Dear Mr. Morrison:
In response to your original request dated August 16, 2006 and
subsequently modified and resubmitted September 24, 2007, for the
administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following:
· Modification of Building H - now depicted as Buildings H-1 & H-2
to reduce the buildings to one floor with an outward
appearance of two stories (as depicted on the attached plan) .
· Modification of parking area north of Buildings H-1 & H-2 (as
depicted on the attached plan) .
· Postponement of the remaining 16 dwelling units to another site
plan modification and utilization of the space as a temporary
park area (as depicted on the attached plan) .
· Relocation of proposed fountain from the easternmost traffic
circle to the westernmost (as depicted on the attached plan) .
Please be informed that the proposed changes on the revised plan
date stamped 9/24/07 are "minor" as defined within the Land
Development Regulations, Chapter 4 Site Plan Review. This
project may continue to be processed by the Building Division as a
permit application, subject to the following conditions:
1. The elevations do not depict the electrical meters and equipment
proposed on the north elevations of Buildings H-1 & H-2. This
equipment is required to be painted to match the building and must
be screened from view. Please depict compliance with these
regulations at time of permitting.
2. Replace the proposed Carpentaria Palms along the north elevations
of the buildings with Foxtail Palms, 16 feet in height except where
the building pop-up occur, in which case they should be planted at
20 feet in height. These palms are more compatible with the Royal
Palms planted in close vicinity.

3. Landscape should be planted around the base of the above mention
palms, as depicted on the front and side elevations.
4. Place two (2) additional Royal Palm trees in between those already
depicted in the widen sidewalk areas along both the NE and NW sides
of the easternmost traffic circle.
5. At time of permitting, please provide written authorization from
Utilities for the placement of artwork in the easternmost traffic
circle.
6. A separate Site Plan Modification approval will be required for the
16 dwelling units. Approval of this Minor Modification in no way
implies the City's approval of the area proposed to contain the 16
dwelling units.
7. Please note that changes or revisions to these plans may generate
additional comments. Acceptance of these plans during the minor
site plan modification review process does not ensure that
additional comments may not be generated at permit review.
Be advised that the proposed changes may require a modification to

The above referenced revised site plans, received on September 27, 2007, were reviewed
against comments provided to the engineer-of-record, Kimley-Horn & Assoc.(KHA), dated
1/08/07. The following comments are based on review of the provided plans and written
responses dated 9/24/07 from KHA. The response(s) provided by K-H for the initial comments
(correspondence dated 1/08/07) are acceptable and most items have been eliminated.
Following are revised and/or new comments and should be included in any return
correspondence:
. Provide written authorization to place artwork in the round-about southeast of Building "H-1."
As previously stated no structural features will be allowed due to utility mains and easements
in this area.
. All comments requiring changes and/or corrections to the plans shall be reflected on all
appropriate sheets.
. Please note that changes or revisions to these plans may generate additional comments.
Acceptance of these plans during the Technical Advisory Review Team (TART) process
does not ensure that additional comments may not be generated by the Commission and at
permit review.

Per our phone conversation late yesterday afternoon I am forwarding a copy of a portion of Sheet C13
from the revised plans for the above referenced minor modification(s).
Comments were provided to Kimley-Horn & Assoc. (KHA) at the beginning of January 2007. The
comment and response regarding the sanitary sewer is as follows:
· The proposed "header" configuration for sanitary sewer laterals to the west of the eight town homes
(adjacent to Building "H-1") will not be permitted. Provide sanitary sewer main along the front of the
townhomes, with laterals properly tied into the main. Connect the new main to the sanitary sewer in
the primary east-west roadway (at the round-about.) Delete the proposed sanitary sewer that runs
from the mid-point of the proposed town homes west and connects into the secondary roadway in
front of Buildings "K", ilL", and "M." The proposed sanitary sewer laterals to the west of the
townhomes area has been previously submitted and approved by the Utilities Department. As
such, the sanitary sewer lines for this area have already been constructed and certified for
system compliance.
There are no plans to develop the town homes at this time; however the developer is going ahead with
getting the infrastructure in place in anticipation of future work. Given our position on the use of headers
for sanitary sewer (or water for that matter) I wouldn't think we would have missed this during our
reviews. In any event could you look through the construction plans for this area and see if, in fact, this
configuration has been reviewed, approved, and constructed so I can appropriately frame a response to
KHA for my second review of this minor modification.

