TRAFFIC PERFORMANCE STANDARDS REVIEW
Dear Mr. Rumpf:
The Palm Beach County Traffic Division has reviewed the traffic study and responses to
comments for the proposed project entitled; Winchester Property, comprised of two
planned developments called; Boynton Town Center & Boynton Village, pursuant to
the Traffic Performance Standards in Article 12 of the Palm Beach County Land
Development Code. This project is summarized as follows:

Based on our review, the Traffic Division has determined that the proposed mixed-use
project meets the Traffic Performance Standards of Palm Beach County, under the
following conditions:
· No building permits for more than 190 new external PM peak hour trips until
construction begins for addition of third WB and EB through lanes on both
approaches of Gateway Boulevard at the intersection of Congress Avenue.
· No building permits for more than 461 new external PM peak hour trips until
construction begins for addition of NB dual left-turn lanes with proper receiving
lanes, or adoption of appropriate CRALLS, for the intersection of Old Boynton
Road and Congress Avenue.
· No building permits for more than 733 new external PM peak hour trips until
construction begins for addition of exclusive EB dual left-turn lanes with
appropriate receiving lanes, or adoption of appropriate CRALLS at the
intersection of Old Boynton Road and Congress Avenue.
· No building permits for more than 896 new external PM peak hour trips until
construction begins for addition of an exclusive EB right-turn lane at the
intersecti.on of Gateway Boulevard and Congress Avenue,

· No building permits for more than 963 new external PM peak hour trips until
construction begins for 5-laning of Old Boynton Beach Boulevard, from
Congress Avenue to Boynton Beach Boulevard, or adoption of appropriate
CRALLS, for all or some links along the arterial segment.
· No building permits for more than 1,018 new external PM peak hour trips until
construction begins for addition of an exclusive SB right-turn lane or adoption of
appropriate CRALLS, at the intersection of Gateway Boulevard and Congress
Avenue.
· No building permits for more than 1,181 new external PM peak hour trips until
construction begins for addition of exclusive SB dual left-turn lanes at the
intersection of Old Boynton Road and Boynton Beach Boulevard.
· No building permits for more than 1,208 new external PM peak hour trips until
construction begins for 6-laning of Congress Avenue, from Lantana Road to
Hypoluxo Road.
· No building permits for more than 1,348 new external PM peak hour trips until
construction begins for 6-laning of Congress Avenue, from Lantana Road to
Melaleuca Lane.
· Exclusive turn lanes are required the following project access locations, where
not available:
o SBL and NBR turn lanes along Congress Avenue at the north-most
project access driveway.
o SBL turn lane along Congress Avenue at the middle project access
driveway.
o NBR turn lane along Congress Avenue at the south-most project
access driveway.
Within six (6) months from the date of municipal development order, the developer must
enter into a Public Facilities Agreement (PFA) with Palm Beach County to fund and/or to
construct any and all improvements that are not "Assured Construction" as the term is
defined by the Traffic Performance Standards Ordinance. The PFA must be in a form
acceptable to the Country Engineer. The municipality shall not issue any building
permits associated with the project unless and until the PFA has been approved by the
Board of County Commissioners.
No building permits are to be issued by the City, after the build-out date specified above.
The County traffic concurrency approval is subject to the Project Aggregation Rules set
forth in the Traffic Performance Standards Ordinance.
The following are suggested to the City.of Boynton Beach:
· Consider implementation of traffic circulation mitigation measures identified in
the "Central Boynton Beach Regional Traffic Circulation Study" which has been
required from the consultant. This report is targeted to identify peak hour
operational problems and identify improvements, which includes extension of
storage lengths at exclusive turn lanes at all intersections within the project area
of influence.

· Because of the high forecasted volumes for Gateway Boulevard, and the
proposed mitigations necessary for this approval, it is suggested for the City to
look into 6-laning of Gateway Boulevard, from Congress Avenue to High Ridge
Road.
· Due to the high forecasted peak hour volumes, provision of the following
intersection turn-lanes are suggested where possible:
o SBR at the intersection of Congress Avenue and Old Boynton Road.
o Additional second WBR lane at the intersection of Boynton Beach
Boulevard and Old Boynton Road.
o NBR at the intersection of Gateway Boulevard and High Ridge Road.
This determination is subject to the conditions set forth in this letter. These conditions
must be included in the Development Order issued by the City. The Development Order
must also provide that failure to meet any of these conditions shall give the County
Engineer the right to rescind or amend the approval granted in this Traffic Performance
Standards Review Letter.

completed surface water managcament system occur, the District will require! the
permittee to provide appropriate mit~gation to the Oi$trict or other impacted pa~ty.
The District will nquire the permittee to modify the surface waUl.' manaljJement
system, if necessary, to eliminate the cause ot the adverse impacts.

