I have reviewed the above referenced plat and have the following comments:
1. Plat (Sheet 2) - Sheet 2 does not appear to be labeled anywhere as Sheet 2.
2. Plat (Sheet 2) - Parcel D, as depicted on Sheet 2, is listed as Tract D on Sheet 1. Parcels A, B, and C
depicted on Sheet 2 should be labeled Tracts and described on Sheet 1.
3. Plat (Sheet 2) - The recreation area should be denoted as a separate Tract and described on Sheet 1.
4. Plat (Sheet 2) -Surveyor Note #3 states that building setbacks shall be as required by City code. The
project was approved as a IPUD with an associated Master Plan/Site Plan that established the
setbacks, not City code. This note should be either eliminated or modified accordingly.

Re: Requirement for a Record Plat Review

Dear Ms. Miskel:
This letter is in response to your letter of October 12th, received on
Friday, October 13th. Pursuant to your firm and your client's meeting
held here in our Engineering Division conference room on October 5th, we
will proceed to review all project improvement plans (paving, drainage
& utilities) prior to receiving (and approval of) the required record
plat for this development. Normally, and as you are aware, the City's
LDR requires the approval and acceptance of the required record plat
prior to the issuance of a Land Development Permit. This permit would
begin the process of approving and issuance of all development
(construction) permits for the various components of the development.
As agreed to in the meeting, if improvement plans are ready for
construction prior to the approval of the record plat, we would allow
construction to proceed while the record plat is being finalized.
However, please be advised that no certificates of occupancy would be
issued until such time that the record plat was approved and recorded
with the Clerk of the Circuit Court of Palm Beach County, Florida; this
was also noted in your letter.
We will expedite our review of the proposed record plat once received.
To meet this end, we will need four (4) copies of the property survey
and two (2) copies of the paving and drainage plans; these are
necessary for the coordination of the driveway access points in
relation to the record plat boundaries and the adjacent roadway. Any
and all utility easements necessary to support this project will be
coordinated directly with the Utility Department and copies to this
Division.

Once we received all plat comments from the various City Divisions
that review same, we will transmit a comments letter to the record
plat preparer directly for review and response. As stated at the
above noted meeting, a boundary record plat (as a minimum) is
necessary to reflect all of the combination of individual lots and/or
the building tracts (including any abandonments) that have been
assembled for this project.
Please be advised that the boundary record plat will require any and
all new utility easements to be shown, access easements (driveway
connection points) to the property at the respective points along with
the 5-foot limited access easement (L.A.E.) along Federal Highway.
Other development requirements may generate notations that could be
required on the record plat.

the Land Use Amendment process, but in accordance with the adopted school concurrency
program, this land use amendment will require concurrency review in conjunction with the
rezoning/site plan applications prior to issuing a residential site plan development order.
Beginning with the 2004-05 school year, the level of service for all CSA's will be reduced to
110%. Developments which will begin construction in 2004 or later will be required to be
evaluated against the 110% LOS for school concurrency. Further, the schools referenced
above that would currently serve the proposed development are subject to change due to
boundary adjustments, to equalize utilization, or to provide capacity for the new student growth.

I visited the site this morning and there are actually a total of 7 Black
Olive trees. There are also 2 very unhealthy mango trees, 4 Queen Palms
that have almost no green in them and 2 small coconut palms that look worse.
The only trees that look healthy and are located so that we can easily save
them are 4 Washingtonian Palms. We will integrate them into the landscaping
of the temporary sales office that we are planning for the front of the
property and then use them on site (additive to the plan submitted) behind
the sign wall at the entry in a cluster.

Enclosed are revised landscape plans that address some of the TART comments.
Specifically, Sheet LP6 includes adjacent properties buildings on the cross-sections. Plans were
revised with additional palms adjacent to the buildings to better screen the buildings (LP3 and
LP4), and the Plant Schedule was updated with the increased number of plants. The note on
Sheets LP1-LP4 were revised to indicate that the irrigation system may be able to be operated
from the existing water meter. On Sheet LPl, alexander palms were changed out with sable
palms to provide additional native materials.
It should be noted that the correct date of the teleconference discussed in response to
TART comment #43 was May 12,2005.
It should also be noted that the correct answer to TART comment #57d is "no", as
contractual service providers are not considered employees.
It is understood that the other TART comments will be placed as conditions of approval
in the project development order, and these comments will be addressed on the rectified site plan
at the time of construction plan submittal/permitting.
The Applicants acknowledge that an analysis of downstream sewer capacity must be
further evaluated. The Applicants further acknowledge that capacity improvements may be
necessary to the downstream lift station to serve the subject project, and in such event that they
are financially responsible for such improvements.
Enclosed is also a draft letter to Willie Swoope, Impact Fee Coordinator, to better address
comment # 57.