We have reviewed your comments for the Minor Modification to Site Plan for the above
referenced project and here are our responses:
Minor Mod 06-050 (BIdi!. H) comments:
· Consider rolling this older Minor Mod request in to this latest request, as part of the
responses / changes noted herein. Some portions of the previous request may now be
outdated or superseded by this most recent application.
Comment noted. We decided to maintain Building H minor modifications separate
from the SMU / C3 modifications so as to not hold the approval of the other
components of the job. This Building H minor modification submittal will
encompass buildings H-l and H-2.
· As noted in the SMU comments, the new traffic circle (southeast of Building "H-l")
is depicted (and labeled) with a fountain in the middle. No structural features will
be allowed, as they will fall within a utility easement that contains water and sanitary
sewer.
The proposed fountain has been relocated to the west traffic circle. The new location
has been coordinated with the Utilities Department and will not be in conflict with
underground utility easements.

Paving, drainage and site details will not be reviewed for construction acceptability
at this time. All engineering construction details shall be in accordance with the
applicable City of Boynton Beach Standard Drawings and the "Engineering Design
Handbook and Construction Standards" and will be reviewed at the time of
construction permit application.

at the southeast comer of Building "H-l" comes off the main instead the main
coming off the fire hydrant lead.
Fire hydrant location was shifted under a previous submittal. No water mains are
shown coming off of tire hydrant leads. Please see sheet C 13.
· A note for 3-in service line with a 2-in meter is shown southeast of the of the eight
townhomes but no line is shown. Please correct.
The plans have been revised to provide for a 4" domestic water service line (cap for
future use)
· Please identify whether townhomes will be 2 or 3-story.
Per agreement with City Staff, the design of the townhomes building will be
finalized at a future date. The current configuration of the area will be a temporary
park.
· No fire line or meter(s) were shown for the proposed townhomes or building "H-2".
Please correct.
New fire and domestic water line have been added to the NW corner of building H-2.
Please see sheet C 13.

· The correspondence regarding this minor modification (dated 8/16/06) states that
grease traps were added throughout the Boynton Town Center & Village site
although only one of the utility sheets was included in the plan set. Is Sheet C-13 the
only sheet with new grease traps identified?
Grease trap locations have been approved under a separate minor modification and
subsequent separate grease trap permits through the building department. New
proposed grease trap locations for Building H were not part of the previous
submittals, but are currently being shown on this minor modification submittal.
Please refer to sheet C 13
. Utility construction details will not be reviewed for construction acceptability at this
time. All utility construction details shall be in accordance with the Utilities
Department's "Utilities Engineering Design Handbook and Construction
Standards" manual (including any updates) and will be reviewed at the time of
construction permit application.

· Building elevations were not provided for the townhomes or the garages north of
Building H.
Building elevations have been included with this submittal for the town homes,
though the garages have been removed from this submittal.
· It would appear as though all glass depicted on Building H is vision glass. If this is
incorrect, please accurately depict areas of vision and non-vision glass.
A glass legend has been provided on the color elevations depicting, vision glass,
non-vision glass and opaque glass that will be back lit at night.
· Originally, Building H appeared to have a good deal of what looked like brick
faryade. Staff would prefer to retain some of that faryade element.
The elevations depicted have been modified to include more height along main st
including brick, glass, balconies, and upper story windows. More height along Main
Street is a specific request of Zoning, and has been discussed with both Mike Rumpf
and Ed Breese.

C-3 related comments:
Revise the yellow lane separator at the driveway adjacent to the northeast comer of
Building "A" (Super Target) to line up with the roadway/aisle alignment. It may be
necessary to extend the length of the separator and curve it to accurately "inform" the
traveling public.
Sheet C3 indicates (in two separate places) the total square footage at 246,506, while
Sheet MSD depicts the total at 246,373.
General comments:
No landscape plans were submitted so that they could be evaluated for potential conflicts
with dumpster/compactor enclosure locations and utility (water & sewer) mains and
easements.
The submittal of revised landscape plans is a necessary part of the Minor Mod submittal
in order to accurately depict the landscape situation based upon changes in building
footprints and relocation of various site features.
Correspondence submitted with the minor modification plans indicates that the plans
have been submitted and approved by the Deputy Director of Utilities, Peter Mazzella.
Please provide a copy of the written approval from Mr. Mazzella for the files.
Palm Beach County Health Department permits may be required for the water and sewer
system revisions.
The revision to any floorplans are not subject to Minor Mod review and therefore have
not been reviewed or approved.
Although the submittal letter indicates color elevations were part of the package, they
were not submitted as part of this Minor Mod application.

Dear Mr. Tazoe:
Staff has reviewed the revisions to the above-mentioned project, and as a result of our review, the
following comments and questions are being forwarded to you for your review and response:
SMU related comments:
With respect to the new trash compactor and loading area at the southeast comer of
Building "F" - the approach to the compactor enclosure overlaps the loading area. Please
be advised this may impact the ability of Solid Waste to pick up if the loading zone is in
use. It is recommended that there be no overlap of the two uses to resolve this conflict.
Rotate the dumpster enclosure northeast of Building "J" so that it is opens to and is
approached from the southeast.
Reduce the amount oflighting depicted on the north side parking lot of Linens-N-Things,
as there are hot spots depicted on the photometries plan.
A lift station now appears along the spine road and no orientation or landscaping has been
depicted with it. Please provide greater detail.
The fountain depicted in the easternmost traffic circle will not be allowed due to utilities
located beneath it. Staff recommends relocating the fountain to the westernmost traffic
circle or re-adjusting the utility runs.
As discussed previously, Staff is looking to create more of a gathering area/public plaza
and outdoor dining experience along the common areas on the north side of the
easternmost traffic circle. Rather than having covered walkways, Staff envisions enlarged
pavered spaces both along the eastern side of Building H and for a sizeable portion of the
greenspace south of the townhouse units, meandering down to the waters edge. In these
areas should be umbrella tables & chairs or some assortment of covered seating areas,
perhaps designed to capture the theme of the public art and/or building fac;ade
embellishments slated for the north side of Linens-N-Things. The public should be able to
take advantage of these areas for outdoor dining, for entertainment purposes, or a space to
leisurely read the newspaper, people watch or enjoy the water feature in the lake.

Dear Mr. Breese:
We are submitting the following sets of drawings for Minor Modifications to
Building "H" review based on the City of Boynton Beach requirements. The
changes to the plans are outlined below:

The configuration for Building "H" has been modified. The residential portion
of Building "H" Gust to the west of retention pond # 3), previously comprised of
a multi-story building with 2 and 3 bedroom apartments, has been replaced by 8
town homes. The total number of residential units for this parcel has been
reduced from 80 units to 16 units (8 town homes and 8 apartments on the second
floor of Building "H" along Main Street). Please refer to site plan sheets C3 and
C5 for changes.
The previously proposed parking garage has been removed. That area is now a
parking lot. Please, refer to site plan sheets C3 and C5 for changes.
The western section of Building H has been removed. Please, refer to site plan
sheets C3 and C5 for changes.
There is a new round-about along Main Street located to the southeast of
Building H. Please, refer to sheets C3, C5, C9 for changes.
Utility Plans have been updated to service new building configurations. We
have also incorporated grease traps throughout the site at the locations of the
proposed restaurants. These plans have already been submitted and approved
by the Utilities Department Director, Mr. Peter Mazzella on 8/4/06. Please,
refer to sheets C 11 and C 13 for utility changes
Paving, grading and drainage plans have been updated to service new Building
H configuration. Please, refer to sheets C 16, C 18 and C3 1 for the changes.
Landscaping drawings have been updated with the new building configuration.
We have prepared a separate sheet comprising Building "H" exclusively.

The above referenced site plans, received on September 15, 2006, were reviewed for modifications to
the SMU portion of the development as listed in correspondence from the engineer-of-record, Kimley-
Horn & Assoc., dated 8/16/06. Following are our comments with the appropriate Code and Land
Development Regulations (LDR) referenced. Additional comments may be added after receipt of
missing information.
PUBLIC WORKS - SOLID WASTE
X Unable to evaluate the new configuration of dumpster and compactor at the southeast corner of
Building "D" as plan set provided is not complete. Provide Sheet C7 to allow backup and turning radii
to be reviewed.
X The proposed dumpster enclosure locations for Buildings "F", "G", "H-1", "H-2", and "J" are
unacceptable. Relocate enclosures to positions that do not require Solid Waste to maneuver in the
development roadways.
PUBLIC WORKS - FORESTRY & GROUNDS

As a result of the storm sewer alignment changes east of Building "L" the minimum 1 O-ft. separation
between utility lines is no longer met (City of Boynton Beach separation standards are more stringent
then the FDEP standards.) Adjust sanitary and storm sewer mains to provide 10-ft. separation or
submit a request for an administrative waiver to the Engineering Division of Public Works providing
justification for not being able to meet the standard.

Paving, drainage and site details will not be reviewed for construction acceptability at this time. All
engineering construction details shall be in accordance with the applicable City of Boynton Beach
Standard Drawings and the "Engineering Design Handbook and Construction Standards" and
will be reviewed at the time of construction permit application.

)( The correspondence regarding this minor modification (dated 8/16/06) state that the Utility plans
have been reviewed and approved by the Deputy Director of Utilities, Peter V. Mazzella. While
preliminary discussions have been held regarding the proposed changes they do not constitute
approval of the utility plan revisions. Following are comments regarding the changes proposed on
the plans and in the correspondence (date 8/16/06) submitted with the plans.
. 12. The proposed "header" configuration for sanitary sewer laterals to the west of the eight townhomes
(adjacent to Building "H-1") will not be permitted. Provide sanitary sewer main along the front of the
townhomes, with laterals properly tied into the main. Connect the new main to the sanitary sewer in
the primary east-west roadway (at the round-about.) Delete the proposed sanitary sewer that runs
from the mid-point of the proposed townhomes west and connects into the secondary roadway in
front of Buildings "K", "L", and "M."
. 13. Likewise, the sanitary sewer laterals for Buildings "J" and "K" will be re-evaluated at the time revised
Utility plans are submitted for review and approval.
. 14. Revise the water main loop around Building "H-1" and "H-2" so that the fire hydrant at the southeast
corner of Building "H-1" comes off the main, instead of the main coming off the fire hydrant lead.
. 15. A note for a 3-in. service line with a 2-in. meter is shown southeast of the eight town homes but no
line is shown. Please correct.

Dear Mr. Breese:
We are submitting the following sets of drawings for Minor Modlficattons reVIew
based on the City of Boynton Beach requirements. The changes to the plans are
outlined below:
· The configuration for Building "H" has been modified. The residential portion
of Building H (just to the west of retention pond # 3), previously comprised of a
multi-story building with 2 and 3 bedroom apartments, has been replaced by 8
town homes. The total number of residential units for this parcel has been
reduced from 80 units to 16 units (8 town homes and 8 apartments on the second
floor of Building H along Main Street). Please refer to site plan sheets C3 and
C5 for changes.
· The previously proposed parking garage has been removed. That area is now a
parking lot. Please, refer to site plan sheets C3 and C5 for changes.
· The western section of Building H has been removed. Please, refer to site plan
sheets C3 and C5 for changes.
· There is a new round-about along Main Street located to the southeast of
Building H. Please, refer to sheets C3, C5, C9 for changes.
· The east end of Building D has been slightly modified. It was desirable for the
tenant to have both a dumpster and a compactor. The loading area was
increased in order to accommodate the compactor. To compensate for the loss
of building area, the northern half of the building was extended towards the east.
Please, refer to sheets C3 and C5 for changes.
· The location of H/C spaces for Buildings E, I, J and K has been modified
slightly. Please, refer to sheets C3, C5 for changes.
· Utility Plans have been updated to service new building configurations. We
have also incorporated grease traps throughout the site at the locations of the

· Paving, grading and drainage plans have been updated to service new Building
H configuration. There have also been some other minor changes throughout
the site as a result of buildings getting close to final design. One of the more
significant changes occurs along the west end of Building L, where the drainage
structures have been shifted slightly to the east so as to be on the other side of
the water main running north-south. This was done in order to minimize the
water main deflections underneath the storm drains. Please, refer to sheets C16,
C 17, C 18 and C3l for the changes.
· Landscaping and Irrigation drawings have been updated with the new building
configuration.
· Photometries plan has been updated with the new building configuration.
· Updated Building H floor plan has been prepared by Pieper, O'Brien Herr
Architects. Please, refer to sheet A1.2
· Building H color elevation rendering has been updated per new building
configuration and new landscaping plans.
· The MSD and MOS sheets have been updated to reflect the recent site changes.

Attached please find a copy of our Master Plan approved under site plan
NWSP#05-004. Additionally, attached hereto is a minor modification to Parcel 6
at Boynton Village SMU, original site plan approved under the same NWSP#05-
004.
We have redesigned Main Street in our effort to build a project substantially as it
was approved. However, we would like to consider transfer of our 64 units of
density to a new sixth floor on to Parcels 4 and 5 at Boynton Village. This site
plan modification is coming in on May 1 ih, under separate cover. It was
originally approved under NWSP#05-019 for 376 units in 5 stories.