1. All activiUes authorized by tbis permit shall be imph1'tl.ented as set forth in the
plans, spec.i.tications and perforlllance criteria as approved by this permit. Any
deviation from the permitted activity and the conditions for undertaking that
activity ~hall constitute a violation ot this permit and Part IV, Chapter 373. F.S.
2. This permit or a co~y thQreof, compiQte with all conditions, attachments, exhibits,
and modifications shall be kept at the ~o:rk site of the peJ;'1l1i tted activity. The
complete pernrlt shall be available for review at the work site upon request by
District staff. The permittee shall require the contractor to review the complete
permit prior to commencement of the activity authorized by this permit.
3. ACtivities approved by this permit shall be conducted in a manner which does not
cause violations of State water quality standards. The permittee shall irnpl~ent best
management practices for erosion and ~ollution control to prevent violation of State
water quality standards. Temporary erosion eontrol shall ge implemented prior to and
durinq construction, and permanent control measures shall be completed within 7 days
of any construction activity. Turbidity barriers shall be installed and maintained
at all locations where the possibility of transfarrinq suapended solids into the
rece! dnq waterbody existlS due to the permitted work. Turbidi ty barriers shall
remain in place at all locations until construction is completed llnd !Ioils are
stabilized and veqetation has been established. All practices shall be in accordance
with the quidelines and specifications described in Chapter 6 of the Florida Land
Development Manual; A Guide to Sound Land and Water Management (Department of
Environmental Requlation, 1989" incorporated by reference in Rule 40E-t,091, F.A.C.

within 30 days of the date that this permit is issued. At least 48 hours prior to
commencement of activity authorized by this permit, the permittee shall submit to the
Oistrict an Environment~l Resource Permit Construction Commencement Notice Form
Number 0960 indicatinq the actual start date and the expected construction completion
date.
S. When the duration of construction will exceed One year, the permittee shall submit
const:r:uction status reports to the District on an annual basis utilitinq an annual
status report form. Status report forms shall be subJUitted the follotfinq June of
each year.
6. Kithin 30 days after completion of construction of the pemltted activity, the
pemitee shall suJ:nnit a writteJ1 statement of cOJllplllltion and certification by a
protessional engineer or other individual authorized by law, utilizin9 the supplied

specification.. Thi$ submittal shall eerve to notify the District th.t the system is
ready for inspection. Additionally, if deviation from the approved drawings are
discovered during the certification process, the certification mu~t be accompanied by
a copy of the approved pexmit drawinqs with deviat1on$ noted. 50th the ori~inal and
revised specifications must be clearly shown. Th. plans must be clearly labeled as
"as-built II or "record" drawings. All surveyed dimensions and elevat;l.ons shall be
certified by A registered surveyor.
7. The operation phase of this permit shall not become effective: until the permittee
has complied with the requirements of condition (6) above, and submitted a request

tor conversion of Environmental Re~ource Permit from Construction Phase to Operation
Phase, Form No. 0920; the District determines the system to be in compliance with the
permitted. plan. and specifications; and the entity approved by the District in
accordance with Sections 9.0 and 10.0 of the Suis of Review for Environmental
Resource Permit Applications within the South Florida Water Management District,
accepts responsibility for operation and maintenance of the system. The permit shall
not be transferred to such approved operation and m,,;i.ntenance entity until the
operation phase of the permit becomes effective. following inspection and approval
of the p.~itted system by the ~lstrict, the pe~ttee shall initiate transfer of the
permit to the approved responsible operating entity it different from the permittee.
Until the permit is transfe~red purau4nt to Section 40E-l.6107, F.A.C., the permittee
shall be liable for compliance with the terms of the permit.
B. Each phase or independent portion of the pe.rnUtted systllm must be completed in
accordance ~ith the permitted plans and permit canQitions prior to the initiation of
the permitted use of .site inf~!l.St~uctu~e located within th<< area served by that
portion or phase of th~ system. Each phase o~ independent portion of the system must
be completed in accordance with the permitted plans and permit conditions prior to
h:arurfer of responsibility for operation and maintenance of the phase or portion of
the system to a local government or other responsible entity.
9. For those systems that will be operated or maintained by an entity that will requir~
an e..ement or deed restriction in order to enable that entity to operate or maintain
the system in conformance with this permit, such easement or deed restriction must be
r.corded in the public records ~nd submitt.d to the District along with any other
final operation anc::l. maintenance document::l required by Section$ 9.0 and 10.0 of the
!3asil!l of Review for Environmental Re~ource Permit applications within the South
Florida Water ManAgement l:listrlct,prlor to lot or units sales or prior to the
completion of the system, whichever comes first. Other documents concerning the
eshblhhm$nt and authority of theopenting entity mwst be filed with the Secretary
of State, county lOr municipal entities. Final operation and maintenance documents
lIluat be received by the District when maintenance and operation ot the system is
accepted by the locd government entity. Failure to submit the appropriate final
documents will result in the permittee remaining liable for carrying out maintenance
and operation of the permitted system and any other permit condition,.
10. Should any other regulatory agQncy require changes to the permitted system, the
permittee shall notify the Oistrict in writing of the changes prior to implementation

