Dear Mr. Johnson:
I am requesting a new height exemption for the elevator shaft and stair as our previous
approval submission dated November 19, 2003 has expired.
There is no adverse effect on the adjoining building which is a three-story structure or on
the east side of the building since the building stair and elevator face west and the canal
and FP&L easement. The same developer owns the adjoining building. This building
footprint was approved when the first building was site plan approved and built. There
will be no shadows that will affect the surrounding areas. The height exception is
required to allow the override of the elevator and the stairing will allow access to the roof
for alc maintenance. The height of the stair and elevator shaft will enhance the exterior
design of the building by providing an entrance feature that is both conservative in design
and functional. These features face west across the canal to an additional three-story
office building. Commercial zoning surrounds the entire land area of this project.
Therefore, we are requesting this height variance, as it does not affect any adjoining
structure or any adjoining land areas which are all zoned commercial.

Conditional Use for Height Exception
Dear Mr. Johnson:
Per the Zoning Code, when a building has parking beneath the structure, you are allowed
to request a conditional use to raise the maximum building height to 35' above the flood
zone in lieu ofthe 30' maximum building height allowed without parking below.
The Standards for Conditional Use are met in all instances by this building. Ingress and
egress as well as off-street parking and loading zones have not varied by modifying the
height of the building to comply with the conditional use. We meet all the zoning
requirements that are necessary as to setbacks and conformance as to standards. There is
no adverse economic effect on any adjacent properties and, in fact, the building is an
asset to all the surrounding properties as it is adding new landscaping and an aesthetically
inviting structure to a now vacant and baron portion of land which is on one of the main
entrances to the City. The additional 5' of height is for the screening of the mechanical
equipment on the roof of the building. We have provided an exceptional landscape plan
that exceeds all the standards per your landscape code and, in fact, we are providing an
attractive and functional landscape buffer along the west property line.
We, therefore, have provided an exceptionally well designed and visually pleasing
building which will be an asset to the City and its residents.

building to fruition.