Yes, it is all one project as planned but the types of buildings take
varying times to construct. We would start the condo building first and
when it is at a shell stage, then we would start the town homes and the
amenity building with the hopes that they would all finish out at the

issues for your proposed townhouse / condo project.
Recently, there were 2 other mobile home parks that were redeveloped for
towhomes. Initally, the residents were worried and came to voice their
opinion at the public meetings. However, afterwards, the transition was
smooth because the developer went above and beyond the requirements of
the
state statutes.
How are you coming along with your mobile home park? I know that you've
submitted your relocation study but can you tell me more about the
communication that the developer has had with the current residents. We
want to avoid problems at the June CRA meeting and we want to get your

Enclosed please find several revised sheets requested in the TART
meeting.
1) Pavilion Elevation with 30'-0" height dimensions.
2) Gazebo Elevation with 16'-8" height dimensions
3) Site Plan (4 shts) indicating the new sidewalk along Fed. Hwy. and
through the development. They also illustrate the new increased
planting area along buildings 300-600.
4) The details of the "Buffer Wall". I didn't send the spec. sheet
because I don't know it they are going to use that particular
company. I did however limit the height to 6'-8" for the piers.
I have a question about the new colored renderings;
You need me to re-color them with the actual landscaping? Thafs

Concurrency Traffic Statement
Dear Mr. Rumpf:
The purpose ofthis letter is to provide a traffic impact analysis for a 3.51 acre site located in the City
of Boynton Beach. The site is located on the east side of Federal Highway approximately one
quarter (1/4) mile north of Gateway Boulevard, as shown on Exhibit 1. It is proposed to develop 70
townhomes. The purpose of this letter is to determine if the requirements of Article 12, Traffic
Performance Standards, of the Unified Land Development Code (ULDC) have been met.
Exhibit 2 provides the daily, AM and PM peak hour trip generation for the proposed project. The
proposed residential project is located in the Coastal Residential Exception Area and is therefore
excepted from the standards. Therefore, the requirements ofthe Traffic Performance Standards have
been met.
Exhibit 3 provides the driveway volumes. A preliminary site plan is also attached for your use.

Lake City Trailer Park
The Lake City Trailer Park was licensed as a Prospectus Park by the Florida Department
of Business and Professional Regulation (DBPR) in 1986 for 45 mobile homes, Lake City
Trailer Park may be improved with 45 mobile home lots or spaces, but only 32 are currently
occupied with units, Of these 32 mobile home lots or spaces, 25 are leased by long-term tenants,
the other 7 lots are occupied by short-term tenants, two of these being motorhomes and one a
recreational vehicle.
Registration data was obtained from the Florida Department of Motor Vehicles (DMV) to
verify the number of mobile homes within Lake City Trailer Park that have valid, current
registrations (see Exhibit "A"), Any vehicle that does not have a current registration is assumed
to be abandoned by the owner. Along with validity of registration, DMV data regarding the age
or model year of each mobile home was obtained to determine whether the unit is disqualified
from relocation due to its age.
Chapter 723, F.S., Mobile Home Park Lot Tenancies, Notifications
Chapter 723,081, F,S, requires that each mobile home owner be notified in writing of any
application for a change in zoning of the mobile home park, This notification is required within
five days of the filing for such zoning change with the zoning authority, the City. There is no
homeowners' association established for Lake City Trailer Park. Each mobile home park owner
will receive notification by U.S. Certified Mail regarding the proposed rezoning petition. A
sample letter is included as Exhibit "B".
Chapter 723,061(1)(d), F.S, specifies that all tenants of a mobile home park must be
given six (6) months notice of a projected change in use and of their need to secure other
accommodations, This notification, pursuant to the purchase agreement, cannot occur until the
proposed land use amendment and rezoning are approved by the City of Boynton Beach,
Therefore, this notice of eviction is anticipated to be forwarded in May, 2005.
Relocation of Mobile Home Owners
If a mobile home owner is required to move due to a change in use of the land, he is
entitled to payment from the Florida Mobile Home Relocation Corporation. In addition to the
payment into the Florida Mobile Home Relocation Trust Fund, pursuant to Chapter 723,06116,
Waterbrook Homes, LLC, as contract purchaser, will assist each mobile home owner in their
effort to secure other accommodations. Information has been compiled that identifies the
licensed mobile home parks in Palm Beach County, Availability of vacant lots or mobile homes
has been compiled, along with mobile home mover information (see Exhibit "c" and Exhibit
"D").
Tenant information from the Property Owner suggests that only 25 residents/families will
need to find other accommodations, by virtue of their leases. Of these 25 tenants' mobile home
units, only 11 of the mobile homes have valid registrations, and assuming those that expired at

the end of 2004 are simply late registrations, 15 mobile home owners would meet the criteria for
relocation assistance through the Florida Mobile Home Relocation Trust Fund.
In evaluation of the DMV data for Lake City Trailer Park, it has been determined that
none of the mobile homes were manufactured after 1993; and only 3 of the mobile homes were
manufactured between 1976 and 1993, These three mobile homes may be relocated to another
mobile home park that is located within Wind Zone 2, The data shows that the other mobile
homes were manufactured prior to 1976, and therefore, may not be relocated,
Vacant lot availability information (Exhibit "C") that was gathered for licensed mobile
home parks in the Boynton area suggests that there over 200 vacant lots, which is sufficient for
Lake City Trailer Park relocation needs, Of the 22 mobile homes that are too old to be relocated,
mobile home availability information suggests that there are sufficient mobile home units
available for sale to accommodate the Lake City Trailer Park unit owners. This information will
be shared with the residents, as well as a listing of qualified mobile home movers (Exhibit "D").

client, Waterbrook Homes, LLC, a Florida limited liability company, contract purchaser of the Lake City
Trailer Park (the "Property"),. and pursuant to the requirements of Section 723.081, Florida Statutes, as
amended. Section 723.081, Florida Statutes, requires that the Property owner notify in writing to each
mobile home owner notice that a rezoning petition has been submitted to the City of Boynton Beach
("City"). The rezoning petition was submitted to the City on Friday, March 18, 2005 requesting that the
Property be rezoned from the R-3 and C-3 zoning designations to Infill Planned Unit Development
(IPUD) zoning designation in order to develop a seventy (70) unit gated townhome and condominium
community on the Property.