permittee, or convey any right/! or privileges other than those specified in the
permit and Chapter 40&-4 or Chapter 40E-40, F.A.C..
12. The permittee is hereby advised t~t Section 253.77, F.S. state/! that l!l person may
not cOlI'lIlIence any excavation, construction, or other activity involving the use of
sovereign or other lands of the. St.te, the title to which is vested in the Board of
Trustees of the Internal Improvement Trust Fund withaut obtaining the required lease,
license, easement, or other form of consent authorizing the propo~ed use. Therefore,
the permittee is responsible for obtaining any necessary authorizations from the
Board of Trustees prior to commencing activity on sovereignty lands or other _tat*-
owned land..
13. The permittee mU5t abtain a Water Ose permit prior to constructian dewaterin9, unless
the work qualifies for a general permit pursuant to Subsection 40E-20.302(3), F.A.C.,
al~o known as the "No Notice" Rule.
14. The permittee shall hold and say. the District harmless trom any and all daru.ges,
Claw, or liabilities which may adse by reason of the construction, alteration,
operation, maintenance, removal, abandonment or use of any system authorized by the

15. Any delineation of the extent of a wetland or other surface water submitted as part
of the permit application, includin9 plans or other 8upportin9 documentation, shall
not be conlllidered bindinQ, unless ~ spec;i,t:l.c condition ot this pe;mit or il formal
determination under Section 373.421(2), r.s., provides otherwise.

conveYllncs, or other transfer of ownership or control of Ii permitted system or the
rsal property on which the psrmitted system is located. ~ll transfers of ownership
or transfers of 8 permit are sUbject to the requirements of Rulos 40~-1.6105 and 40E-
1.6107, F .A. C. . The permi ttee transferring the pernai t shall remain liable for
corrective actions that may be required as a result ot any Violations prior to the
sale, eonveyance or other transfer of the system.
17. Upon reasonable notice to the pe:rmittee, DilJtrict authorized IJtaff with proper
identifioation shall have permission to enter, inspect, sample and test the system to
insure conformity with the plans and specifications approved by the psrmit.
lB. If histo~ical or archaeological artifact. are diacoverea at any time on the project
site, the peImittee shall immediately notify the appropriate District service center.
19. The permittee shall i.1mnediately notify the District in writing of any previously
submitted intor.m~tion that is later discovered to be inaccurate.

from the date of issuance of the permit. ConceJ'ltuBI approvals which have no Individual or standard
general envirOnmental resource permit appticatlons filed for a period of two years shall expire

(b) Far a conceptual approval fIJed concurrentfy with .. de'telopment of regional impact (DRI)
appfleatlon for development appnMIl (ADA) and a local government comprehensive plan amendment, the
duration of the eonceptual approval shall be two years from Whichever one of the foUowlng occurs at the
bItest date:
1. the effective date of the locsl govemrnenfs comprehensive plan amendment
2. the ~e date of the loeal government dhelopment crder.
3. the date on which the DIStrict issue, the conceptWllapproval, or
4. the latest date of the resolution of any Chapter 120.57, FAC., administratiVe proceeding
or ether legal appeals.
(e) For an individual or &tandard general environmental resource permit, five years from the
date of issuance or such amount of time as made a condition of the permit.
(d) For 8 noticed general permit issued pursuant to d'lapter 40~E-400, F.A.C., five years from
the date the nctic:f of Intent to use the permit Is provided to the Diatrlct
(2)(1) Unless pre$Cribed by special permit condition, permits expire automatJcally according 10
the timeframes Indicated in this rule. If application for extension Is made in writing pursuant to subsection
(3), the permit shan remain in full farce and effect until:
