatering operations within one foot below land surface. Obstructions and
sediments within the recharge trenches shall be removed to maintain the effectiveness of the recharge
trenches.

This letter is to notify you of the District's agency action concerning your Notice of Intent to Use Water. This
action is taken pursuant to Chapter 40E-20, Florida Administrative Code (FAC.). Based on the information
provided, District rules have been adhered to and a General Water Use Permit is in effect for this project
subject to:
1. Not receiving a filed request for Chapter 120, Florida Statutes, administrative hearing and
2. The attached limiting Conditions.
The purpose of this application is to obtain a Dewatering General Water Use Permit for short-term
dewatering for the safe excavation and installation of underground utilities, storm drainage facifities, and
on-site wet detention areas for the proposed project known as Boynton Town Center and Boynton Village.
The project is located in Section 20 of Township 45S, and Range 43E in Palm Beach County, east of.
Congress Avenue and between the SFWMD C-16 Canal and New Boynton Road West. Please see
Exhibits 1-3 for project location maps.
Actual dewatering activities are expected to require less than 145 days, with a maximum daily pumpage of
less than .108 million gallons and a total project pumpage not expected to exceed 15.66 million gallons.
All dewatering water shalf be retained on the Permittee's land. Off-site discharge of dewatering effluent
shall not be made. The dewatering water shalf be retained on-site in the proposed recharge trenches. If
off-site discharge becomes a necessity, the Permittee shalf apply for a modification of this permit prior to
discharging off-site.
A copy of the permit, its limiting conditions, and dewatering plan is required to be kept on site at all times
during dewatering operations by the lead contractor or site manager.

17. All dewatering water shall be retained on the Permittee's land. Off-site discharge of dewatering effluent
shall not be made.
18. The excavation shall be constructed using sound engineering practice. If the excavation endangers the
properties of adjacent owners through erosion, side wall collapse, etc., the Permittee shall cease
operation upon notification by the District until a method to prevent such occurrences is found and
instituted.
19. Permittee shall immediately cease dewatering when continued dewatering would create a condition
hazardous to the health, safety, and general wenare of the people of the District
20. Permittee shall be responsible for clearing shoaling if the Permittee's dewatering operation creates
shoaling in adjacent water bodies.

Limiting Conditions
21. Permittee shall comply with turbidity and general water quality standards for surface discharge into
receiving streams, as established by Chapter 62-302, Florida Administrative Code.
22. Permittee shall not lower the water table below the following depths:-11.5 feet NGVD (approximately
22.5 feet below land surface).
23. A copy of the permit, its limiting conditions, and dewatering plan is required to be kept on site at all
times during dewatering operations by the lead contractor or site manager.
24. In the event of a declared water shortage, water withdrawal reductions will be ordered by the District in
accordance with the Water Shortage Plan, Chapter 40E-21, F AC. The Permittee is advised that during
a water shortage, pumpage reports shall be submitted as required by Chapter 40E-21, F.A.C.

Dewaterinq Activities
Dewatering is needed for the safe excavation and install.ation of underground utilities, storm
drainage facilities, and on-site wet detention areas.
Facilities'for dewatering include a portable 4-inch centrifugal pump and wellpoints discharging
on-site to proposed recharge trenches. Specific pump information is provided in Exhibit 5. All
Dewatering effluent will be retained on the Permittee's land.
There are several locations to be dewatered for this project, including underground utilities,
stormwater piping, and the proposed on-site wet detention areas. The dewatering site plan is
provided in Exhibit 48.
Instillation of the lift station will require the maximum dewatering and excavation depths, which
will occur at a maximum depth of -11.5 feet NGVD (approximately 22.5 feet below land surface).
The anticipated duration for actual dewatering activities is 145 days with a maximum daily use
limited to the maximum pump capacity, which is approximately 75 gallons per minute (less than
0.108 million gallons per day).
Contamination:
The nearest potential source of contamination is the Oakwood Cleaners, located approximately
700 feet south of the project. The Permittee has proposed recharge trenches on the dewatering
plans (Exhibit 48) and pursuant to Limiting Condition Number 25, the Permittee shall construct
the proposed recharge trenches prior to dewatering and maintain water levels during active
dewatering operations within one foot below land surface. Obstructions and sediments within
the recharge trenches shall be removed to maintain the effectiveness of the recharge trenches.
Additional drawdown buffering is expected to be provided by the maintained Lake Worth
Drainage District canals which surround at least half of the project site.
Due to the small magnitude of the proposed dewatering activities, the depth of the proposed
dewatering, and on-site recharge. the potential for harm due to the movement of contaminants
is considered to be minimal.
Saline Water/Salt Water:
The site is more than 1,000 teet from the nearest source of surface saline water and discharge
of fresh water to saline or salt water is not proposed.
Wetlands:
Wetlands on site are to be developed; therefore, no significant drawdown impacts to associated
wetlands are anticipated.
Stormwater:
Dewatering water will be stored on-site in proposed recharge trenches; therefore, the proposed
activities should have no impact on the storage capacities of any off-site stormwater
management facilities.

The City of Boynton Beach has received a Notice of Intent that Comprehensive Plan
Amendments 2005-049 thru 2005-60 for Palm Beach County have been found by OCA to
be in compliance with the Comprehensive Plan. A portion of these Amendments relate to
the CRALLS benefiting the Winchester Development.
This Notice was issued January 24th, with copy of same distributed to both you and me by
Ms. Kim Glas-Castro of Ruden McClosky on January 25th, 2006. Please find a hard copy of
this Notice attached to this letter, as well as the Staff Report from the second hearing of the
Pahn Beach County Commission. This took place on November 28' 2005, and it was at this
time that the Amendments were adopted by the County for DCA final action.
This will become final action from DCA on the CRALLS after a twenty-one (21) day appeal
period, or February 14, 2006.

The Department gives notice of its intent to find the Amendment to the Comprehensive Plan
for Palm Beach County, adopted by Ordinance Nos. 2005-049 thru 2005-060, on November 28, 2005,
IN COMPLIANCE, pursuant to Sections] 63.3184. 163.3187 and 163.3] 89, F.S.
The adopted Palm Beach County Comprehensive Plan Amendment and the Department's Objec-
tions, Recommendations and Comments Report, (if any), are available for public inspection Monday
through Friday, except for legal holidays, during nonnal business hours, at the Palm Beach County
Planning, Zoning and Bui]ding Department. 100 Australian Avenue. West Palm Beach, Florida 33406.
Any affected person, as defined in Section] 63.3] 84, F.S., has a right to petition for an admin-
istrative hearing to challenge the proposed agency detennination that the Amendment to the Palm Beach
County Comprehensive Plan is In Compliance, as defined in Subsection 163.3] 84(1), F.S. The petition
must be filed within twenty-one (21) days after publication of this notice, and must include all of the
infonnation and contents described in Unifonn Ru]e 28-] 06.20], F.A.C. The petition must be filed with
the Agency Clerk, Department of Community Affairs, 2555 Shumard Oak Bou]evard, Tallahassee,
F]orida 32399-2] 00, and a copy mailed or delivered to the loca] government. Fai]ure to timely file a
petition shall constitute a waiver of any right to request an administrative proceeding as a petitioner under
Sections ]20.569 and 120.57, F.S. If a petition is filed, the purpose of the administrative hearing will be
to present evidence and testimony and forward a recommended order to the Department. If no petition is
filed, this Notice of Intent shall become final agency action.
If a petition is filed, other affected persons may petition for leave to intervene in the proceeding.
A petition for intervention must be filed at least twenty (20) days before the final hearing and must
include all of the infonnation and contents described in Unifonn Ru]e 28-106.205, F.A.C. A petition for
leave to intervene shall be filed at the Division of Administrative Hearings, Department of Management

STAFF RESPONSE: This is a temporary CRALLS which will expire after West Atlantic Avenue is widened to six lanes from Turnpike
to Jog Road and to four lanes from SR-7 to Lyons Road. The widening of the road has to be done before December 31st 2008 or no
building permits will be issued to the developers. Once after the widening of West Atlantic Avenue is completed there will be no
necessity for this CRALLS since the roadway will function well within its capacity. Generally for temporary CRALLS when mitigation
opportunities are limited the County does not insist on mitigation measures since the roadway is anyway not going to be constrained
permanently. However the major mitigation measure of this project is that it will be relieving traffic on State Road 7 which is projected to
carry heavy traffic on the long term. This mitigation measure is an important land use/site planning technique (shown in Policy 1.2-q) that
will balance land use/traffic regionally. Also we are modifying this CRALLS to include additional properties which will contribute towards
widening of West Atlantic Avenue. Hence taking into consideration the temporary nature of this CRALLS and the fact that it includes an
important mitiqation technique of balancinq land use/traffic in a reqional scale, this CRALLS is consistent with TE Policy 1.2-0.

point system was a combined effort of the County and FDOT. The point system consists of fourteen mitigation strategies. Each
mitigation strategy has a certain amount of points attached to it. Applicants meeting the minimum required point totals will receive
approval. Seven of the fourteen mitigation strategies available in the point system are also available in TE Policy 1.2-q. County believes
that the point system has sufficient mitigation measures to improve mobilitv in the corridor and that it is consistent with TE Policv 1.2-q.

STAFF RESPONSE: The traffic study was reviewed based on our Comprehensive Plan, specifically Future Land Use Elemment
(FLUE) Policy 3.5-d, which requires that all long term traffic impacts from new developments be reviewed for both significant and
negative traffic impacts. An impact is considered negative when the total traffic exceeds LOS D. An impact is considered significant
when the project traffic is above 3% of the roadway capacity. A project fails only if the long term traffic impacts are both significant and
negative. This project at the maximum intensity, significantly and negatively impacted State Road 7 and Lyons Road, hence it did not
pass at the maximum intensity. By limiting the project to 80,803 sf of commercial and 108.000 sf of Institutional, State Road 7 and Lyons
Road were negatively impacted but the project traffic was not significant (the impact was de minimis). The proposed conditions further
limit the project below the above figures; hence this project at the conditioned intensity meets the traffic requirements for plan
amendments as set forth in the Comprehensive Plan.
The short-term roadway failures are dealt with a very comprehensive concurrency system in place in Palm Beach County. The
backbone of the Concurrency System is mandated in detail within the adopted policies of the Transportation Element (TE) of the
Comprehensive Plan. While all of the policies can be reviewed, of particular note are TE Policies 1 .1-a and 1.1-g.
All projects coming in for development approvals must meet Palm Beach County Traffic Performance Standards (TPS) to show that
necessary roadway infrastructure is in place concurrent with the impacts of the development. Based on our discussion with DCA we are
submitting a short-term peak hour analysis for informational purposes only_ The short-term peak hour directional analysis and the
consultant's covering letter are attached with this report and it doesn't show any failures of the impacted roadways. Since the long-term
impacts and the short-term impacts of the proposed land use amendment meet the LOS standard as explained above, the County
believes that the amendment is consistent with the Comorehensive Plan.

Please accept this letter as a request by the City of Boynton Beach to
initiate a Comprehensive Plan amendment to accomplish a CRALLS
designation for the following locations:
. Intersection of Old Boynton Road and Congress A venue
. A segment of Old Boynton Road between Congress A venue and Boynton Beach Boulevard
. Intersection of Gateway Boulevard and Congress A venue
The City is currently evaluating traffic impact from the proposed Boynton Town Center and Boynton Village
Developments located on the east side of Congress A venue and north of Old Boynton Road to the Boynton C-
16 Canal. The property is more commonly known as the Winchester parcel. The Developer has received a
concurrency letter from Palm Beach County Traffic Staff dated February 1, 2005 that details a number of off-
site roadway improvements that, according to the Traffic Performance Standards in Article 12 of the Palm
Beach County Land Development Code, are required to support the proposed development. Unfortunately,
many of the required improvements will be exceedingly difficult to construct because of the lack of sufficient
right-of-way. The construction would require the acquisition of additional right-of-way from a number of
private properties near the proposed development. Furthermore, the acquisition of property, and construction
of the proposed improvements, would have a negative impact on the remaining properties by reducing building
setbacks, potentially reducing available parking, and by degrading the overall appearance of the property when
viewed from the public roadway.
Because of these issues, alternative solutions such as CRALLS designation must be explored to allow for the
aforementioned development to proceed, if approved on February 15, 2005.
We appreciate your cooperation and assistance in working with the City in processing this application. We will
prepare data analysis within the time schedule specified by the Palm Beach County Land Development Code.

I agree - we absolutely must be prepared to propose mitigation at the pre-app. I have
Kimley-Horn undertaking preliminary design for widening of Gateway and determining if the
other mitigation measures suggested within the concurrency letter from Masoud can be
accommodated within existing public ROW. Other measures, if those cannot be performed,
need to be then determined and suggested. The broader network traffic study Masoud wanted
has just been completed by Kimley Horn and he is sending me a draft copy. He has other
suggestions within that report. I'll update the team shortly.

Dear Mr. Hudson:
The Palm Beach County School District has reviewed the request for a Concurrency
Determination on the above reference~ project for 1 ,120 multi-family units.
Attached please find the approved Palm Beach County School District Concurrency
Application and Service Provider Form for Boynton Village. This Concurrency Determination
is valid for one (1) year from the date of issuance. Once a Development Order has been
issued for the project, the concurrency determination will be valid for the life of the
Development Order.
